We have visited the site, reviewed the plans, specifications and addenda (thru #6). The “suggested grout pipe layout schematic” on drawings BP101-103 is the basis of our costs. The final design is the responsibility of the specialty contractor and upon award discussions regarding probable settlements from SEM will be needed to finalize the design. Based upon available information it is anticipated additional holes and monitoring points (drawing BP011) will be needed, and will be added costs at the unit prices below. As discussed in the meeting the headhouse excavation will be stopped at approximately El. 90 for the drilling and grout pipe installation. Utilizing 2 rigs 2 shifts we will need 8 to 10 weeks to complete. A minimum 8 feet wide “cat walk” working platform along the wall and holes will be needed to complete the pre-condition and the cavern excavation compensation grouting. Understanding staging area is critical, we can compact our operations in a minimum area 20 by 30 feet by stacking containers 3 high. In addition, HB can provide Jet Grouting and Permeation Grouting services as requested for the SEM work. We can supply either or both cement, microfine or chemical penetration grouting. Compensation Grouting Items included in our proposal for this project are as follows: All labor, equipment, materials, and supervision to perform the drilling and “sleeve port grout pipe” (SPGP) installation, Procurement, software, and Installation of Liquid Level System (LLS) for heave monitoring (with integration into global job computer data system), All labor, equipment, materials, and supervision to perform the precondition consolidation grouting, All labor, equipment, materials, and supervision to perform compensation grouting during SEM cavern excavation and support work, Testing, quality control and quality assurance for the compensation grout work as described in the contract specifications, Submittals and shop drawings required for our work. Provision of electric power up to 400 amp service at 440 volts, All lighting, ventilation, and noise control, Upon completion, SPGP removal / withdrawal, grout backfilling, & repair/seal of the diaphragm wall, Safety and sanitation facilities for workers, Any and all traffic control required for the work, Inspection, permits, and easements necessary to perform the work Additional items as further described in our general terms and conditions. SUMMARY HB believes that the compensation grouting process is ideally suited to the particular needs of this project. HB has successfully utilized this technology for similar projects in the US and Europe on many occasions, and can provide references and project lists upon request. Additionally, HB has the resources (equipment and personnel) to adequately handle this work, and as the largest specialty foundation contractor in the United States, we have the financial backing and bonding capacity necessary to complete this work. Please find attached a list of HB completed soilfrac compensation projects. HB includes the LLS monitoring in our proposal because it is critical to the control of our injection. We have worked with GeTec (designer, manufacturer and setup) on over 8 major compensation projects to date. Their system is capable of repeatedly providing data to 0.2 millimeters, which allows us not only real-time settlement but also tells us if the settlement is slowing down or speeding up. This letter and its attachments constitute HB's proposal and will be made a part of any contract between yourselves and HB. The acceptance of the price of this Proposal shall evidence the concurrent acceptance of all terms and conditions recited herein or incorporated by reference. We have enclosed our Schedule of Prices and our General Terms and Conditions, herein. Our bonding rate is one percent. The Lump Sum price for Building Protection Work shall be full payment for Work and Materials indicated on Building Protection BP Drawings and as stated in Sections 01 76 29 Protection of Existing Properties, 31 09 13 Geotechnical Instrumentation and Monitoring and 31 09 15 Structural Instrumentation and Monitoring, except as provided under other Bid Items. Only those Items that are shown on the Building Protection BP Drawings and related Specification Sections, will be measured for payment. Any such items required elsewhere shall be considered Incidental to the Work of for which it is needed. b. Estimates for progress payment purposes will be made based on the Contractor’s approved Schedule of Values, which shall include furnishing, installing, maintaining, protecting, making measurements, interpreting, reporting, removal, and location restoration of items compensable under this Bid Item. c. The costs for Compensation Grout Holes and Compensation Grouting will be paid under other Bid Items 18 and 19 below. BID ITEM 18 — COMPENSATION GROUT HOLES a. The unit price for Compensation Grouting Holes shall be full payment for the cost of Work and Materials necessary for investigation/surveying, drilling, pre-conditioning, pre-heaving of buildings, de-watering, tie-back cutting, pre-grouting, and abandoning filled compensation grout holes. b. Only compensation grout hole work shown on the Building Protection BP Drawings and related Specification Sections, and as approved by the Engineer will be measured for payment. c. The cost of re-drilling and casing holes, and temporary changes to driveways, walkways, and landscaping for Compensation Grout Holes Work shown on the Drawings, is Incidental Work to this Bid Item. d. The cost of performing compensation grouting is paid under other Bid Items. e. Estimates for progress payment purposes will be made based on the length of the hole as indicated on the Drawings, measured by the lineal foot, and multiplied by the unit price bid. Item BI-19B covers standby or compensation grouting as needed utilizing General Contractors labor (estimate 3 to 5 laborers required to handle / control packers placement, cleaning etc. of SPGP’s and help batching, mixing and pumping operations). General Contractor provides their labor for training during pre-conditioning work. All grouting equipment, monitoring equipment, computer data acquisition and computer monitoring, along with grout materials are included in the above items. With regard to Item BI-19B and/or C, a total minimum charge of 24 shifts per month applies. Hayward Baker June 4, 2012 Chinatown Station SFMTA Contract 1254 Chinatown Station Hayward Baker Grout Proposal Page 5 of 6 GENERAL TERMS AND CONDITIONS FACILITIES BY OTHERS The following facilities and services are to be provided to HB by others free of all costs to HB: Site Access: Unrestricted and uninterrupted access, ventilation, and lighting to the work site / headhouse excavation during the period of HB's operations suitable for our equipment moving under its own power. Off-loading and placement of equipment and supplies to and from the working surface in the headhouse. Work Platform for Drilling: Level floor area of excavation along concrete diaphragm wall of headhouse at 1 st bracing level as shown on drawings BP102 & BP 103 for diesel hydraulic powered crawler drills for SPGP hole locations noted on drawing BP 101. A minimum of 25 feet working space from wall is required for drill operation and inserting SPGP’s. Work Platform for Grouting: A minimum 8 to 10 feet wide working platform along the headhouse concrete diaphragm wall to allow workers with long straddle packers, connecting hoses, hose reels, small high pressure pumps, etc. to perform the pre-condition and compensation grouting. Designed and approved by Cal-OSHA, and designed such that water and grout runoff is routed to protect workers below. Waste Control: Containment, removal, and disposal of waste cuttings and wash water from both drilling and grouting operations. Utilities: All existing above and below ground utilities, which may be affected by the work, shall be located and exposed, removed, or relocated. The extent and location of adjacent utilities and services left in place shall be clearly and accurately marked out on site and shown to an HB representative prior to the commencement of work. HB cannot accept responsibility for any damage to any such utilities not thus indicated. Furthermore, it is possible that damage may occur as a result of heave, settlement, and/or intrusion of grout due to unforeseeable condition of the ground or utility. For this reason HBI cannot accept responsibility for damages thus caused. Surveying: All survey of all necessary lines and grades from which HBI's work can be easily established. Permits and Easements: All site permits and easements required to legally perform the work. Sanitary Facilities: On-site sanitary facilities for the use of HB employees. Site Yard: A minimum area of 650 square feet to permanently locate our material, batch, mix, pump equipment, office and supply storage directly adjacent or inside the headhouse and site office. Electrical: Supply of up to 400amp/440volt power for equipment, shop, office, and headhouse grouting platform. Water: Adequate supply of suitable clean fresh water supplied to within 100 feet of HBI's operations at the rate of up to 70 gpm. Traffic Control: All pedestrian and vehicular traffic control including personal, signs and barricades, if and when required. Security: Site security for our personnel and equipment during the duration of work. PROGRESSION OF WORK HB's proposal is based upon carrying out the work in a continuous unobstructed manner. Two shift operations are planned with regard to headhouse horizontal drilling and grouting work, with maintenance work on Saturdays. In the event that HB's work is interrupted for any reason beyond our control HB shall be compensated at $3,800.00 per shift for each crew delayed. At this present time, HB anticipates commencing work on-site within 8 weeks of receipt of a written acceptance and approval of submittals. Progress payments will be submitted monthly and shall be payable within 30 days of the invoice date. All amounts due, including retention (if any), will be paid in full within 45 days of completion of HB's work regardless of the anticipated project completion date. An interest charge of 1 percent per month and all costs of collection, including reasonable attorney’s fees and court costs, will be added to overdue accounts. In the event payment is withheld for reason not the fault of or within the direct control of HB then payment shall be made at the time and in the amount originally scheduled. STANDARD CONDITIONS Standard Term of Subcontract: Our proposal is based upon a performing the work under a standard form of contract (either AIA form A401 or AGC form 640) with this proposal as the prevailing contract document. Changed Conditions: If the ground, structure, or site conditions differ from those offered at the time of bidding and referred to in this proposal, HB reserves the right to obtain an equitable price adjustment to compensate for extra work and impacts as a result of the changed condition. Confidentiality: All specifications, drawings and technical data submitted by HB are to be treated as confidential and shall not be disclosed to any third party without express written consent of HB. Such information shall remain HB's property and be returned to HB upon demand. Hazardous Material: In the event that Hayward Baker encounters any material on the site, as defined in 29CFR1910, which has not been rendered harmless, HB shall immediately stop work in the area affected and report the condition in writing to the Owner and Engineer. To the fullest extent permitted by law, the Owner and Contractor shall indemnify and hold harmless HB, their agents, consultants, and employees from and against all claims, damages, losses and expenses, including but not limited to attorney fees arising out of or resulting from performance of the work in the affected area. Labor: This proposal is based upon using union labor. Insurance: HB will provide insurance in accordance with the contract documents. Liability: No liability can be accepted by us, nor shall we accept as in any way our responsibility defects of any kind whatsoever arising from a cause which is outside our immediate control or knowledge, or for any fault in the junction between our work and subsequent work carried out by others. Indemnity: Subject to the terms of the Liability Clause above, and to the correct soil conditions having been provided to us prior to our work, HBI shall indemnify and insure the Contractor from and against all claims, damages, losses, and expenses, but only to the extent of the negligence of HBI, and provided that such claim, loss damage or expense is attributable to 1) bodily injury, sickness, disease or death, or to 2) the injury to or destruction of tangible property (other than the work itself), and only to the extent such claim is covered under the Commercial General Liability Policy of HBI. Liquidated Damages: The Contractor shall not be entitled to any liquidated damage, delay damage or other time related penalties arising from the work. Force Majeure: HB cannot accept any liability for default or delay in the completion of the work when caused by strike, riot, war, or Act of God or other similar circumstances beyond HB's control. Bonds: The cost of a bond premium is not included in our contract price. Exclusions: Any items of work not specifically included in this proposal shall not be the responsibility of HB.
