Request:
Zone Variance (ZV) to allow a 20.5 square foot trash area within the front one-half of the site in
lieu of the required rear one-half of the site location.
1. The intent of locating the trash/recycling area to the rear portion of the site is to protect the
nearby residential property aesthetics, etc. However, the residential is bordering this particular
site along the rear portion of the site and the commercial type uses are bordering this site along
its front portion of the site. Therefore, the granting of this zone variance will be consistent with
the intent of the zoning regulation as it pertains to the location of the trash/recycling area.
2. The rear portion of the site abuts residential. Locating the trash/recycling area will adversely
impact the residents of the neighboring properties. Also, the residents will have to endure such
impacts as trash odors, aesthetics, and etc. However, location the trash/recycling area to the
front portion of the site will not significantly impact the surrounding commercial establishment.
Therefore, there are special circumstances applicable to this site location that does not apply to
other property in the same zone.
3. As previously stated, the rear portion of the site abuts residential and the front portion of the
site abuts commercial type uses. Therefore, zone variance to allow the trash/recycling area to
be located in the front portion of the site is necessary for the preservation and enjoyment of the
abutting residential properties.
4. The rear portion of the site is surrounded by residential. Location of the trash/recycling area
in the required rear portion of the site will result in the smelling of obnoxious odor by the
residential properties bordering the site. However, the front portion of the site is surrounded by
commercial type uses. The proposed plans identify the trash/recycling area in the front portion
of the site. The location of the trash/recycling area is situated in an area of the site that will not
adversely affect the residential properties in the immediate area. Therefore, the granting of the
zone variance will not be materially detrimental to the public welfare or injurious to the
properties in the general vicinity.
5. The location of LC&WB is in harmony with the various elements and objectives of the City’s
General Plan.
