OHIM and Europol are working together to identify and assess the current situation of the trade in
counterfeit and pirated products affecting the EU. OHIM’s contribution will be through the European
Observatory on Infringements of IPR, which was been part of the Office since 2012.
This questionnaire forms part of the data collection process. The collected data will be analysed and
eventually used for the drafting of a joint OHIM – Europol “Situation Report on Counterfeiting (through
online and offline distribution channels) in the EU” as well as in other reports on the extent and economic
impact of infringement of IP rights.
The term “counterfeiting” in this questionnaire refers to infringements of trade marks, copyright, patents
and design rights related to tangible products. The term “piracy” refers to infringement of copyright in
audio-visual products such as music and films, as well as e-books, photographs and similar products that
are distributed online.
