DEFINITIONS
CR 154-2.2b
Bilingual Education program shall mean a research-based program comprise of three components:
1) language arts component including Home language arts (HLA) and ELA
2) English as a new language (ENL) component (see below)
3) bilingual content area instructional component in at least two core content areas (math, science, and social
studies)

English as a new language shall mean a research-based program comprised of two components:
1) content area (ELA, math, science or social studies) instructional component in English (integrated ENL)
2) English language development component (stand-alone or integrated ENL)

Home language arts shall mean a unit of study or its equivalent in language arts in the student’s home
language. Such unit of study shall be aligned to the NYS learning standards for ELA and the ELA curriculum of
the school district and shall focus on the literacy and language development in the home language.

Integrated English as new language shall mean a unit of study or its equivalent in which students receive core
content area (ELA, math, science or social studies) and English language development

Stand-alone English as new language shall mean a unit of study or its equivalent in which students receive
instruction in order to acquire the English language needed for success in core content areas. A student shall
not receive stand-alone English as a new language in lieu of core content area instruction.

Personnel qualified to teach home language arts at K-6 level is an elementary teacher with a bilingual
extension in home language of the students; at the 7-12 level is a LOTE teacher in the home language of the
students.

Personnel qualified to teach Integrated ENL is either a dually certified teacher or an ESOL teacher and a
certified content teacher, who co-teach.
CR 154 2.2r
Person qualified to teach Stand-alone ENL is a certified ESOL teacher K-12 or at the elementary level, a
certified bilingual teacher.

SUBGROUPS OF ELLS
Newcomer ELL: have received ENL for a total of 0-3 continuously enrolled years [154-2.2(o)]
Developing ELL: have received ENL for a total of 4-6 continuously enrolled years [154-2.2e]
Long-Term ELL: received ENL for 7 or more continuously enrolled years [154-2.2(n)]
SIFE ELL: ELLs who have attended schools in US less than 12 months and who are 2 or more years
below grade level in literacy in their home language and/or 2 or more years below grade level in
Math, due to inconsistent or interrupted school prior to arrival [154-2.2(y)]
ELL SWD: ELLs who have been identified as having a disability; their specific disability must be reported
Former ELL: exited from ELL status as per section 154-2.3(m) [1542.2(i)]
PARENTS/GUARDIANS

Schools must meet individually with parents at least once a year, in addition to parent-teacher
conferences, quarterly progress meetings and other such scheduled events, to discuss the goals of the
program, their child’s language proficiency assessment results and the language development in needs
in all content areas and in the child’s home language for students enrolled in a bilingual education
program
Meetings shall be conducted with a qualified interpreter/translator in the language or mode of
communication the parent best understandings
Each school shall maintain records of signed notices of parents and persons in parental relation that
indicate program selection, as well as orientation session agendas and sign-in sheets. Signed notices
that indicate program selection shall be included in the student’s cumulative record.

BILINGUAL PROGRAM & UNITS OF STUDY [CR 154-2]
Language Arts
2 units of study in Language Arts, one in English and one in the student’s home language
o English Language Arts may be provided through ENL
o .5 unit of Language Arts credit for each Language Arts unit of study, for a total of 1 Language
Arts credit
Core Content
Math, Science, Social Studies, with at least two courses in the student’s home language and English

PROGRAM REQUIREMENTS
CR 154-2.3d
Districts shall create bilingual education programs if there are 20 or more ELLs of the same grade level
who speak the same home language districtwide.
Districts will be allowed to apply for a one-year waiver for languages that represent less than 5% of the
statewide ELL population, if they can demonstrate they meet established criteria for a one-year waiver
and provide alternate home language supports
New programs triggered by this provision shall be placed in a school that has not been identified as
Schools Under Registration Review (SURR) or as a Focus or Priority school.

Consistent with the requirements in section 200.3, ELLs identified with a disability shall be provided
with bilingual services or instruction from a person certified under Part 80 to provide such services.

The maximum allowable grade span for grouping instruction in grades K-12 ENL and BE classes is two
contiguous grades.
PROFESSIONAL DEVELOPMENT
CR 154-2.3(K)
School districts are required to ensure that at least 15% of professional development hours for all
teachers and administrators, and 50% for Bilingual Education and ENL/ESL teachers be specific to the
needs of ELLs, co-teaching strategies, and integrating language and content instruction for ELLs.
If ELL enrollment makes up less than 5% of the school district’s total student population, the school
district may request a waiver from the percentages in which the school district provides evidence that
the district’s PD plan meets the needs of its ELLs, co-teaching strategies, and integrating language and
content instruction for its ELLs
