On approval of phytosanitary requirements applicable to imported quarantineable products Resolution of the Government of the Republic of Kazakhstan No. 1674 of 30 December 2011 In accordance with subparagraph 9) of article 6-1 of the Law of the Republic of Kazakhstan “On Plant Quarantine” of 11 February 1999 the Governement of the Republic of Kazakhstan RESOLVES: 1. Approve the attached phytosanitary requirements applicable to imported quarantineable products. 2. This Resolution is implemented upon the expiration of ten calendar days as of the day of the first official publication. Prime Minister of the Republic of Kazakhstan K. Masimov Approved by the Resolution of the Republic of Kazakhstan No. 1674 of 30 December 2011 Phytosanitary requirements applicable to imported quarantineable products 1. General provisions 1. These phytosanitary requirements applicable to imported quarantineable products (hereinafter - Phytosanitary requirements) are created in accordance with subparagraph 9) of article 6-1 of the Law of the Republic of Kazakhstan “On Plant Quarantine”of 11 February 1999. 2. These Phytosanitary requirements establish requirements for imported quarantineable products, including its package, desinfection and transportation in order to provide plant quarantine. 3. Types of quarantineable products are identified in accordance with a Foreign Trade Goods Classification of the Customs Union (hereinafter referred to as FTGCCU). 4. Quarantineable products imported into the territory of the Republic of Kazakhstan must be clear of quarantine objects, which are specified in the List of quarantine objects and foreign species, in relation to which established and implemented measures on plant quarantine approved by the Resolution of the Republic of Kazakhstan No.1295 of 10 December 2002 (hereinafter referred to as List of quarantine objects). 5. The list of countries importing quarantineable products into the territory of the Republic of Kazakhstan is established in accordance with the appendix to these Phytosanitary requirements. In case quarantineable products, which are not included in the appendix to these Phytosanitary requirements are imported to the territory of the Republic of Kazakhstan, owner of products guarantees accordance of quarantineable products to these Phytosanitary requirements. 2. Phytosanitary requirements to cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products 6. Imported cereals, grain legumes, oilseeds, forage crops, industrial crops: 1) are sent to processing and (or) storage, except for flour and grain; 2) are subject to return or destruction when Indian wheat smut is found; 3) at the owner’s option are subject to disinfection or destruction when quarantine objects are found; in case the owner denies or fails to do that, they are subject to return. 7. It is forbidden to use for seed purposes cereals, grain legumes, oilseeds, forage crops imported into the Republic of Kazakhstan for use in food, feeding and industrial purposes. 8. Waste products of grain, grain legume crops: 1) are processed or destructed based on technology that provides devitalisation of seeds; 2) that do not present any economic value are subject to destruction by the method of burning in the places of unloading, storage or processing. 9. Transportation of cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products within the territory of the Republic of Kazakhstan is allowed in lower holds of vessels, containers, wagons with provision of measures on exclusion of spills. It is allowed to transport cereals, grain legumes, oilseeds, forage crops, industrial crops from the companies responsible for their storage to the processing companies by automobile transport in full metal tanks, including containers. 10. When importing cereals, grain legumes, oilseeds, forage crops, industrial crops boxed or cased into the territory of the Republic of Kazakhstan, the package must be gas-permeable. 11. Technical means excluding spills to water surface are are when unloading cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products from the lower holds of vessels. Unloading of cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products from means of transport is allowed only to sites with hard surface (concrete, asphalt). Unloading of malt originated in countries of khapra beetle expansion from means of transport at points of its destination is allowed only after carrying out state control and supervision of means of transport in the area of plant quarantine and compulsory desinfection. Taking wagons outside off-loading sites is allowed upon condition of their complete cleaning, including exterior surfaces of wagons, from grain and (or) its derived products. 12. Spills of cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products, which are formed on the off-loading sites and railway lines, are subject to daily removal and cleaning. 13. Means of transport, containers, storage facilities and equipment, which is used for storage, transportation, processing of cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products are subject to cleaning, including waste removal, and, if necessary – fumigation. 14. Storage facilities of organizations, self-employed entrepreneurs, individuals and legal entities, which deal with storage and processing of cereals, grain legumes, oilseeds, forage crops, industrial crops carry out preventative disinfection of premises at least once a year. 3. Phytosanitary requirements to planting or seed material 15. Planting or seed material must have: 1) phytosanitary certificate issued by the national quarantine services of exporting countries; 2) marking with information about the name of product, country of its origin, exporter and (or) reexporter, place and (or) area of production; 3) original package until the procedure of state control and supervision in the area of plant quarantine is finished. 16. It is not allowed to use planting or seed material prior to receiving results of laboratory examination. Up to the end of the laboratory examination planting or seed material must be stored in conditions that exclude expansion of quarantine objects. 17. Samples which have undergone laboratory testing are not returned to the owner of propducts or his representative, except for samples that are considered as scientific or other kind of value, according to request of their owners. 18. Lots of potato seed material must be packed in a new container. 19. Planting material of a potted plant or a plant with a closed root system must be imported into the territory of the Republic of Kazakhstan in a nutritious substrate, clear of quarantine objects. 20. Import of plants with radical soil into the territory of the Republic of Kazakhstan is forbidden. 21. Planting material of decorative, fruit and berry crops and grape (except for strawberry) must be in aestivation, bald and blind. 22. Lots of imported planting or seed materials, where quarantine objects are detected on the choice of the owner are subject to desinfection or destruction; in case the owner denies or fails to do that, they are subject to return. Only infected part of the lot is thus subject to disinfection, destruction or return. Planting or seed material, which is infected with quarantine objects and also considered as scientific or other kind of value can be sent to research to an introduction and quarantine garden at a request of th owner. After infection with quarantine objects is eliminated, planting or seed materials is given back to its owner. 23. Potato seed material must be produced in the zones, places and (or) areas of production, which are clear of agents of fungal, bacterial, phytoplasmic, viral and nematode diseases, which are included into the List of quarantine objects that must be proved by the corresponding information in the section of phytosanitary certificate "Additional declaration". 24. Planting material: seedling stocks and quicksets of pomaceous, stone fruit and nut-fruited crops must be clear of plant pests, agents of fungal, bacterial, phytoplasmic, viral and nematode diseases, which are included into the List of quarantine objects and grown in the clear zones, places and (or) areas of production, that must be proved by the corresponding information in the section of phytosanitary certificate "Additional declaration". 25. Seeds (plantings) made by import planting or seed material are subject to annual inspection. These operations are provided by individuals and legal entities on the basis of instructions of state inspectors on plant quarantine. 26. Planting or seed material are transported in a package providing measures to exclude spills. One package can not contain different types of planting and (or) seed material. 4. Phytosanitary requirements to vegetables, fruits and potato for food and (or) industrial purposes 27. Vegetables, fruits and potato must have: 1) marking with information about the name of product, country of its origin, exporter and (or) reexporter, place and (or) area of production; 2) original package until the procedure of state control and supervision in the area of plant quarantine is finished. 28. If quarantine objects are detected in sample (samples) of vegetables, fruits and potato, which is selected from the lot, at the choice of the owner this lot is subject to desinfection or destruction; in case the owner denies or fails to do that, they are subject to return. Only infected part of the lot is thus subject to disinfection, destruction or return. 29. Soil additive in potato and (or) other tuber and rhizocarpous vegetables should not excess 0,5 % of the product weight. 30. It is forbidden to use vegetable-based bedding when importing fruits, vegetables and potato. 31. Vegetables, fruits and potato are transported in a package providing measures to exclude spills. One package can not contain different types of vegetables, fruits and potato. 5. Phytosanitary requirements to cuts of natural flowers and potted plants, acarian, nematodes and living insects for research and development purposes 32. Cuts of natural flowers and potted plants must have: 1) marking with information about the name of product, country of its origin, exporter and (or) reexporter, place and (or) area of production; 2) original package until the procedure of state control and supervision in the area of plant quarantine is finished. 33. A lot of cuts of natural flowers and potted plants infected with quarantine objects at the choice of the owner is subject to desinfection or destruction; in case the owner denies or fails to do that, it is subject to return. Only infected part of the lot is thus subject to disinfection, destruction or return. 34. A zone, place and (or) area of chrysanthemum production (Chrysanthemum, Dendranthema) must be clear of the agent of chrysanthemum ray blight Didymella ligulicola (K.F. Baker, Dimock & Davis) von Arx and the agent of chrysanthemum white rust Puccinia horiana P. Henn., which must be proved by the competent authority of the exporting country based on the results of inspections during three years prior to shipping. "Additional declaration" section of phytosanitary certificate contain the corresponding entry thereof. 35. Acarian, nematodes and living insects for research and development purposes must be packed into cardboard boxes. In addition, the package must exclude a possibility of flying or creeping away of insects on the way and provide access of air necessary for breathing of insects. To prevent insects from early leaving their chrysalis or puparium, the cardboard box is covered inside with foam plastic and special dry chemical regrigerators in the form of flat tins are put between the packing material. 36. Cuts of natural flowers and potted plants are transported in a package. One package can not contain different types of cuts of natural flowers and potted plants. 37. It is unaccepted to transport acarian, nematodes and living insects at the same time with cereals, grain legumes, oilseeds, forage crops, industrial crops and derivative products, vegetables, fruits and potatoes, planting or seed material, cuts of natural flowers and potted plants, wood, package and mounting materials. 6. Phytosanitary requirements to wood, package and mounting materials 38. Wood, package and mounting material imported into the territory of the Republic of Kazakhstan, including details of the repaired wood, package and mounting material must be: 1) desinfected; 2) marked; 3) debarked. 39. Moisture content of wood, package and mounting material should be not more the 20 %. 40. When marking is missing, it is allowed to import wood, package and mounting material upon availability of phytosanitary certificate and according to results of state control and supervision in the area of plant quarantine. 41. Wood, package and mounting material subject to desinfection, return or destruction, must be stored in conditions that exclude expansion of quarantine objects immediately upon their detection and up to the moment of taking necessarz phztosanitarz measures.
