Tree Officer’s report – The trees
were growing in an elevated seafront
garden in a prominent location and
contributed greatly to the amenity of
the conservation area. Following preapplication advice from the EDDC
Tree Officer a request for the works to
be given permission so as to alleviate
overcrowding and to tidy up the row
of trees. The removal of H2,
Hawthorn, which was suppressed,
would allow the two trees either side
more space to grow balanced crowns.
Recommendation for approval to
works to all trees with a note to state
that the Elms growing along the
southern boundary were of insufficient
size to be covered by the requirement
for a conservation area so no
permission to coppice and lay to
hedge were required.

regretted the loss of a
family house for an
apartment block as
there were concerns
that a high density
development could alter
the age balance of the
community. On a
positive note the
application was an
improvement on the
original application in
that it was more
traditional in design and
materials. Although the
height was higher than
the original house the
robust continuous
screening between the
main block and Colvin
and Dunsford Close
prevented overlooking.

P13/283. ITEMS FOR CONSIDERATION
1. Owls Cott St Johns Lodge St Johns Road - 13/2620/CPE
Mr John Wright
Certificate of lawfulness for existing use of chalet as a single dwelling
and associated garage and domestic cartilage.
The applicant had supplied evidence which demonstrated use of the building since 11/4/2009
with no intervening use. A Certificate of lawfulness could be issued provided that evidence
was produced that proved that the claimed use had existed uninterrupted for more than 10
years (or 4 years if used as a house), or the development took place more than 4 years ago and
had not been altered since that time – whichever was relevant.
EDDC was interested in hearing any information that either supported or contradicted the
evidence that the applicant had submitted. Any information submitted would be placed on
public file and may be later used in any appeal, should the Council refuse to issue a
Certificate.

Proposal : Construction of detached Chalet Bungalow
Location: Land to the rear of 6 Portland Avenue, Exmouth EX8 2BS
A Letter from EDDC dated 4th December, confirmed an Appeal in connection with the above
matter. Any representations on the Appeal should have been received by the Planning
Inspectorate no later than 3rd January 2014. The original application 13/1399/FUL was heard
at the planning committee on 12th August 2013 which was objected to on the grounds of
overdevelopment of the site, lack of access for emergency vehicles, not in keeping with the
Avenues Design Statement, identified parking space had previously been allocated to support
a proposal for 10 units and refuse collection point too far from bungalow.
