Tree Officer’s report – The trees were growing in an elevated seafront garden in a prominent location and contributed greatly to the amenity of the conservation area. Following preapplication advice from the EDDC Tree Officer a request for the works to be given permission so as to alleviate overcrowding and to tidy up the row of trees. The removal of H2, Hawthorn, which was suppressed, would allow the two trees either side more space to grow balanced crowns. Recommendation for approval to works to all trees with a note to state that the Elms growing along the southern boundary were of insufficient size to be covered by the requirement for a conservation area so no permission to coppice and lay to hedge were required. Approval in accordance with the Tree Officer’s report 399 P13/283. Mr John Connolly had spoken against this application during public speaking time. LIMIT COMMENTS REPRESENTATIONS OBJ/NO OBJ Cllr. T Cope – considered the application garden grabbing and overdevelopment of the site. The construction and shape and design were out of keeping with the street scene. It would set a precedent for further applications in this small hamlet. Environment Agency gave standing advice as the property was in a Flood Zone 1 area. 3 x Reps – approval would set a precedent for further infill of land where there were buildings of historic interest and the area was of great landscape value. The property was out of keeping and out of character with Old Bystock buildings. Inadequate on-site parking on the site and the access roads were dangerous and too narrow to provide off street parking. The new property would impair light and overlook a neighbouring property and threaten a mature tree on the property boundary. The site was outside of the EDDC planning boundary. There was inadequate street drainage and surface water runoff. An 8 paged document supported the objection. Objection as contrary to Planning Policy S5 & S7. However if EDDC were minded to approve, the Committee requests reports are obtained from The Conservation Officer EDDC Tree Officer in respect of the Robinia & wild rose Natural England and the Wildlife Trust in connection with the bee habitat within the site SWW re drainage and flooding & all are taken into consideration. 31.12.13 401 The committee requested that this application is referred to EDDC Development Management Committee. The tree screening at the rear of the property to be retained to protect the privacy of residents living in Halsdon Avenue. Anglesea Maer Lane Mr & Mrs P Mitchell Construction of two storey side and rear extension, front and rear single storey extensions, raised patio with balustrading to rear and detached double garage None No Objection 402 PLAN No: 13/2647/MFUL PROPOSED DEVELOPMENT 34 Cranford Avenue Mr M Sansom Demolition of existing dwelling and construction of 12 no. apartments within one block, laying out of parking area and provision of bin and cycle stores. Ann Sherwood, Ed Shutt & Guy Farrent had spoken against this application during public speaking time. LIMIT COMMENTS Cllr. M Williamson – regretted the loss of a family house for an apartment block as there were concerns that a high density development could alter the age balance of the community. On a positive note the application was an improvement on the original application in that it was more traditional in design and materials. Although the height was higher than the original house the robust continuous screening between the main block and Colvin and Dunsford Close prevented overlooking. 24.12.13 403 REPRESENTATIONS 14 x Reps – objected on the grounds of :Replacement of a low density single detached house with a high density apartment block which may set a precedent. It was too high, out of scale and overbearing resulting in overlooking and overshadowing of properties nearby and particularly Colvin Close, Dunsford Close and 34a Cranford Avenue. The access road to the apartments ran very close to the neighbouring property and would create traffic noise and dust. The proposed tree screening on the northern boundary would have an overbearing impact and cause loss of light to properties and gardens in Colvin Close. The site entrance was on a dangerous curve in the highway. It was garden grabbing and intrusive to the 4 surrounding properties. OBJ/NO OBJ Objection on the grounds of: Insufficient parking on the site would add to on street parking. Overlooking of properties in Colvin Close, Cranford Avenue & possibly Dunsford Close. Overbearing, out of keeping and character of the area. EDDC to request that SWW give feedback on the capacity of the drains and sewage in respect of the application. In principle the Committee would be minded to accept 3 bedroom houses on the site. If EDDC approved the application Exmouth Town Council request that Permitted Development Rights be withdrawn. Owls Cott St Johns Lodge St Johns Road - 13/2620/CPE Mr John Wright Certificate of lawfulness for existing use of chalet as a single dwelling and associated garage and domestic cartilage. The applicant had supplied evidence which demonstrated use of the building since 11/4/2009 with no intervening use. A Certificate of lawfulness could be issued provided that evidence was produced that proved that the claimed use had existed uninterrupted for more than 10 years (or 4 years if used as a house), or the development took place more than 4 years ago and had not been altered since that time – whichever was relevant. EDDC was interested in hearing any information that either supported or contradicted the evidence that the applicant had submitted. Any information submitted would be placed on public file and may be later used in any appeal, should the Council refuse to issue a Certificate. Any representations on the Appeal should have been received by the Planning Inspectorate no later than 3rd January 2014. The original application 13/1399/FUL was heard at the planning committee on 12th August 2013 which was objected to on the grounds of overdevelopment of the site, lack of access for emergency vehicles, not in keeping with the Avenues Design Statement, identified parking space had previously been allocated to support a proposal for 10 units and refuse collection point too far from bungalow. 2.
