REQUEST FOR PROPOSAL CASH FARM LEASE The Hardin County Board of Education is accepting proposals to lease farm ground of approximately +/25 farmable acres of a 38.657 acre tract on south side of Ky. Hwy. 86. This ground is also the future site for the new Cecilia Valley Elementary School. Farm lease period will be for the remaining 2014 planting season only. The construction of the new elementary school will start in the spring of 2015. The purpose of the Request for Proposal is to provide all interested individuals an opportunity to provide the District with a proposal for entering into a one-season farm lease agreement with the Hardin County Board of Education for the property. Interested parties must submit their farm lease proposals to the Hardin County Board of Education Central Office at 65 W.A. Jenkins Road, Elizabethtown, Ky. 42701, on or before 2:00 pm local time on April 30, 2014. FARM LEASE AGEREEMENT THIS FARM LEASE AGREEMENT is made and entered into this ____ day of ______________ 2014, by and between Hardin County Board of Education, 65 W.A. Jenkins Road, Elizabethtown, Kentucky 42701, herein referred to as (“Landlord”) and (name and address) ; herein referred to as (“Tenant”). LEASE In consideration of the mutual covenants and agreements contained herein, Landlord agrees to lease and rent to Tenant, and Tenant agrees to lease and rent from Landlord a certain parcel of real estate herein referred to as (“the property”), being fully described as a vacant lot as shown on the attached map, which is incorporated herein by reference, which will consist of approximately +/- 25 farmable acres of an 38.657 acre tract on the south side of Ky. Hwy. 86 now owned by the Hardin County Board of Education. This property shall be leased from Landlord to Tenant for the purpose of planting, growing, and harvesting grain crops. 1. Rent. The rent which Tenant shall pay and Landlord shall receive shall be _________________ _____ per acre per year. 2. Clearing and Cutting of Timber Acres. Tenant shall not cut, destroy, or impair any timber on or adjacent to the property covered in this lease. 3. Payment of Rent. The rent payment due to be paid by the Tenant to the Landlord shall be paid by ______________, 2014, or within 30 days of the sale of the crop harvested from the property, whichever comes first. 4. Term. The term of this lease shall be for the 2014 planting season only, commencing from today’s date to December 31, 2014. This lease shall not renew unless otherwise determined by the Landlord. 5. Actions at Expiration or Termination. At the expiration or termination of this lease, or following the last use of the land for planting and harvesting grain crops by Tenant, Tenant shall leave property in the same and/or better condition than it was in when the lease began and Tenant shall ensure that the property is planted in perennial grass seed. 6. Border Strips. The Tenant agrees to leave an unplanted border strip a minimum of Fifteen (15) Feet around the perimeter of the field cropped by the Tenant. 7. Access by Landlord. The Tenant grants to Landlord unlimited access to all planted fields for purposes of showing and viewing the leased property. The Landlord agrees to confine all access to leased property to the unplanted strip around the perimeter of the field provided in the lease. 8. Delayed Harvest. Should the Tenant be prevented from harvesting the Tenant’s crops by the expiration of this lease due to weather conditions or any other reasonable cause, the Landlord grants to the Tenant additional time, up to ____________ days to harvest said crops. Any such granting of additional time to Tenant to harvest Tenant’s crops does not in any way constitute an extension of this lease. 9. Insurance. Tenant shall maintain Public Liability Insurance, including Limited Pollution Liability Insurance, with a minimum Liability limit of One Million Dollars ($1,000,000.00) per Occurrence for Bodily Injury and Property Damage. Tenant agrees to name Landlord as Additional Insured on the insurance coverage for this leased property on policies providing said Liability Insurance coverage and to furnish Landlord Certificate of Insurance outlining coverage, limits, effective dates, and expiration dates. Landlord shall be provided thirty (30) day written notice of any cancellation of this insurance. 10. Improvements. Tenant shall make no permanent improvements in or on this leased property, except as otherwise provided in this lease. 11. Maintenance. Tenant shall be solely responsible for following good farm practices on the property, for miscellaneous mowing and maintenance required to keep the property in the condition which it exists at the commencement of this lease, and otherwise maintaining the property in the presently existing condition. 12. Activities. Tenant agrees to: a) Comply with pollution control and environmental protection requirements. b) Implement and continue soil erosion control practices in compliance with standards provided by the Natural Resources and Conservation Service. c) To prevent all unnecessary waste, loss, or damage to the property of the Landlord. 13. Restrictions. a) Landlord forbids any assignment of this Lease or the rights of the Tenant thereunder to any party without prior written consent from the Landlord. b) Tenant agrees to refrain from altering any physical condition of the Leased property, except as otherwise provided in this lease, without prior consent from the Landlord. c) Landlord and Tenant hunting and trespassing of any kind on the property shall be prohibited. d) Tenant agrees not to erect or permit to be erected any commercial advertising signs on the property without the written consent of the Landlord. e) All costs for all products and equipment used for agricultural production or any other use by the Tenant on the property shall be paid by the Tenant. f) No claims, mortgages, liens, or other attachments shall be made against the property by any other party other than the Landlord. 14. Law. This agreement shall be governed byand construed in accordance with the laws of the Commonwealth of Kentucky. 15. Survival. This contract shall be binding on and shall insure to the benefits of the parties hereto, including their personal representatives, executors, administrators, devisees, heirs, successors, and assigns. 16. Entire Agreement. This document contains the entire agreement between the parties hereto concerning the subject matter hereof, and neither party is relying on any promise, statement, or representation not contained herein.
