CONDITIONS OF SALE:
Buyer agrees to take good care of this cat so as to provide food, shelter, correct routine and accident related medical attention,
exercise and affection. The purchaser agrees to keep the kitten/cat indoors at all times unless in a carrier, on a leash and
accompanied at all times by a competent handler, or in an escape proof enclosure. Buyer agrees to provide immediate
veterinary care to this.
Buyer agrees that if the kitten/cat is found to be neglected or mistreated, Seller shall have the unconditional right to reclaim the
kitten/cat WITHOUT refund of purchase price and renders guarantee null and void. Neglect shall include, but is not limited to:
being left alone without human companionship for periods in excess of 72 hours; lack of proper sanitary facilities; being caged;
poor diet; poor health, lack of medical treatment if kitten/cat shows signs of distress, illness, or injury and otherwise poor
condition. Mistreatment shall include, but is not limited to: lack of proper food, lack of water, and physical abuse. Buyer will be
responsible for any veterinary bills directly incurred as a result of any neglect or mistreatment.
The minimum housing requirement for a Breeder is 6 feet by 8 feet. Under no circumstances may a Breeder be housed in a
cage, or in any area under these dimensions as primary living quarters.
Breeder Males are not to be placed at open public stud, but are to used solely by the purchaser’s females unless with written
approval from seller.
Seller does not guarantee quality of kittens produced, nor the fact that the cat may carry any unwanted recessives.
Cat cannot be resold with breeding rights, co-owned or leased or sold to a third party at any time. Should the Buyer decide to
sell this cat, the cat must be neutered/spayed first and sold as a pet or show alter only. Buyer agrees that under NO
circumstances will the kitten/cat EVER be sold, leased, or given to any pet shop, animal shelter, research laboratory, or similar
facility. All kittens will be sold with registration papers, health guarantee & cannot be sold in “litter lots”. Buyer agrees to
registering a cattery with TICA if they have not already done so before said cat produces kittens. It is agreed that no breeder
kittens will be sold, traded or given into the province of Ontario, Canada. If breeches occur, said cat and all kittens it has
produced will be surrendered to Seller with a monetary fine of $2000 CAD.
Should Buyer not be able to keep this animal for any reason, including the incapacitation or death of the Buyer, it is to be
returned to Seller for placement without refund of any kind, unless the above written permission to transfer ownership is
obtained. If such permission is given, new owner must sign a new contract, identical or similar to this one, with Seller. Buyer
agrees to tell family members about this clause.
HEALTH & CONGENITAL DEFECTS:
Health is guaranteed for a period of 72 hours from the time the cat/kitten leaves the possession of the Seller if vetted within

that time (at Buyer’s expense). Failure to have animal checked by a licensed veterinarian within 72 hours will void any guarantee
covered in this contract. It is required that the cat/kitten be quarantined from other animals during this 72-hour period. If the
cat/kitten is found after such examination to have any type of life threatening problem, it may be returned and a replacement
cat/kitten offered as available. Seller will not honor any health guarantee if the cat/kitten dies of a virus from contact with
another animal not bred at this Cattery. Once the cat/kitten leaves the possession of the Seller, Seller is not responsible for any
Veterinarian bills or charges incurred on said cat/kitten.
This cat/kitten is guaranteed against congenital defects for two years from date of sale. Should the animal die within that time
as a direct result of a congenital defect, the cat will be replaced ONLY if an appropriate autopsy/necropsy is performed by a
licensed veterinarian and a veterinarian's certificate is provided as proof of cause of death. NO KITTEN OR CAT IS TO BE
EUTHANISED WITHOUT THE PRIOR KNOWLEDGE OF THE BREEDER, EXCEPT IN THE CASE WHERE A VETERINARIAN CONSIDERS IT
THE ONLY HUMANE ALTERNATIVE, OR THE GUARANTEE IS VOID.
If cat/kitten becomes HCM positive, not equivocal but positive, within 2 years from date of birth, Seller will replace said cat
unless cat has been bred and produced a litter (purebred or otherwise). It is recommended to test for HCM before breeding.
The health guarantee is void if the Buyer has the kitten vaccinated for any disease besides: Rabies, Feline Leukemia, Calici,
Panleukopenia or Feline Rhinotracheitis.
FERTILITY:
If cat/kitten sold with breeding rights is unable to sire/produce young after two years of age and several breeding attempts with
proven fertile cats, tests will be done at the expense of the new owner to determine fertility. If testing by a licensed veterinarian
finds this cat to be sterile, the Seller will replace said kitten/cat with one of equal quality. Test results must be made available to
breeders veterinarian. Once done, buyer is responsible to alter existing cat and place it in a suitable loving pet home.
If there is no stud available on premises and cat needs to be sent to an open stud, seller does not guarantee cat will become
pregnant. This warranty does not include bacterial or viral infections, hormonal imbalances and/or pyometria.
OFFSPRING:
Any kittens produced by a Breeder cat as defined here in this contract must have the following restrictions placed on them
under the contract:
1 - No offspring of the cat/kitten sold as a Breeder/Show cat may be resold, traded, given away, or re-homed or placed,
intact/unaltered into any other Program or housed on any other premises except their original Buyers', and all kittens must be
sold under a similar contract as this.
2 - ALL pets produced by the Breeder/Show cat/kitten as identified here, must be altered or sold under an altering agreement
under contract if going to pet homes.
3 - Minimum housing requirements of 6 foot by 8 foot square also transferred to any Breeder/Show offspring of the cat/kitten
outlined in this contract.
REPLACEMENT/REFUND:
In the event that a cat is proven infertile or has a congenital defect the cat can be returned to Seller or altered and rehomed. If
altered and rehomed, TICA slip must be signed and sent back to Seller along with proof of alteration. Alteration is done at Buyer
expense. Seller has right to offer a full or partial refund instead of offering a replacement cat.
No monetary refunds will be made unless Seller chooses to not provide a replacement. No replacement or refund will be given
for any condition or defect caused by exposure outside of Seller's cattery, accident, neglect or malnutrition.
Buyer agrees to grant full access to all veterinary records of cat/kitten to Breeder. Veterinary records include copies of actual
visit cards to veterinarians stating vaccinations, injuries, test results, etc. during the period the kitten is owned by the Buyer.
Diagnostic test results are required where possible as proof of diagnosis. In situations where test results are based upon
opinion, Seller's veterinarian must be in agreement on results. If Seller's veterinarian disagrees with Buyer's veterinarian then
an unrelated third party veterinarian of Seller's choice will be used to provide a tie-breaker decision.

By the time the cat is mature enough to breed, and the purchaser has deemed it to be of good enough quality to breed his/her
cats to make themselves a litter off of it is now their choice to have used this cat and is no longer replaceable by Seller.
DEPOSITS & PAYMENTS
Deposits and boarding fees are not refundable if purchaser is unable or decides not to take the cat/kitten. The deposit may,
however, be applied to another equivalent cat/kitten should the original kitten become unfit to sell to the Buyer at Seller's
discretion. Deposits are not transferable if Buyer changes mind on kitten.
Buyer is to pay ALL shipping related expenses in addition to kitten price and boarding when applicable. This includes, but is not
limited to, rabies vaccinations, titers, veterinarian certificates, shipping kennel, flight, quarantine and any other costs required
for shipping outside of initial kitten vaccines and deworming.
Full payment including any additional costs must be paid and received in full 30 days before cat is shipped. Cat/Kitten will be
withheld until all payments are received and cleared.
This Contract is legally binding to all parties involved. It applies only to the Buyer and Seller in this transaction and is nontransferable to other parties. Any legal action which may arise under the terms of this contract will be brought in Kitchener,
Ontario Canada. Buyer shall be liable for any court costs and related charges including attorney's fees associated with Seller
enforcing the terms of this contract. Breach of contract will result in cancellation, and in turn repossession of the cat by the
Seller without compensation along with a monetary fine of $2000.00 CAD.
This cat/kitten will receive excessive amounts of tender loving care, will be fed the best possible diet, will receive substantial
amounts of entertainment, and will be treated with the utmost respect so that he may realize his full potential.
