07/23/15 TERMS OF TENTATIVE SUCCESSOR COLLECTIVE BARGAINING AGREEMENT BETWEEN CHICAGO TEACHERS UNION AND THE BOARD OF EDUCATION OF THE CITY OF CHICAGO This Tentative Agreement for a Successor Collective Bargaining Agreement to the 2012-15 Collective Bargaining Agreement and made this ____ day of July, 2015 by and between the negotiating teams of the Board of Education of the City of Chicago and the Chicago to Teachers Union. 1. Term. This agreement shall be in effect from July 1, 2015 to June 30, 2016. The current provision regarding a one year extension shall be eliminated from the successor CBA. 2. Teacher Salaries. Teacher salaries shall increase as follows during the term of this agreement: Fiscal Year FY2016 Base Salary Increase 0.00% Step Increase Lane Increase Per salary schedule, Board policies and current practices Per salary schedule, Board policies and current practices 3. PSRP Salaries/Wages. PSRP base salaries shall be adjusted by $200 across the Board on January 1, 2016 and the PSRP bonus provision of the current CBA will be eliminated. Otherwise, PSRP shall receive the same increases as Teachers set forth under Section 2. 4. Pension Pick-up. The Board shall continue pension pick up during this extension under the same terms contained in the 2012-15 agreement. 5. Joint Committee on District Revenues. The Board and the Union shall make joint recommendations on appropriate ways to increase Board revenues to the Governor and the General Assembly of the State of Illinois. The recommendations shall be transmitted to the Governor and leadership of both houses of the General Assembly and published to the Board of Education and the CTU membership no later than June 30, 2016. 6. LMCC Revisions to Health Plans. The LMCC created in Article 31 shall review CPS’s healthcare programs and make recommendations to the Board of Education to achieve significant savings in healthcare costs. Recommendations shall be made no later than December 31, 2015 with possible implementation dates of April 1, 2016 or July 1, 2016. 7. Teacher Evaluation. Article 39 shall not apply to: Temporarily assigned teachers The following sections of Article 39 shall not apply to Related Service Providers: 39-2.3 A, B, and C. Protocols regarding observations and pre- and postobservation conferences for RSPs shall be issued by the Joint Committee on Teacher Evaluation no later than August 28, 2015. (b) Effect of Two Successive Developing Ratings. The rule that a teacher who receives two consecutive developing ratings without improvement shall be rated unsatisfactory, set forth in Article 39-2, shall be suspended during School Year 2015-16, (e.g., which means that teachers rated developing for a second consecutive year in 2014-15 shall not be considered unsatisfactory in 2015-16 and teachers rated developing for a second consecutive year in 2015-16 shall not be considered unsatisfactory in 2016-17.) (c) Observations. Teachers shall be observed in accordance with the statutory minimums (modifying Articles 39-2.3(B)(4), 39-3 and 39-4(A) and (B) and any other provision concerning the number of observations, i.e., PAT (annual cycle) – A minimum of 2 formal observations and 1 informal observation Tenured rated less than proficient (or satisfactory/unsatisfactory) (annual cycle) – a minimum of 2 formal observations, 1 informal observation Tenured rated proficient or better – A minimum of 1 formal observation, 1 informal observation Observations for teachers on a biennial rating cycle will be sequenced 1 month apart (modifying Article 39-2.3(B)(2) and any other provision concerning the sequencing of observations). The parties will continue to negotiate in 2015 and 2016 with respect to Evaluations. 8. Joint Taskforce on Grading Practices. CPS and CTU shall form a joint task force of educators to develop guidelines regarding best practices for teacher grading, e.g., recommended frequency of assessment, number of assessments per quarter etc., International Baccalaureate grading practices, and sequencing of grading etc. (Note this is not GPAs or letter grade values). The task force shall issue guidelines as soon as practicable, but in no event later than June 30, 2016, which principals, evaluators and network administrators shall use to guide and assess teachers’ grading practices. School/Department grading practices shall be consistent with district policies, developed in consultation with teachers and published annually at the beginning of Page 2 of 5 1545517.3 07/23/15 each school year in the school’s staff handbook and other appropriate print or electronic communications. Teachers shall determine the number, type and frequency of student assignment and assessments that are used to determine course grades, provided that they are responsible for regularly assessing student progress and for determining students’ grades in the subject area or activity for which the teacher is responsible. Student grades shall be based upon the teacher’s independent professional judgment of the student’s work. Teachers’ grading practices must be clear to staff, students and parents. . 9. Required and Optional Assessments. CPS will develop a standard assessment calendar consisting of assessments mandated by CPS for REACH (e.g., NWEA, STAR, performance tasks) and state and federal laws and regulations (e.g., PARCC, ACCESS, DLM, NAEP). The calendar will also include assessments that provide students with access to placement/scholarship opportunities (e.g., Middle Grades Algebra Exit Exam, AP, IB, STEM, dual enrollment) and assessments offered centrally that schools can opt-in to (e.g. NWEA Science). The assessment calendar will be made available to schools by August 15, 2015. No later than August 15, 2015, CPS and CTU shall mutually develop up to five supplemental model grade band assessment calendars per elementary grade band for ELA, math, science and social science or high school content area or grade level that include additional common formative assessments that teachers within those grade bands shall administer. Models may be amended annually to reflect changes in assessments and assessment availability. The grade bands shall be as follows: a. d. K to 2 Grade Band b. 3 to 5 Grade Band c. 6 to 8 Grade Band, and High School Content Area or Grade Level Band. Teachers within each grade band shall vote on the additional formative assessments within those grades. A vote of those teachers shall be conducted during the week of August 31 to September 4, 2015 to determine what if any additional assessments shall be administered at each school during SY15-16. A vote of teachers within each grade band shall be taken to determine what if any additional formative assessments will be administered at each school in SY2016-17 no later than the end of the school year. Votes shall be taken in accordance with Appendix C procedures except that only teachers within each grade band, including teachers providing EL, MTSS or Special Ed services to students in the grade band, may vote. Schools may waive the alternative models and develop a unique school-model using the procedures of Appendix C. 10. Counseling & Case Management. The Joint Board-Union Counselor & Case Management Committee shall issue recommendations based on the pilot program in the Page 3 of 5 1545517.3 07/23/15 All-Means-All pilot program being implemented in school years 2015-16 by April 1st, 2016. CPS shall provide the goals of the pilot program, costs (budgeted and actual) related to the “All-Means-All” pilot, and provide documentation on the successes and failures of the program. One of the goals of the Joint Board-Union Committee is to find a way to allow counselors the ability to perform school counseling duties as outlined in the Framework for School Counselors for at least 80% of school day. All recommendations shall be implemented by the district in school year 2016-17 or such other date(s) that the Joint Board-Union Committee agree on. 11. Paperwork Reduction. CPS shall eliminate the following paperwork for SY 201516: a. b. c. d. e. f. g. h. i. j. During the course of the school year, no additional paperwork shall be imposed except in compliance with Article 44-21. See Side Letter. 12. Notice of New Positions. CPS shall provide CTU notice of new titles or job classifications when they are created. 13. Roll-over of Other Terms of the 2012-15 CBA. Except as specifically modified herein, the terms 2012-15 collective bargaining agreement shall be extended to June 30, 2016.
