Approval of Commercial Vessel Transit in Part of the Great Australian Bight Commonwealth
Marine Reserve - Former Great Australian Bight Marine Park (Commonwealth Waters)
Approved area
The area specified in Part 1 of the Schedule to this approval, being the area
of the former Great Australian Bight Marine Park (Commonwealth Waters)
declared by Proclamation on 22 April 1998 and revoked by a Proclamation
that came into effect on 17 November 2012.
Approved action
Commercial vessel transit (being continuous passage of a vessel through
an area by the shortest direct route without any other activity being carried
on).
Approved persons
All persons taking the approved action (including all employees, servants,
agents, contractors, clients and invitees engaged in or taking part in the
approved action).
Conditions of
approval
1. The approved action must not be taken in the period 1 May to 31
October inclusive in the area specified in Part 2 of the Schedule being
the Marine Mammal Protection Zone of the former Great Australian
Bight Marine Park (Commonwealth Waters).
2. Subject to conditions 3 and 4 the approved action must be taken in
accordance with other applicable Commonwealth and State laws.
3. The approved action must be taken in accordance with:
a. the Environment Protection and Biodiversity Conservation Act 1999;
b. the Environment Protection and Biodiversity Conservation
Regulations 2000;
c. any prohibitions, restrictions or determinations made under the
Regulations; and
d. any other notices, information, guidelines, codes of conduct or
protocols issued by, or under the authority of, the Director of
National Parks.
4. Discharge of waste is prohibited.
Unless sooner revoked this approval remains in effect until a management plan comes into effect
for the reserve.

Former Great Australian Bight Marine Park (Commonwealth Waters)
All of that area in the Southern Ocean bounded by the line(1):
(i)
(ii)
(iii)
(iv)
(v)
(vi)

commencing at the intersection of the parallel of latitude 31° 47′ 00″ S by the scheduled areas(2)
boundary between Western Australia and South Australia;
from there north along that boundary to the westernmost point on the outer limit of the coastal
waters of the State(3) of South Australia;
from there generally easterly along that outer limit to its intersection by the parallel of latitude
31° 47′ 00″ S;
from there west along that parallel to its intersection by the meridian of longitude 130° 51′ 58″ E;
from there south along that meridian to its intersection by the outer limit of the exclusive economic
zone(4);
from there generally north-westerly along that outer limit to its intersection by the meridian of
longitude 130° 28′ 02″ E;
from there north along that meridian to its intersection by the parallel of latitude 31° 47′ 00″ S; and
from there west along that parallel to the point of commencement.

1.
Geographic coordinates are expressed in terms of the Geocentric Datum of Australia 1994
(GDA94) as described in the Commonwealth of Australia Gazette GN35 of 6 September 1995.
2.
The scheduled area has the same meaning as in section 7 of the Offshore Petroleum and
Greenhouse Gas Storage Act 2006.

The coastal waters of the State has the same meaning as in subsection 3 (1) of the Coastal
Waters (State Powers) Act 1980.
4.
The exclusive economic zone of Australia and its external territories is established under the
Seas and Submerged Lands Act 1973 (Proclamation dated 26 July 1994 published in the
Commonwealth of Australia Gazette No. S290 on 29 July 1994). It commences at the outer limit of
the territorial sea (12 nautical miles from the territorial sea baselines established under the Act)
and extends generally to 200 nautical miles from the baselines.

All of that area in the Southern Ocean bounded by the line(1):
(i) commencing at the intersection of the parallel of latitude 31° 47′ 00″ S by the scheduled areas(2)
boundary between Western Australia and South Australia;
(ii)
from there north along that boundary to the westernmost point on the outer limit of the coastal
waters of the State(3) of South Australia;
(iii)
from there generally easterly along that outer limit to its intersection by the parallel of latitude
31° 47′ 00″ S; and
(iv) from there west along that parallel to the point of commencement.
