The area of the Driving Academy (hereinafter ‘’Area’’) is in rightful use of the Operator. For
this Rules of Operation under the notion Area is understood an area including training rooms
of the Driving Academy, each module of the drill field of the Driving Academy (under the
notion or in case of providing Courses’’ Racing’’ drill field is understood a Race track of the
Motodrome Slovakia Ring in Orechová Potôň (hereinafter ‘’Motodrome’’), social facilities,
parking area, facilities and parts of stated objects, and this including the area of the
Motodrome in case providing Courses ‘’Racing’’.
For this Rules of Operation under the notion Visitor each person (legal or natural person) is
understood who enters the Area on basis of a contract or the purchase of an entrance fee or
with the consent of the Operator.
For this Rules of Operation under the notion Participant is understood a Visitor who on basis
of the personal written Contract or personal concession of the Operator takes part on the
training/course (trained person).
For this Rule of Operation under the notion of External Instructor is understood the
instructor of courses secured by the participant or by third person, agreed prior in written form
by the Operator.
The Provisions of Article II.of this Rules of Operation refers to all Visitors.
The Provisions of Article III. of the Rules of Operation refers to Participants.
The Provisions of Article IV. of the Rules of Operation refers to External Instructors.
II
General Provisions
1. Entering the premises of the Area, each person enters voluntarily into a contract
relation and respects all provisions of the Rules of Operation (with the exception of
those persons who have signed an extra written contract/agreement on respecting the
Rules of Operation prior before entering the Area).
2. Entrance and driving into the Area is possible only under a contractual relationship
with the Operator and except of these cases exclusively with the approval of the
Operator. Persons under the age of 16 can access only in company of a Visitor older
than 18 years.
3. Parking in the area is permitted only on assigned places or according to the
instructions of the Operator’s security service or by persons authorized by the
Operator.
4. Persons with intake of alcohol, psychotropic or narcotic substances, insect-infested or
with evident contagious diseases are not allowed to enter the Area. The Visitor
entering the Area is not entitled to produce visual (photographic), sound or soundvisual recording during his/her presence in the Area. It is forbidden during the
stay/presence in the Area to manipulate with open fire, carry and/or hold a weapon
(including guns and stickers), explosives, bring in and drink alcohol and consume
drugs or psychotropic substances.
5. Any person/Visitor who despite of having been reminded by an employee of the
Operator’s security service or representative of the Operator, and will not respect the
provisions of the Rules of Operation or will not follow the instructions of the security
service or the representative of the Operator, or in any other way behave disruptively
and with disrespect will be banished from the Area. In case such person will not leave
the Area, the security service or the Operator’s representative is entitled to escort the
person outside or ask the police force to interfere.
6. Visitors are exclusively entitled to enter assigned premises by the Operator expressly
for accessible Visitors.
7. Visitors are fully liable for damages caused by them.
8. It is forbidden in the Area to act in a way that could threaten the security and order as
well as to disturb other people present in the Area and its surroundings with causeless
noise. It is forbidden in the whole Area to drive racing vehicles, tune motors or to
cause noise in any other way from 8.00pm until 8.00am. In front of the parking area of
the Hotel Ring is permitted to drive with the maximum speed of 30km/h and at the
same time it is prohibited to heat up vehicles, full braking (with the exception of full
braking because of an unexpected barrier in the driving direction), intense
acceleration, intentional swerving and drifting.
9. Manipulation with an open fire is in the whole Area forbidden.
10. Visitors are responsible for all their belonging which must be secured against theft,
including parked vehicles and everything what is inside of them. The Operator is not
liable for damages on objects stored in the premises of the Area.
11. Objects found in the Area must be handed over by the finder to the employees of the
Operator’s security service staff or to a representative of the Operator.
12. In case a Visitor brings or lets into the premises of the Area an animal he/she must
secure that it may not be let free. The owner of the animal or the Visitor who brought
or let in the animal, are liable for damages caused by not respecting this restriction.
The Visitor who brought or let in the animal into the premises of the Area is obliged to
dispose with all excrements left behind.
13. Visitors are fully liable for their actions within the Area. The Operator is not liable for
possible damages on the property and on the health state of Visitors. Visitors of the
Area are entitled to use the accessed Area and are obliged to handle all equipments of
the Area in the appropriate way to avoid damages. It is strictly prohibited to drill holes
into reinforced surfaces in the whole Area. In case of causing damage on the
equipments of the Area the Visitor who caused the damage is obliged to fully settle all
claims.
14. It is forbidden to dispose waste otherwise than into the assigned waste bins, to
discharge any liquid and charges of motor vehicles or the content of automotive
batteries. Such waste has to be disposed into containers which are assigned for such
purpose.
15. Entrance into the exercise ground of the Driving Academy and to the Area of
Motodrome is exclusively allowed to enter for Visitors (competent Participants) on
basis of a special written contract or extra permit from the Operator.
16. In case any of the provisions of this Rules of Operation are violated, the operator is
entitled to fine Visitors with 500,- EUR for each violation separately. The fine must be
paid in cash on the spot to the Operator’s responsible person.
17. The Area can be monitored by camera system (i.e. video or audio recording). The
Visitor, latest with the entrance to the Area, declares his/her agreement with the above
mentioned video- or audio record and its use (even if he/she is recorded) for the
purposes of legal, criminal, administrative or other proceedings (and also proper
evidence), as well as other proceedings conducted by bodies of state administration
and public authorities.
18. Visitors arriving to the Area can park their vehicles into the reserved parking area in
front of the Hotel Ring.
19. After parking, every Visitor has to check in at the reception of the Operator. The
registration is made by a pleasant worker of the reception of the Operator (hereinafter
‘’Registrant’’).
20. The Visitor takes in mind that there is fire extinguisher and a pharmacy in every
module in the controlling standpoints. Accordingly there are replaced materials for
preventing the extension of petrol, eventually the oil leaking out of the vehicles.
III
Provisions for Participants
1. After parking, every Visitor has to check in at the reception of the Operator at the
registrant, while presenting the driving license of the participant, a document about the
payment of the compulsory contractual insurance and valid certification of the vehicle
demonstrating the technical capacity.
2. Every Participant is navigated by the registrant in cases by the workers of the
Operator in trainings rooms of the Area.
3. It is prohibited to arbitrary enter or move on exercise ground and/or in the area of the
Motodrome. The accession to the drill field and to the Area of the Motodrome is
possible while guarding by an instructor of the Operator, in case by other person
authorized by the Operator and/or guarding by an external instructor.
4. Every person following the Participator of the Course, who is not registered as
Participant of the training process neither the practical training, can freely move in
places assigned for this purpose in accessing places of the Hotel Ring. For these
persons is prohibited entering freely the training rooms without the Operator’s
guarding.
5. Theoretical training in training rooms of the Area
5.1 The registrant separates Participants into groups and assigns one or more instructors
to each group by the previous agreement.
5.2 In the training rooms of the Area during the course Standard there are 12 Participants
in the training room and an appropriate number of instructors. It is possible to get a
larger place of training rooms by an agreement (by the combination of two or more
training rooms), while it is possible to accompany more groups and to perform the
theoretical part all at once.
5.3 After the theoretical part the instructor accompanies his group into the restaurant.
After the lunch break the instructor accompanies his group to the reserved parking
Area in front of the Hotel Ring.
6. Practical training on the drill field
6.1 The practical training starts after the lunch break with the meeting of the Participants
in front of the Hotel Ring in case if it is not agreed otherwise.
While attending the practical training (as well as within it), the Participant shall not be
under the influence of alcohol or other psychotropic or narcotic substances. If the
instructor has a suspicion that someone of the Participants has drunk alcohol before
entering the practical training, the instructor has a right to accomplish a breath test
which the Participant has to fulfill obligatory. If the breath test is positive the
instructor excludes the Participant from the training process. In this case the
Participant has no right to refund any kind of payment (neither of its part) of the
training/Course. If the breath test is negative the Participant is authorized to continue
the training course, if in this Rules of Operation or in any other contractual documents
on the basis which the training course provides, is not defined otherwise.
6.2 The instructor introduces the process of the training course and gives transmitter to
each of the Participant. At the same time the instructor performs handling the
operation of these transmitters. The Participant has to place the transmitter into his/her
vehicles in a way not to damage or devaluate during the whole training process. Right
from the start of receiving the transmitter the Participant takes the responsibility for
any kind of damage causing by an incorrect operation or handling of the transmitter.
In case of damage, destroy and/or loss of the transmitters the Participant has to
recompense the incurred loss to the Operator immediately, and this in an amount of
payment defined by the Operator.
6.3 After serving the transmitter, the instructor controls the connection with every
Participant and this in a way that the Participant in his/her vehicle switches on the
indicating lights. After checking the connection the instructor introduces the
appropriate training module in his car pursuant to the training plan.
6.4 For every Participant it is obligatory to fasten the seatbelts in their vehicles in order to
avoid any chance of hazards in crisis situation.
6.5 In places of the drill field the Participant has to follow the instructor’s instructions. It
is compulsive to follow the guiding vehicle of the instructor while attending the drill
field to the appropriate module and not to move arbitrarily over the drill field. At each
module the instructor specifies the parking place for vehicles, place for the training
and place for observing as well, while all Participants have to respect these reserved
places. Before the start of the training the instructor explains the whole process and
the aim of the training, if something from the instructions is not clear, the Participant
can ask for more information to the transmitter. With the help of the transmitters, the
instructor specifies which person of the Participants has to enter the training Area as
the first. After accomplishing the discipline the instructor evaluates the practice and
asks other Participants for entering the training Area. The Participants can enter the
training Area only after the instructor’s instruction not by their reflection.
6.6 During the whole training process in each section of the drill field the Participants
manage to drive a vehicle under the control, pursuant to his/her abilities and
possibilities. The Participant takes the responsibility for any kind of damage of the
vehicle or health harm. The Participants are fully liable for their actions during the
practical training of the course.
6.7 When during the training process there is any kind of defect on the vehicle generating
the use of the vehicle (for example defect, lack of oil), and if it is possible to remove
this defect immediately, the instructor can define a place for the Participant to remove
this fact safely. In this case it is not in need to stop the training process and the
instructor with the Participants can continue in training. If it is not possible to remove
the defect of the vehicle on the place, the Participant tells the fact to the instructor
who passes this information to the Registrant, who assures the arrival of the
appropriate Emergency Service and/or Breakdown Service.
6.8 If the Participant gets into a crisis situation during the training process which cannot
handle and there is a damage of the vehicle consequently and/or health harm, the
instructor contacts the Registrant and tells about the incurred situation. After the
evaluation of the seriousness of the situation the Registrant calls the appropriate
Emergency Service to the place of the origin.
6.9 If the Participant suffers injuries that need an immediately professional First Aid the
instructor stops the training process, contacts the Registrant and tells about the reason
of the happened situation, and consequently gives the injury First Aid till the
Emergency Service arrives.
6.10
If the Participant suffers injuries what do not need an immediately professional
First Aid but his/her vehicle blocks the safely operation of the vehicle and the
crossover of another vehicles, the instructor stops the training process, informs the
Registrant about the situation and the training process will be suspended until the
Emergency Service does not remove the vehicle from the drill field.
6.11
Participant causing a kind of incident (incident referring to point 6.7 to 6.10 of
this Rules of Operation) does not have a right for any compensation neither any harm
from the Operator either the others of the Participants have no right for the refund of
the payment (nor the part of it) because of the shortened Course.
6.12
After practicing all the training variants prepared by the instructor, with the
help of the transmitters the instructor informs the Participants about the ending of the
training on the appropriate module. Participants stay in their vehicles and for the
instructor’s instruction will everybody follow the guiding vehicle of the instructor.
About the other process of the training Course, eventually about the change of the
training module, Participants will be informed by an instructor with the help of the
transmitter. At the end of the whole training process on the drill field, the instructor
goes with the Participants to the reserved parking area in front of the Hotel Ring by
means of the above mentioned.
6.13
After parking, the instructor asks Participants giving back the transmitters
while controlling its technical state and informs the Registrant about the eventually
damage.
7. Prohibited actions
7.1 Participant has no right moving apart from the area defined by the instructor or person
authorized by the Operator.
7.2 Participant has no right moving on the area of drill field without the instructor’s
permission.
7.3 Any kind of activity on the drill field is forbidden (including while practicing) if there
is a lack of visibility and it is not possible to evidently see the objects at distance of 90
meters.
7.4 Any kind of activity on the drill field is forbidden (including while practicing) in
cases of other adverse natural impact like a windstorm, flood and/or other incident in
consequence which, there will be a submergence of the training area.
7.5 Any kind of activity on the drill field is forbidden (including while practicing) if there
is min. 5cm of coat of snow on the surface. In this case it is possible to continue the
practicing after removing the snow.
IV.
Provisions for External Instructors
1. Outfit/facilities of the External instructor
1.1 While arriving to the Area the External instructor dresses up the working dress which
consists of a T –shirt assured by the Operator.
1.2 Due to weather conditions the External instructor dresses up a jumper or a coat with
reflexive elements assured by the Operator.
1.3 On the basis of the prior agreement, during the theoretical training the External
instructor uses his notebook or a notebook assured by the operator. The External
instructor has to operate with the notebook safely not to cause damage. In case of
damage he bears personal responsibility. Only the External instructor nor third persons
takes a responsibility for to ensure and prevent copying files and distributing of it
and/or accessing files from the borrowed notebook. The External instructor has no
right to enable the notebook assured by the Operator to any of the third persons.
1.4 After the theoretical part, the External instructor has to immediately hand in the
notebook to the Operator or to person authorized by the Operator for receiving back
the notebook.
1.5 Before the practical training the External instructor borrows an appropriate number of
charged transmitters from the Operator which the External instructor can exclusively
provide for the Participants; by which during the period (i.e. by the time using by the
Participants) the External instructor takes responsibility towards the Operator, for any
kind of damage of the transmitters. It is obligatory that after the practical training the
External instructor immediately hands in the borrowed transmitters to the Operator at
the same condition as the External instructor has received it.
1.6 The External instructor reaches the key and the remote control from the Operator for
accessing the training Area and is obligatory to hand in immediately after the end of
the course back to the Operator. The External instructor is not authorized for enabling
the key and the remote control for any of third person.
1.7 During the practical training in the Area the External instructor uses his vehicle or
vehicle provided by the Operator (hereinafter ‘’Borrowed vehicle’’), and this by an
agreement between the External instructor and the Operator. In case of using the
borrowed vehicle the External instructor is liable for the operation of the vehicle
provided by the Operator not to cause damage, theft or an eventually accident.
1.8 On each training module the External instructor is liable for parking the borrowed
vehicle besides the training Area in a way not to cause damage to the Participant’s
vehicle during the training Course.
2. The External instructor controls the Participants attending the Course in the Area, in a
way that no one from the Participants can leave arbitrarily or move freely in training
rooms and on modules in pleasant of the External instructor.
3. On each module the External instructor deals with the controlling computer of the
service facilities in a way not to cause damage (pursuant to the base training). If on the
equipment appears an error or the equipment has stopped to operate correctly, the
External instructor is forced to immediately inform the Operator or the person
authorized by the Operator and stop the training on this module in order not to cause
biggest damage.
4. After the practical training the External instructor is responsible for that all
Participants shall leave immediately the training Area under his control, further
ensures not entering the training Area (left closed the electronically controlled ramp).
5. After the end of the whole training process the External instructor hands in the
borrowed dress to the Operator, and this in a condition like it was given to the External
instructor before.
