ROLE PURPOSE:
As part of the broader Legal Leadership Team, the Deputy Director, Corporate Law
will provide in-house specialist technical expertise, legal advice and support to the
Commission, including all aspects of; grant giving, contracts, procurement and single
tender actions, governance, employee relations and employment law, contentious
and otherwise, pensions and expenses, IT and facilities, complaints, freedom of
information, data protection and correspondence generally, devolution issues
affecting the Wales and Scotland directorates and any other appropriate issues
arising.
Additional the provision of leadership and management of the Commission’s inhouse resources and out-house contracts to enable the successful delivery of
strategic objectives and in support of the Commission’s vision and mission.
ROLE CONTEXT AND SCOPE:
Reporting to the Chief Legal Officer the role is part of the broader Legal Leadership
Team and will be a source of expert legal advice to the Commission on all relevant
in-house legal areas. The role holder will initially manage and direct a team of
approximately two and will be accountable for the quality of output of advice and for
the personal conduct of the most complex or sensitive matters. They will exercise a
high degree of independent professional responsibility, autonomy and discretion to
ensure the successful delivery of a range of work.
As part of their responsibilities they will develop, procure, implement and manage the
establishment of an out-sourced contract for the provision of legal services, and
determine the appropriate level of in-house resource going forward.
The role holder will drive through a programme of ensuring the most efficient
deployment of legal resources, through the development of guidance, templates,
signposting and training for the benefit of Commission teams and colleagues and
through the establishment of excellent internal relationships.
TYPICAL ACCOUNTABILITIES:

Lead, as the authoritative Commission expert on Corporate Law and provide
expert legal advice and services on: grant giving, contracts, procurement and
single tender actions, governance, employee relations and employment law,
contentious and otherwise, pensions and expenses, IT and facilities, complaints,
freedom of information, data protection and correspondence generally, devolution
issues affecting the Wales and Scotland Directorates and any other appropriate
issues arising.

To support the Senior Management Team and Board of Commissioners on the
legal remit of their actions and on governance issues, ensuring that the legal
consequences and risks of decisions are properly understood and balanced and
that they do not give rise to illegality or maladministration.

To work with the rest of the Commission, establishing and maintaining excellent
internal relationships and establishing and maintaining systems of guidance,
templates, signposting and training to ensure the most effective use of the
Corporate Law resource.

Lead and manage the work of the Corporate Law team, taking accountability for
performance within area of responsibility, allocating work, implementing
operational plans to ensure delivery of business plan commitments and strategic
aims and coaching staff to ensure effective delivery of work; managing service
delivery to ensure compliance with governance and policies, appropriate risk
management, professional and regulatory compliance and appropriate monitoring
and management of budget.

To establish and manage a contract with an outsourced provider of legal
services, including with regard to budget, quality and appropriate use of the
resource.

Adopt and promote a flexible approach to work, undertaking other areas of
responsibility as required ensuring the overall business priorities of the
Commission are delivered.
TYPICAL PERFORMANCE MEASURES:
 Delivery of work (both in-house and outsourced) for which responsible to
deadlines, to budget, to agreed standards (including professional, regulatory and
the Commission’s standards) and in compliance with relevant governance
arrangements and other requirements; effective management of resources and of
risk.
 Effective leadership and management of in-house and out-house resources.
 Evidence of effective relationships with and communication to the rest of the
Commission.
 Evidence of commitment to continual improvement and to motivation and
development of others to ensure effective performance and delivery of objectives
across the team.
INDICATIVE DIMENSIONS:
 Management of legal services including an in-house team an out-house contract
with a budget of approximately £100K.
 Significant strategic impact across the short, medium and long term, on the
provision of legal advice and services to the Commission, in particular the People
Team, Finance Team, Correspondence Unit, Strategy and Policy teams and
Board of Commissioners.
 Working with a high degree of independent, professional responsibility, autonomy
and discretion within agreed delegated limits and supervisory framework.

KNOWLEDGE, SKILLS AND EXPERIENCE:
 Qualified solicitor or barrister entitled to practice in England and Wales
 Substantial relevant post qualification experience with a proven track record of
successful delivery of high quality advice on law and practice relating to
employment / employee relations, general litigation, personal conduct of legal
disputes and actions and negotiating successful settlements.
 Demonstrable knowledge of public law, contracts and commercial law,
procurement, information law and corporate governance, including negotiation
and execution of complex legal agreements and documentation.
 Substantial technical legal skills including advising orally and in writing,
negotiating and drafting skills.
 Ability to provide clear analysis, advice and guidance on contentious and noncontentious areas of law.
