All services and fees in this schedule are effective 1 July 2015. Return to work services comprises the following six service categories: 1. Pre-injury employer services 2. Fit for work services 3. Restoration to the community services 4. Job placement services 5. Return to work assessment services 6. Mediation services Each of these six categories is described in this document. The provider must deliver the services in accordance with: their Terms and Conditions of Appointment (Appointment), including the conditions, service item descriptors and guidelines detailed in this fee schedule; and the referral instructions provided by the case manager. Pre-injury employer services The purpose of pre-injury employer (PIE) services is to assist the worker achieve a timely, safe and durable return to work in suitable employment with the pre-injury employer. The primary goal is to return the worker to maximum work capacity, with this ideally being at pre-injury duties and hours. This service includes an assessment of the physical and/or psychological demands of available duties at the workplace, the recommendation of appropriate workplace modifications to accommodate a worker’s medically certified work capacity, the resolution of barriers preventing a successful return to work, and achieving agreement by the involved parties on the return to work arrangements. Services provided outside of this fee schedule and policy may be approved by the case manager on a case-by-case basis. Pre-injury duties transition (PIDT) ReturnToWorkSA - Return to work services fee schedule 2015-16 Inclusion in performance measurement 8 How much ReturnToWorkSA will pay ReturnToWorkSA will pay the reasonable cost of pre-injury employer services up to the maximum amount detailed in this fee schedule. What ReturnToWorkSA will pay for ReturnToWorkSA will pay for pre-injury employer services that are: focused on achieving safe, early and durable return to work outcomes reasonable and necessary approved by ReturnToWorkSA or the claims agent. What ReturnToWorkSA will not pay for ReturnToWorkSA will not pay for pre-injury employer services that include: claims management functions extended monitoring of the worker’s status without progress towards the goal (medical, return to work or otherwise) advocacy treatment services other services referred to by a provider without the prior approval of the case manager (e.g. return to work assessment services, activities of daily living assessments) overseeing or monitoring of the worker’s treatment or scheduling medical/treatment appointments worker transport costs and interpreter services, as these are generally reimbursed to the worker or paid directly by the case manager. Referral criteria Who can refer for pre-injury employer services These services may only be requested by ReturnToWorkSA or the claims agent. The requestor is to include relevant and appropriate information with the referral, including, but not limited to, information about the barriers to return to work; medical reports; and the current Work Capacity Certificate or WorkCoverSA Medical Certificate. the expertise of a pre-injury employer service provider to resolve it is expected that a pre-injury employer service provider can resolve the barriers to return to work, and progress the worker towards pre-injury duties and hours within four weeks. Referrals are made for a specific service category based on the worker’s status at the time of the initial pre-injury employer service referral. This service category will not change for the entire duration of the service even if the worker’s status changes: during the time allocation of referral between Level 1 Intervention and Level 2 Intervention between Level 2 Intervention and Level 2 Extension. When a referral can be rejected A pre-injury employer service provider may reject a referral in very limited circumstances, such as when the: referral is for a category for which the provider has not been appointed referral does not meet the referral criteria defined in this fee schedule for the relevant service item referral includes services not included in this fee schedule provider can demonstrate it does not have the capacity to provide the services in the time required by ReturnToWorkSA or the claims agent provider or ReturnToWorkSA has given notice to the relevant party of termination of their appointment provider is suspended from receiving new referrals by ReturnToWorkSA provider identifies an actual or perceived conflict of interest exists or may reasonably arise relating to delivery of any part of the service - unless the provider notifies ReturnToWorkSA or the claims agent provides written approval to the provider to proceed despite the existence or possibility of a conflict of interest. The provider must advise the case manager in writing of a rejection of a referral, including the reason, and not proceed with the requested service. When a referral can be made to pre-injury employer services A case manager may refer a worker for this service when: there is information (including medical evidence) indicating that a remain at work or return to work outcome with the pre-injury employer is achievable there are barriers to progressing or achieving a return to pre- injury duties and / or pre-injury hours which require ReturnToWorkSA - Return to work services fee schedule 2015-16 9 When a service can be suspended A case manager may make a decision to suspend a preinjury employer service for a period up to six weeks. This may occur up to a maximum total suspension period of 12 weeks for each referral. Suspensions may occur as a result of: temporary discontinuance of income support illness, unexpected surgery or hospital admission where the provision of pre-injury employer services during the suspension period is not expected to improve the worker’s capacity to return to work. Where the suspension criteria is met, a suspension can be applied at any level of the service. Providers will be responsible for ensuring the most appropriately qualified personnel is appointed to deliver the required components of the service that best meet the circumstances of the referral. The provider may recommend a suspension. This recommendation must be made in writing to the case manager, including the recommended suspension period. Acceptance of the suspension must be recorded in the provider’s file. What is required within a Level 1 intervention service Services will recommence automatically at the end of the suspension period unless: The Level 1 intervention service will drive early resumption of workplace activity, by assisting an employer to identify suitable duties. When pre-injury employer services cease, an intervention outcome report should be completed by the provider and submitted to the case manager. A provider should discuss their recommendation to cease preinjury employer services with the case manager. This discussion should be evidenced on the provider’s file. doctor assessing the barriers to the worker’s return to work, and identifying actions to address these duties and individual tasks giving consideration to the available medical evidence, and the provider’s knowledge of the injury, treatment, pathology and prognosis identifying suitable duties and recommending workplace modifications or equipment to accommodate the worker’s return to work where appropriate a task analysis where required establishing agreed return to work arrangements with the worker, employer and doctor educating the worker in safe work practices relevant to their return to work duties completing and submitting a Level 1 intervention report, which includes recommended strategies for how the worker’s return to work arrangements will be implemented assisting the case manager in developing a Recovery/ return to work plan where requested. If a full return to work outcome is achieved, the provider should complete an intervention outcome report and submit this to the case manager. A completed Level 1 Intervention is not a prerequisite to a referral for a Level 2 Intervention service. A case manager may refer directly for a Level 2 Intervention service where they have established a Recovery/return to work plan for the worker. ReturnToWorkSA - Return to work services fee schedule 2015-16 10 When Level 2 services are recommended RAW Level 2 12 hours 13 weeks After completing a Level 1 Intervention service, a provider can recommend Level 2 Intervention service, and proceed with service when: RTW Level 2 20 hours 26 weeks CRTW Level 2 28 hours 26 weeks Pre-injury duties transition 7 hours 4 weeks services are necessary to resolve barriers to achieve a return to work the worker and employer are not able to independently implement the return to work plan. Level 2 intervention service hours can only be billed using the respective service codes, within the allocated timeframes, as specified above. A provider should notify the case manager when recommending and progressing to Level 2 intervention services in writing, and ensure that: PIE Level 2 intervention service - extension A case manager may approve a Level 2 intervention service extension in the following circumstances: at referral, the agent has not provided instructions for a Level 1 Intervention service only the agent has not requested that pre-injury employer service cease. PIE Level 2 intervention service Who can deliver a RAW, RTW, or CRTW Level 2 intervention service ReturnToWorkSA will pay for pre-injury employer Level 2 intervention services delivered by: Class A RTW consultants Class B RTW consultants. subsequent to the completion of a PIE level 2 Intervention service subsequent to the provision of an intervention outcome report and a worker’s return to work fails or regresses and the employer requires assistance to return the worker to work. In these circumstances: an extension may be approved to assist the worker to resume their return to work the extension hours include notifying the case manager in writing once an outcome is achieved no additional intervention outcome report is required to be completed no early durable outcome payment is payable. where there is a reasonable prospect that the worker will achieve pre-injury duties and/or pre-injury hours during the extension period. What is required within a PIE level 2 intervention service The aim of a Level 2 intervention service is to facilitate a worker’s full return to work by supporting the parties to implement the return to work arrangements and continuing to resolve barriers to achieving their return to work goal. Ideally the worker will achieve full pre-injury duties and hours. A provider will have 10 hours of service (including travel) within a 6-week period for a PIE Level 2 intervention serviceextension. The case manager may decide to refer direct to Level 2 Intervention service when: return to work arrangements have been agreed by the parties and the employer requires assistance to manage the RTW process; a Recovery/return to work plan is in place (referral to PIE Level 2 Intervention services). Within a Level 2 intervention service, it is expected that a provider assists the worker in achieving pre-injury hours and pre-injury duties. Once pre-injury hours are achieved, a provider should develop a plan to assist the worker and employer in transitioning to pre-injury duties. The provider will cease their involvement when they are confident the worker and employer can progress the developed plan independently and achieve pre-injury duties. The following maximum hours and timeframes apply for PIE Level 2 intervention and Pre-injury duties transition services: PIE Level 2 maximum hours and timeframes PIE service category Max hours (incl travel)* Max timeframe (excl suspension)* ReturnToWorkSA - Return to work services fee schedule 2015-16 Pre-injury duties transition A case manager may refer a worker for pre-injury duties transition: where the worker is working at full pre-injury hours, and the employer requires assistance to transition them to full pre-injury duties where the worker is not receiving any income support. A case manager cannot refer a worker for pre-injury duties transition: when there is a concurrent pre-injury employer service when it is immediately subsequent to a previous preinjury employer service referral closure (as it is expected this plan be developed with this previous referral). The allocated hours during this service include: provision of an intervention outcome report once the worker has reached their maximum level of durable return to work. The report should detail a brief summary of actions taken, the level of duties reached at 11 closure point, and highlight any barriers to the durability of the return to work status. a review of the pre-injury employer workplace with the worker and employer to develop a plan to transition the worker to their pre-injury duties any travel that may be required. Reports Level 1 Intervention report A level 1 Intervention report should be completed and provided to the case manager within 10 business days from the referral. It should include: barriers to return to pre-injury duties and/or pre-injury hours agreed return to work strategies and actions to progress a RAW or RTW outcome summary of the suitable employment identified. Intervention outcome report An intervention outcome report should be completed and provided to the case manager: when improved durable remain at work or return to work has been achieved at either PIE Level 1 Intervention, a PIE Level 2 Intervention, or PIE Level 2 Extension, and a further intervention service is not required or where no further improvement in remain at work or return to work is expected through a Level 2 – Intervention or extension service, and further intervention services are not justified or at the request of a case manager and within 10 business days from the closure date as it is agreed with the case manager. The intervention outcome report should include: a summary of the service provided, and the outcome and level of return to work achieved (nil, partial or full) a brief summary of the RTW consultant’s actions which supported the outcome recommended return to work arrangements (in the form of a Recovery/return to work plan where requested by the case manager) recommendations for the future management of the workers return to work where a partial or no return to work was achieved, details regarding: ongoing return to work barriers that may impact upon the worker’s recovery and ability to participate in pre-injury employer services, fit for work services, job placement services, or to achieve suitable employment with a new employer suitable employment information including transferable skills, qualifications, interests and abilities identified during the referral period that may be relevant to the future planning for the worker’s return to work, including identification of suitable employment with a new employer other relevant recommendations and actions required that may support the worker’s return to work goal a summary of the potential suitable employment options at the pre-injury employer, recommended pathways to the worker commencing these roles, and the barriers to achieving this a recommendation about the appropriateness of the return to work goal remaining as pre-injury employer. other related information as requested by the case manager all activities associated with preparation of the report are included within the fee for this item and cannot be separately charged under a different item code. Durable RTW certificate A durable RTW certificate should be completed and provided to the case manager: at 13 weeks following the submission of the intervention outcome report and when the worker has sustained their return to work for the full 13 weeks the worker is entitled to less than 5% of the income support they were entitled to at the commencement of PIE services where the provider believes they are entitled to a RTW outcome payment and on the form specified by ReturnToWorkSA. Outcome payments When an early durable outcome payment can be made An early durable outcome payment is payable to the provider where: a return to suitable duties at full pre-injury hours has been achieved and sustained for 13 consecutive weeks, and a worker receives or is due to receive equal to or less than 5% of their maximum income support throughout the durability period and evidence of 13 weeks’ durability is provided on the specified Durable RTW Certificate and either when an outcome is achieved in a level 1 intervention service, the maximum outcome fee is payable for the service category, or where the outcome is achieved in a level 2 intervention service, the hours invoiced for the level 2 service do not exceed the specified maximums for the specific outcome payments (i.e. excludes level 1 hours). An early durable outcome payment is not payable to the provider where: following a return to suitable duties at full pre-injury hours, the worker ceases work during the 13 week durability period. This may be due to: ReturnToWorkSA - Return to work services fee schedule 2015-16 12 breach of mutuality – section 48 reduction or discontinuance of weekly payments worker develops or sustains a non-compensable injury worker aggravates their existing injury worker resigns from pre-injury employer worker employment is ceased by pre-injury employer, or seasonal work ceases worker makes a voluntary discontinuance of income support. How the early durable outcome payment is determined the durability period is the 13 week period commencing from the date of the intervention outcome report a Durable RTW certificate has been received by the case manager only 1 payment can be made for each claimant/referral the fee payable is determined by the number of level 2 hours used for the service and travel combined to achieve the outcome (refer page 5) additional regional travel charged under WR901 is excluded from the calculation. To receive reimbursement, the provider must submit: directly related to the provision of chargeable pre-injury employer services for a referred worker, as described in this fee schedule documented in the worker’s case file including purpose, origin, destination, travel time in minutes, including return divided proportionately between each worker where travel involves provision of services to multiple workers. Note: For additional information, refer to the invoicing section. Additional regional travel (WR901A/B) The case manager may approve additional regional travel for up to five additional hours at a time (up to a total maximum of ten hours): where the worker’s workplace, office of their employer, rooms of the worker’s treating doctor, or other appropriate place to deliver a service is located in one of the regional postcodes listed in Appendix 3. a tax compliant invoice for travel expenses incurred, and a receipt for each travel expense incurred. Equipment expense reimbursement (WR910) The case manager may approve reimbursement for equipment expenses incurred by a provider to directly support the worker’s return to work. Travel time must be: economy airfares, overnight accommodation and reasonable cost for meals associated with the overnight stay, taxi fares, car parking and car hire expenses (excluding fuel costs and vehicle mileage). there is evidence of prior approval from the case manager where the cost of the item is greater than $500, and tax compliant and itemised invoices for equipment expenses are provided. ReturnToWorkSA - Return to work services fee schedule 2015-16 17 When a referral can be suspended A case manager may make a decision to suspend a fit for work service as a result of a worker’s: income support being temporarily discontinued illness, unexpected surgery or hospital admission. The provider may recommend a suspension. This recommendation must be made in writing to the case manager, including the recommended suspension period. Acceptance of the suspension must be recorded in the provider’s file. Fit for work services will recommence automatically at the end of the suspension period unless: the case manager decides to further suspend the service. This may occur up to a maximum total suspension period of 4 weeks, or the case manager makes a decision to close the referral, in which case the provider should complete and submit an Intervention outcome report. When concurrent fit for work and job placement services (JPS) can be delivered The case manager is responsible for identifying the need for concurrent return to work services and will make referrals in accordance with the respective referral criteria. In this instance a referral will be limited to a Fitness upgrade assessment and report only. a fit for work provider has recommended commencement of JPS prior to the full completion of a fitness upgrade program. the worker will participate in activities as set out by the job placement service provider where activities such as work trials and training have been pre- arranged by the fit for work provider, the worker is to complete these activities with monitoring to be conducted by the job placement service provider there must be timely and regular communication between service providers to achieve collaborative goal setting the focus for the fit for work provider will be to gain an increase in medically certified work capacity to the worker’s maximum durable capacity there must be no conflict in the requirements of the worker there must be no duplication of services. 18 Service item descriptors During the fit for work service, the provider will provide the case manager with details of the worker’s capacity upgrades by, wherever possible, submitting a copy of an updated medical certificate (Work Capacity Certificate or WorkCoverSA Medical Certificate). Where there is evidence that the worker has the capacity to commence job placement services, the fit for work provider should make this recommendation to the case manager. Fitness upgrade assessment and report (FW110A/B) The reporting requirements for this service are either: submission of an intervention outcome report where an upgrade to maximum hours is obtained. The report should detail: the certification obtained; and recommendations for the job placement specialist to consider in assisting the worker to gain suitable employment, or submission of a fitness upgrade program if an upgrade to pre-injury hours is not obtained. Note: Following submission of the fitness upgrade program, the provider should proceed with delivering and arranging fitness upgrade pathway services. Maximum time: 15 business days. The purpose of this service is to upgrade the worker’s medically certified work capacity to maximum hours, ideally at the pre-injury level in preparation for them gaining suitable employment through job placement services. This service involves: worker consultation and engagement including: identification of the worker’s employment history, experience, transferrable skills and work preferences where such information is not readily available identification of suitable employment options including labour market analysis of these options where this information is not already available identification of and recommendations to address barriers to achieving an upgrade in medically certified work capacity and suitable employment at maximum capacity collaborative development of a proposed fitness upgrade program (where anticipated it will be necessary). treating doctor consultation including: discussion about the health benefits of work and the opportunities available to the worker to re-enter the workforce request that the treating doctor details in the medical certificate, the worker’s certified work hours and any relevant restrictions and functional capabilities communication including, but not limited to case conferences, telephone contact. Travel is included within allocated hours, where case conferences are arranged. the outcome of this consultation is either: - obtaining an upgrade in certified capacity for pre-injury hours, or - agreement for a fitness upgrade program (which is aimed at upgrading the worker’s medically certified work capacity). Note: This service is not intended to duplicate activity undertaken by a previous service or concurrent service e.g. Job placement service. ReturnToWorkSA - Return to work services fee schedule 2015-16 Fitness upgrade program Maximum time: 8 weeks duration from date of submission of the fitness upgrade program. The purpose of this service is to coordinate and deliver the fitness upgrade program as agreed between the doctor, provider and worker. The program is to address specific barriers that exist and that are preventing the worker’s medically certified work capacity being upgraded. The aim is for the worker to be able to re-enter the workforce in suitable employment, at pre-injury hours. The minimum service requirements include: fortnightly contact with the worker (if the worker is not participating in work or training activity that is at pre-injury hours, contact must be face-to-face) for 30 minutes fortnightly progress update to the case manager. When a fitness upgrade program is implemented, the provider is responsible for: arranging or delivering the fitness upgrade pathway services as agreed by the doctor and worker. The case manager is not required to approve these services. monitoring the worker’s progress and participation in the fitness upgrade program ensuring fitness upgrade pathway services are delivered by suitably qualified consultants ensuring services that have been pre-arranged by the case manager continue, and that such services are not duplicated or replaced with another fitness upgrade pathway service ensuring short term transport costs and interpreter services for the worker are reimbursed or paid directly by the case manager co-ordinating and making payment for fitness upgrade pathway services that are arranged through a third party provider. These services are to be paid by the fit for work provider who then seeks reimbursement from the case manager under the relevant item numbers in the fee schedule assisting the case manager in developing a Recovery/return to work plan where requested. 19 Fitness upgrade program – extension Maximum time: 4 weeks duration. A case manager may approve one fitness upgrade program extension where: there is reasonable prospect that the worker’s medically certified work capacity will increase to a level appropriate for commencement of job placement services. During the extension period, the provider can continue delivering services up to the maximum prescribed limits of the fitness upgrade program funds. When a referral can be rejected A job placement service provider may reject a referral in very limited circumstances, such as when the: referral is for a category for which the provider has not been appointed referral does not meet the referral criteria defined in this fee schedule for the relevant service item referral includes services not included in this fee schedule provider can demonstrate it does not have the capacity to provide the services in the time required by ReturnToWorkSA or the claims agent provider or ReturnToWorkSA has given notice to the relevant party of termination of their appointment provider is suspended from receiving new referrals by ReturnToWorkSA provider identifies an actual or perceived conflict of interest exists or may reasonably arise relating to delivery of any part of the service - unless the provider notifies ReturnToWorkSA or the claims agent providers written approval to the provider to proceed despite the existence or possibility of a conflict of interest. The provider must advise the case manager in writing of a rejection of a referral, including the reason, and not proceed with the requested service. When a referral can be suspended Service may be suspended for a cumulative total of 12 weeks as a result of: temporary discontinuance of income support unexpected illness, surgery or hospital admission hours and capacity falling below the referral criteria, which requires additional intervention outside of job placement services. 27 The job placement service provider must make a written request for suspension, including the recommended suspension period, and obtain written approval from the case manager. Approval of the suspension must be recorded on the worker’s file. Services will recommence automatically at the end of the suspension period unless: a further suspension is approved by the case manager, or the referral is closed by the case manager. When job placement services cease Job placement services should cease: where there is no evidence of continued progress towards suitable employment, and approved by the case manager, or at the request by the case manager. Service item descriptors Intensive job placement services Initial assessment and recommended employment pathway plan (JB101) This service is to be completed within 10 working days from date of referral and includes: Concurrent return to work services Fit for work or return to work assessment services may be delivered concurrently to a job placement service. ReturnToWorkSA and the claims agent are responsible for identifying the need for concurrent services and will make referrals in accordance with the relevant referral criteria. The interview with the worker is, at a minimum, to include: When concurrent return to work services are being delivered, there must be: timely and regular communication between service providers to achieve collaborative goal setting no conflict in the requirements of the worker no duplication of services. Concurrent fit for work and job placement services may occur where: additional support is required to obtain an increase in the worker’s certified medical capacity to enable them to obtain suitable employment with a new employer, or the worker’s medically certified work capacity falls to below eligibility level requiring the job placement service provider to suspend the service in accordance with suspension criteria a fit for work provider will not arrange a fitness upgrade program whilst job placement services are being delivered. Concurrent return to work assessment services and job placement services may occur where: the suitability of identified duties or employment is uncertain and additional expertise outside that of a job placement specialist is required to conclude suitability and/or additional information regarding suitable employment options for worker is required to support decisionmaking in the case management process. ReturnToWorkSA - Return to work services fee schedule 2015-16 review of medical information and other information provided by the case manager communication with the fit for work provider where services have been or are concurrently being provided interview with the worker to assess skills and expertise identification of wider suitable employment options, and a minimum of 3 specific suitable employment options development of an employment pathway plan which provides an overview of employment pathway services to be arranged for the 13 week service period. confirmation of the worker’s details an authority to obtain information explanation of the: - services that the job placement service provider will provide - worker’s rights and responsibilities. explanation of the job search facilities, where these are located, and how to access those facilities provision of an initial list of appropriate job vacancies an assessment of the worker’s transferable skills, expertise and work history development and agreement on an appropriate employment pathway plan, and what this means in respect of the worker’s participation information about the most effective ways to seek work and successfully obtain employment discussion about local employment opportunities provision of information about skills shortage areas assistance to the worker to prepare or review their resume. The job placement service provider is to provide the case manager with a written employment pathway plan developed with the worker. The employment pathway plan is to be completed using the ReturnToWorkSA template, and include: specific examples of suitable employment goals (minimum of 3) wider suitable employment goals employment pathway plan activities for the first 13 weeks of service including: - detailed description of activities to be undertaken by the worker - details of the tailored services to address individual worker needs 28 - - where appropriate, recommendations for training (retraining or on-the-job training) to enable access to suitable employment opportunities proposed allocation of employment pathway services expenditure proposed review points to adjust the allocation of services within initial plan. Service fee (JB201, JB202) This service fee: covers a worker’s access to job search facilities in normal business hours includes a minimum of fortnightly contact with the worker (If the worker is not participating in work or training activity equivalent to pre-injury hours, it is expected that contact will be face-to-face with the job placement service provider) includes fortnightly updates of the worker’s progress in employment pathway services and return to work, to ReturnToWorkSA, or the claims agent is payable in two stages - 13 week service fee – on the worker commencing the 26 week program - 26 week service fee – at 14 weeks where the worker continues the job placement services program beyond 13 weeks. must be charged as a single invoice transaction for each item number (JB201 and JB202) covers the provision of an updated employment pathway plan at week 14 which describes the employment pathway plan activities for the next 13 weeks of service. If the worker obtains sustainable employment that meets the criteria for a durability fee - full outcome, the job placement service provider is not eligible to charge subsequent service fees. Employment pathway services (JB302 JB306; JB312; JB314; JB315A/B) The job placement service provider can select and arrange services up to the maximum allowed in this fee schedule. Payment will only be made for those services delivered. The maximum fee payable for employment pathway services is determined by the elapsed time from the date the agent received the claim to the date of referral to job placement services as specified in the job placement services quick reference guide. The job placement service provider shall monitor employment pathway services usage to ensure the expenditure is within the maximums prescribed. ReturnToWorkSA - Return to work services fee schedule 2015-16 Independent job seeking support Service fee (JB701) ReturnToWorkSA or the claims agent may elect to refer the worker directly to independent job seeking support, or subsequent to the completion of intensive job placement services. This service fee: is payable: - at commencement of each 13 week period, and - for a maximum period of 12 months. covers a worker’s access to job search facilities in normal business hours includes as a minimum fortnightly contact with the worker (where the worker is not participating in work or a training activity that is at pre-injury hours, it is expected that contact be face-to-face with the job placement specialist) for a minimum of 30 minutes includes a fortnightly update of the worker’s progress in employment pathway services and return to work, to the claims agent or ReturnToWorkSA. If the worker obtains sustainable employment that meets the criteria for a durability fee - full outcome, the job placement service provider is not eligible to charge subsequent service fees. Employment pathway services (JB302 JB306; JB312; JB314; JB315A/B) The job placement service provider can select and arrange services up to $1,000 for workers who participate in independent job seeking support. This may be from: continuation of service following intensive job placement services a direct referral to independent job seeking support. Funds are allocated for use with each service fee period (ie 13 weeks). Unused balances will not transfer to subsequent service fee periods. The job placement service provider is to provide the case manager with a written employment pathway plan detailing the employment pathway. Additional regional service fee (JB208, JB708) The case manager may approve this service fee for one occasion per 13 week service period: where the worker’s residence, or other appropriate place to deliver a service is located in one of the regional postcodes listed in Appendix 3, and the worker is unable to travel to the job placement service provider’s premises. 29 Employment pathway services These services may be selected by the job placement specialist in a combination and a proportion as required by the specific needs of the worker and their circumstances in order to achieve the suitable employment goal. The employment pathway services selected relevant to a worker’s requirements will be detailed in the completed employment pathway plan. Employment pathway services, where incurred as external costs to the job placement specialist, are to be paid by the job placement specialist who then seeks reimbursement from ReturnToWorkSA or the claims agent. Transport costs will ideally be paid by the worker who will then seek reimbursement from ReturnToWorkSA or the claims agent. Interpreter services will be paid directly to the provider by ReturnToWorkSA or the claims agent. The Re-employment Incentive Scheme for Employers (RISE) program provides wage subsidies for employers and can be actively marketed in consultation with the worker. RISE requires approval by ReturnToWorkSA or the claims agent. Other wage subsidies are not permitted to be reimbursed as employment pathway services. Job carving is the creation of a modified job to fit the worker’s skills and capabilities and can occur in relation to an existing vacancy request from an employer. Job carving can relate to several workers, but shall not include general marketing to employers. The cost of job carving shall be allocated across the relevant workers. A log of reverse marketing and job carving activities for workers shall be retained by the job placement service provider. JB312 Post placement support $95.00 per hour Direct contact to support employment durability in addition to the expected one contact per fortnight with the worker and/or employer. Post placement support and mentoring can be offered to address issues which are likely to impact on the worker’s ability to continue in an employment placement. JB314 Assistance to overcome non-vocational barriers, for example: mental health support substance dependency services gambling rehabilitation personal development and self-esteem family support financial counselling anger management support. Reimbursement at reasonable cost Only to be incurred with approval by ReturnToWorkSA or the claims agent Assistance to overcome non-vocational barriers may be reimbursed where the service may be approved by the case manager. The job placement service provider must pay these services directly to the relevant provider then seek reimbursement form ReturnToWorkSA or the claims agent using item number JB314. JB315A Worksite assessment service JB315B The purpose of this service is to ensure that a safe and suitable return to work occurs with the new employer. It is used in circumstances where there is uncertainty about the suitability of the proposed duties and additional expertise beyond that of job placement service provider is required. The assessment should include recommendations in relation to the employment or work trial suitability that will assist the worker’s safe and durable return to suitable employment. This service can only be delivered by class A or B consultants (physiotherapists or occupational therapists) employed by an appointed Return to Work service provider under the Return to Work scheme. Class A $173.90 per hour (max 6 hours) Class B $141.50 per hour (max 6 hours) The service is to be delivered in accordance with the worksite assessment service detailed in the return to work assessment services section of this fee schedule. It includes: workplace visit with worker and employer/host employer travel recommendations for any workplace accommodation and/or education clarification of worker’s capacity from treating doctor, if required report summarising recommendations including capacity of the worker to perform duties and any strategies that will assist the worker’s safe and durable return to the proposed suitable employment. Changes in employment status Upgrading employment hours: where a worker is initially employed at below full capacity, providers should continue to assist a worker in maximising their earnings, and reducing their maximum income support. This may be through: - upgrading hours within the existing placement - obtaining a supplementary placement - obtaining a new placement with greater earnings and hours of work. the maximum income support threshold for 26 week durability fee – full outcome is 15% compared to 10% for 13 week durability fee – full outcome. This is to provide incentive for the provider to increase a worker’s hours of work where they are initially employed below full capacity. In cases where a return to work is possible, a separate referral to a return to work service will be required to drive a return to work outcome. Services provided outside of this fee schedule and policy may be approved by the case manager on a case-by-case basis. The initial assessment will incorporate, but is not limited to: a meeting with the worker, employer (where applicable) and treating doctor assessing the barriers to the worker’s access to the community and identifying actions to address these establishing an agreement on the Recovery/return to work plan between all parties completing and submitting an initial assessment report, which includes recommended strategies to how the restoration to the community plan will be implemented assisting the case manager in establishing a Recovery/return to work plan where requested traveling time required to deliver this service completing and submitting an initial assessment report to the case manager. Ideally, this is to be submitted within 15 working days Restoration to the community coordination (RC307) The case manager may refer for restoration to the community coordination. During the restoration to the community coordination service, the provider will implementation the restoration to the community plan. Equipment expense reimbursement (RC910) Additional regional travel (RC901) For equipment expenses incurred by a provider to directly support the worker’s restoration to the community: The case manager may approve additional regional travel for up to five additional hours maximum: for the initial assessment only where the worker’s workplace, office of their employer, rooms of the worker’s treating doctor, or other appropriate place to deliver a service is located in one of the regional postcodes listed in Appendix 3. Note: only the portion of time taken to travel beyond 50km from the provider’s closest place of business is chargeable under this item. Travel expense reimbursement (RC907) Where the provider is required to travel to a destination greater than 100km from the provider’s closest place of business, travel expenses incurred for a return to work service delivered may be reimbursed. This must be at the request of the case manager. These expenses may include: prior approval from the case manager must be obtained tax compliant invoices for equipment expenses must be provided with the relevant invoice before payment will be made. Where a service uses time based billing, the actual time taken must be accumulated for the day and then rounded to the nearest 6 minutes. economy airfares, overnight accommodation and reasonable cost for meals associated with the overnight stay, taxi fares, car parking and car hire expenses (excluding fuel costs and vehicle mileage). To receive reimbursement, the provider’s invoice is to include: tax compliant invoice for travel expenses incurred, AND receipt for travel expenses. ReturnToWorkSA - Return to work services fee schedule 2015-16 claims management functions advocacy treatment services overseeing or monitoring of the worker’s treatment or scheduling medical/treatment appointments worker transport costs and interpreter services, as these are to be reimbursed to the worker or paid directly to the provider by the case manager. 39 Referral criteria Travel expense reimbursement (WA907) Who can request return to work assessment services A case manager may require a service to be delivered at a location greater than 100km from the provider’s closest place of business. In these circumstances a case manager may approve reimbursement of the following travel expenses: These services may only be requested by ReturnToWorkSA or the claims agent. The requestor is to include relevant and appropriate information with the referral which may include, but is not limited to: medical reports, current Work Capacity Certificate or WorkCoverSA Medical Certificate, previous assessment reports etc. Note: The provider is responsible for identifying the appropriate and qualified return to work consultant within their organisation to complete the assessment service. Where multiple specialities are required, the provider is to coordinate this and submit a single integrated report to the case manager. Travel Travel time is included in the Return to work assessment services. Travel time must be: directly related to the provision of the Return to work assessment service for a referred worker, as described in this fee schedule documented in the worker’s case file including purpose, origin, destination and travel time in minutes (including return) divided proportionately between each worker where travel involves provision of services to multiple workers. Note: Additional information is located in the invoicing section. Additional regional travel (W901A/B) The case manager may approve additional regional travel for up to five hours at a time (up to a total maximum of 10hrs): where the worker’s workplace, office of their employer, rooms of the worker’s treating doctor, or other appropriate place to deliver a service is located in one of the regional postcodes listed in Appendix 3. Note: Only the portion of time taken to travel beyond 50km from the provider’s closest approved regional office is chargeable under this item. economy airfares, overnight accommodation and reasonable cost for meals associated with the overnight stay, taxi fares, car parking and car hire expenses (excluding fuel costs and vehicle mileage). To receive reimbursement, the provider must submit: a tax compliant invoice for travel expenses incurred, and a receipt for each travel expense incurred. The invoice must be clearly itemised if more than one expense is being claimed (eg airfare, accommodation, meals, etc). Economy airfare means the amount determined by ReturnToWorkSA to be the reasonable cost of undertaking the travel using a standard economy airfare. If travel is undertaken for more than one worker, the travel expenses must be divided proportionately between the two or more workers. Equipment expense reimbursement (WA910) The case manager may approve reimbursement for equipment expenses incurred by a provider to directly support the worker’s return to work. Reimbursement will only be made where: there is evidence of prior approval from the case manager where the cost of the item is greater than $500, and tax compliant and itemised invoices for equipment expenses are provided. Employers are expected to fund reasonable workplace modifications and workplace equipment to accommodate a worker’s injury or disability. Where this is not reasonable and practical, a request, including items required and their cost, should be forwarded to the case manager for consideration. Invoicing Please refer to the Invoicing section of this fee schedule. All return to work assessment services are to be charged as a single invoice transaction. ReturnToWorkSA - Return to work services fee schedule 2015-16 40 Service item descriptors Agent case conference support service The purpose of the agent case conference support service is to assist the case manager in their agent case conferencing. The nature and the focus of the service will be contingent on the worker’s needs within their return to work process. Who can deliver an agent case conference support service ReturnToWorkSA will pay for agent case conference support services delivered by: Class A RTW consultants Class B RTW consultants. Functional capacity evaluation and report The purpose of the functional capacity evaluation (FCE) is to determine the worker’s capacity over a range of physical demands in order to make recommendations for participation in work and specific duties available to the worker. The FCE is a standardised battery of tests used to evaluate a worker’s capacity for work related activities. Who can deliver a functional capacity evaluation service ReturnToWorkSA will only pay for functional capacity evaluations delivered by Class A or B RTW Consultants who are: What ReturnToWorkSA will not pay for ReturnToWorkSA will not pay for this service concurrent with: And who: pre-injury employer service fit for work service. It is expected that agent case conference support service would form part of the service and hours within these two services. When can a referral be made A case manager may refer for this service when the expertise of a RTW Service provider is required to support an agent case conference. It is designed to be a very targeted and short term intervention. What is required within an agent case conference support service discussion or visit with the treating medical practitioner and/or other treating providers to gather the worker’s return to work, certified medical capacity and treatment status and progress preparation for and/or attendance at the agent case conference preparation of a brief report for the case manager travel to and from the case conference. Within this service, the case manager will be responsible for: ascertaining the type of information required the method by which the information is to be obtained completing and distributing any necessary outcome summary documentation and reporting. are formally trained in FCEs, and when required, formally certified in their nominated assessment system have the correct environment and space for the FCE equipment, and maintain and regularly calibrate the equipment have appropriate facilities, equipment and training to respond to emergencies. Functional capacity evaluation report On completion of the service, a functional capacity evaluation report is to be submitted to the case manager and includes: injury/diagnosis results of subjective interview results of self-reported measures current work status results of physical examination/screening behavioural aspects including pain behaviour and effort pace of work clinical observations including body mechanics functional abilities for the assessed physical demands capacity to perform specified duties when requested job matching, where a job description including documentation of the job demands has been provided appropriate recommendations relevant to the conclusions drawn from the results obtained during the evaluation. Return to work goal verification service and report shall be excluded from providing new employer services in respect of the worker’s return to the workforce with a new employer. Who can refer for RTW goal verification service and report These services may only be requested by ReturnToWorkSA or the claims agent. The requestor is to include relevant and appropriate information with the referral, which may include, but is not limited to medical reports; current Work Capacity Certificate or WorkCoverSA Medical Certificate; pre-injury employer reports where appropriate, and the Recovery/return to work plan. Who can be referred for this service A worker may be referred for this service when: the worker’s current RTW goal is return to their preinjury employer and the case manager requires the expertise of a RTW service provider to assess, or provide an independent opinion on the availability of suitable employment at the pre-injury employer and worker’s medical status is stable and a pre-injury employer Level 1 or Level 2 service has been delivered without resulting in a full sustainable outcome. Note: If no PIE service has been delivered to date, the referral should be for a PIE Level 1 service. The purpose of a Return to work (RTW) goal verification service is to provide an independent and evidence-based assessment of the availability of suitable employment at the pre-injury employer. The service also includes an assessment of the physical and/or psychological demands of duties at the workplace and a recommendation for appropriate workplace modifications, where required, to accommodate a worker’s medically certified work capacity. Who can deliver a RTW goal verification service and report ReturnToWorkSA will pay for RTW goal verification services delivered by: RTW service providers who are independent, meaning that their organisation: has not provided pre-injury employer services in respect of the worker at the pre-injury employer ReturnToWorkSA - Return to work services fee schedule 2015-16 42 What is required within a RTW goal verification service The RTW goal verification services includes, but is not limited to: a review of the history and return to work progress to date (including medical, vocational and return to work services history and reports). attendance at the pre-injury workplace(s) with worker, employer. identification of all suitable employment options at the pre-injury employer including consideration of: - physical environment - mental work demands - human behaviour - working conditions - educational requirements - other relevant component. establishing the worker’s capacity to undertake the available suitable employment giving consideration to the available medical evidence, and the provider’s knowledge of the injury, treatment, pathology and prognosis assessing the barriers to the worker’s return to work and identifying actions to address these consultation with the worker, pre-injury employer and treating doctor that explores and exhausts all suitable employment options with pre- injury employer the outcome of consultation and any agreements made by the parties with regard to the worker’s capacity to return to PIE making recommendations for workplace modifications or equipment where necessary to accommodate the worker’s return to suitable employment recommendation for the RTW goal (PIE or NES) providing recommended return to work arrangements that will assist the case manager in establishing a Recovery/return to work plan where appropriate a report. It is a reasonable expectation that components of the assessment would already have been conducted as part of pre-injury or fit for work services. The service must be tailored to the worker’s circumstances and the information required for identifying suitable employment. This service includes a report integrating the evidence: RTW goal verification service and report On completion of the service, a RTW goal verification service and report is to be submitted to the case manager and include: an overview of the workplace and the worker’s preinjury duties suitable employment options at the pre-injury employer supporting the suitable employment options, and of agreement by the treating doctor in respect of identified suitable employment options. The service will include tailoring the employment options to the worker’s specific circumstances and obtaining agreement from the worker and their treating doctor. Who can deliver a vocational assessment and report ReturnToWorkSA will pay for vocational assessments and reports completed by: Class A or B RTW consultants – Psychologist. What is required within a vocational assessment service Worksite assessment and report The purpose of a worksite assessment is to ensure that a safe and suitable return to work occurs. The service includes the identification of suitable duties and/or employment, and an assessment of the physical and / or psychological demands of duties at the workplace. It also includes the recommendation of appropriate workplace modifications to accommodate a worker’s capacity for work and achieving agreement by the involved parties on the return to work arrangements. This service is intended to provide the employer with one off expert assistance in cases where the return to work strategy includes the employer managing the return to work rather than engaging other services, such as PIE services. It includes: attendance at the worksite with the worker and employer establishing the worker’s capacity to undertake pre injury duties and individual tasks, giving consideration to the available medical evidence, and the provider’s knowledge of the injury, treatment, pathology and prognosis identification of suitable duties (which may be preinjury duties, including consideration of: physical environment mental work demands human behaviour working conditions educational requirements other relevant components. assessing the barriers to the worker’s return to work and identifying actions to address these recommending workplace modifications or equipment where necessary to accommodate the worker’s return to work educating the worker in safe work practices relevant to their return to work duties where appropriate establishing agreed return to work arrangements with the worker, employer and doctor providing recommended return to work arrangements to the case manager that will assist them to establish a Recovery/return to work plan. Mediation services The purpose of mediation services is to enable effective, structured and meaningful conflict resolution to resolve barriers that are preventing a return to work outcome within the first twelve months of a claim. The outcome of service is to facilitate timely, safe and durable return to work outcomes. Mediation is a ‘stand-alone’ service. Participation is voluntary and should not proceed where one party is not participative. Mediation should not be adversely impacted by other claims management activities when determining the compensability of the claim. Services provided outside of this fee schedule and policy may be approved by the case manager on a case-by-case basis. Mediation reporting A mediation report should be completed on ReturnToWorkSA’s proforma and provided to the case manager within 5 business days following the completion of service. Invoicing Information What are the payment conditions Providers should only invoice for services described in this fee schedule. Payment for services (including reports) will not be made in advance, except for where explicitly noted in this fee schedule. There must be written evidence of case manager referral and authorisation on an approved referral letter prior to the provision of the service. Services are only chargeable if provided by a registered return to work consultant (or employment consultant for JPS) (ie, services provided by nonqualified administration staff are not chargeable). How is chargeable time calculated Where a service uses time based billing, the actual time taken must be accumulated for the day and then rounded to the nearest six minutes. What is not chargeable Providers should not invoice for the following: work undertaken by clerical/administration staff or other non- qualified staff file maintenance typing, photocopying preparing and submitting billings and accounts distributing reports receiving and reading of a medical certificate (Work Capacity Certificate or WorkCoverSA Medical Certificate) time already billed on another claim cancelled appointments self-marketing supervision including peer review of files activities that are part of ReturnToWorkSA’s or the Job Placement Specialist provider’s quality assurance process staff training and professional development research to improve the knowledge and skills of consultants. What records of services rendered are to be maintained? Providers are required to maintain on a worker’s file a record of all services invoiced, including the date those services were provided and sufficient detail to enable verification (e.g. copy of email, travel destination and distance), in accordance with their Conditions of Appointment. What information is required on an invoice? For all invoices, whether a tax invoice or not, the following information should be provided: ReturnToWorkSA - Return to work services fee schedule 2015-16 provider details – name, ReturnToWorkSA provider number, contact and location details invoice number and invoice date Australian Business Number (ABN) worker’s surname and given name(s) claim number brief description of the injury to which the services relate employer name, if known each service itemised separately in accordance with this fee schedule including: date of service and commencement time service item number and service description duration of service in hours/minutes rounded to the nearest 6 minutes for hourly rate services charge for the service total charge for invoiced items plus any GST that may be applicable bank account details for electronic funds transfer (EFT). ReturnToWorkSA or the claims agent is unable to pay on ‘account rendered’ or statement invoices. Payment will be made, where appropriate, on an original invoice or duplicate/copy of the original. When to submit an invoice Invoices are to be submitted within four weeks of completion of the service. Invoices received more than six months after date of service may not be paid unless in exceptional circumstances. GST All amounts listed in this booklet are exclusive of GST. If applicable, ReturnToWorkSA will pay to the provider an amount on account of the provider’s GST liability in addition to the GST exclusive fee. Return to Work Service Providers should provide ReturnToWorkSA or the claims agent with a tax invoice where the amounts are subject to GST. Appendix 1 – Definitions Case manager refers to the person with primary responsibility for management of the worker’s claim at ReturnToWorkSA or the claims agent. 50 Conditions of appointment refer to the terms and conditions under which the provider is appointed under Part 3 of the Act as a Return to Work Service Provider. Fitness upgrade pathway services refers to fitness upgrade assistance provided to the worker under the Fitness Upgrade Program items of this fee schedule. Return to work consultant means a person employed by a Provider and registered with ReturnToWorkSA to deliver the services under the Terms and Conditions of Appointment as a South Australian Scheme Return to Work Service Provider. Fee schedule means the Return to Work Services fee schedule, as amended from time to time, and published on our website at www. rtwsa.com. Current medical capacity is the hours for which the worker is certified as fit for paid employment with or without restrictions specified on the worker’s most current medical certificate (Work Capacity Certificate or WorkCoverSA Medical Certificate) at the relevant time (for example, at the commencement of paid employment). Provider organisation (Provider) refers to an organisation which has been appointed by ReturnToWorkSA to provide Return to Work Services to assist workers to remain at work or return to work following a work injury. Date of injury is the date on which the worker sustained the injury that is the basis for their claim as recorded on ReturnToWorkSA or the claims agent’s claims management information system. An Employment consultant is a person who provides nonadministrative job seeking assistance to workers who is employed by a Job Placement Specialist appointed under Part 3 of the Act. Employment pathway plan refers to a plan that has been discussed with the worker specifying, at a minimum, the following: specific suitable employment goals wider suitable employment goals employment pathway activities plan, including detailed description of activities to be undertaken by the worker. In addition, it shall include a planned allocation of Employment Pathways Services expenditure for discussion with the case manager (and the worker at the discretion of the Job Placement Specialist). Employment pathway services refers to return to work assistance provided to the worker under the Employment Pathway Services service items of this fee schedule. Fitness pathway program refers to a program that has been discussed with the worker and nominated treating doctor specifying, at a minimum, the following: fitness upgrade goals at specific milestones and fitness pathway activities plan, including detailed description of activities to be undertaken by the worker. Host organisation refers to a company or business, not the pre-injury employer, which provides work training or work hardening. Maximum income support is the notional weekly earnings less Part 4, Division 4 income support reductions (step downs). A Non-payable placement is a position: where the worker obtains employment more than 180 calendar days following the cessation of services from the Job Placement Specialist provider. where the worker obtains employment following the cessation of services with the Job Placement Specialist provider, and commencement of services with another Job Placement Specialist provider or Return to Work Service Provider that is providing job seeking assistance. that would lead to employment involving nudity or in the sex industry, including retail positions. for placement in work experience activities. where the worker commences his own business. that contravenes Commonwealth, State or Territory legislation or provides terms and conditions of employment which are inconsistent with the relevant workplace/industrial relations laws, or any instrument made under such laws. that pays a commission as either the entire remuneration or part of the remuneration, except where any commission being paid to the worker is in addition to the amount being paid to the worker in accordance with any applicable Commonwealth or State law and any applicable award, industrial agreement and/or national minimum wage order. where the type of work is inappropriate for the worker’s medically certified work capacity. for a school-based traineeship and/or apprenticeships. in a training course. for self-employment opportunities. that involves taking up employment in another country, regardless of whether the salary is paid in Australian Dollars or by an Australian company. for non-ongoing employment or a Work Trial, and/or for which the Job Placement Specialist provider has already claimed the relevant placement or outcome fee. Potential future suitable employment is where suitable employment is obtainable following provision of training to the worker. In addition, it shall include a planned allocation of Fitness Pathways Services expenditure for discussion with the case manager (and the worker at the discretion of the return to work service provider. ReturnToWorkSA - Return to work services fee schedule 2015-16 Reasonable costs as defined in section 33 of the Act. Suitable employment means employment in work for which the worker is suited, whether or not the work is available, having regard to the following: 51 the nature of the worker’s incapacity and previous employment the worker’s age, education, skills and work experience the worker’s place of residence medical information relating to the worker that is reasonably available, including in any medical certificate or report the worker’s Recovery/return to work plan, if any. Specific suitable employment goals include identification of (1) current suitable employment goals, and (2) potential future suitable employment goals for the worker. The goals must be realistic and in areas of the labour market where employment is known to be commonly available. Wider suitable employment goals specify the wider criteria for consideration in assessing further suitable employment. For example: ‘Any employment that falls within the following generic employment parameters will be regarded as suitable: (include a brief summary of the worker’s transferable skills, qualifications, capacity for work (based on medical restrictions stated in the latest functional assessment or Work Capacity Certificate/WorkCoverSA Medical Certificate)’. Work trial in instances where a worker has limited work capacity, skills or experience, a graduated program of work tasks that are conducted in the workplace and progress to paid employment, may be appropriate. Work trials aim to prepare a worker to return to paid employment by: increasing capacity, tolerance and endurance for the physical and intellectual demands of specified duties or employment updating existing skills or acquiring new skills improving work performance.
