POLICY
It is the policy of the Facility Name to investigate and document compliance with
the US Environmental Protection Agency (EPA) Spill Prevention Control and
Countermeasure Rule (SPCC).
PROCEDURE
The SPCC Rule 40 CFR Part 112 was promulgated in accordance with the Oil
Pollution Prevention regulation under the authority of the Federal Water Pollution
Control Act (Clean Water Act). The categories for “oil” or “waste oil” include: (1)
Petroleum oils, (2) animal fats and vegetable oils, in accordance with Edible Oil
Regulatory Reform Act (EORRA); and, (3) other non-petroleum oils and greases.
The rule specifies that proactive measures be used to respond to oil discharges if
the hospital’s location could reasonably be expected to discharge oil in harmful
quantities into the navigable waters of the United States or adjoining shorelines and
the hospital meets any of the following criteria:



Have containers used for the storage of oil in a capacity greater than 55
gallons per unit.
Have aboveground storage containers greater than 1,320 gallons in capacity
(completely buried storage tanks subject to all of the technical requirements
of the Underground Storage Tank (UST) regulations are exempt if less than
42,000 gallon total capacity).
Have had 2 discharges (over 42 gallons) in any 12-month period or a single
discharge of more than 1,000 gallons.
To determine if the Facility Name must comply with the SPCC Rule, an assessment
will be conducted that identifies the following:




Distance of the Hospital or associated businesses to navigable waters of the
United States or adjoining shorelines (including tributaries and
environmental drainage systems).
Location and capacity of all aboveground oil storage containers.
Location and capacity of storage containers greater than 55 gallons.
Documentation of spills involving oil within the past 12 months.
If it is determined from the assessment that the Facility Name meets any of the
above criteria, a SPCC Rule and a Hospital Response Plan (FRP) will be developed
as described in 40 CFR Part 112. The preparation or revision of the SPCC and FRP
will be performed by a Certified Professional Engineer (PE).
The assessment will be repeated when there is any change in the oil utilization,
transfer, or storage program or acquisition of properties that could discharge oil in
harmful quantities into the navigable waters of the United States or adjoining
shorelines.
