V8J 3S2 is authorised to discharge effluent to the water from a kraft pulp mill complex located at Watson Island, near

Prince Rupert, British Columbia, subject to the conditions listed below. Contravention of any of these conditions is a violation of the Waste Management Act and may result in prosecution.

This permit supersedes and amends all previous versions of Permit PE01157 , issued under Part 2 Section 10 of the Waste Management Act.

AUTHORISED DISCHARGES

1.1

This subsection applies to the discharge of effluent from a SECONDARY TREATMENT SYSTEM to PORPOISE HARBOUR . The site reference number for this discharge is E103446.

1.1.1

The maximum authorised rate of discharge is 210,000 m 3 /day.

The compliance location is the monitoring station located just downstream of the secondary clarifiers, unless otherwise specified by the Regional Waste Manager.

Monthly average is the average of the composites obtained in a month as per defined in Subsection 3.1.2.

The discharge of AOX shall be reduced or eliminated as required by the Pulp Mill and Pulp and Paper Mill Liquid Effluent

Control Regulations (BC Reg. 470/90)

Daily average is the average of the readings from the continuous pH meter, collected from 7 am to 7 am.

1.1.3 The authorised works are in-plant chemical and fibre recovery facilities, spill containment and collection systems, Golden Pond, wet well, primary clarifier, UNOX TM oxygen activated sludge reactor, two secondary clarifiers, effluent monitoring station, foam trap, submerged outfall, diffuser, the Zanardi collection works (consisting of the pump chamber and force main from West seep area, the wet well, pump chamber, diversion box and retention pond) and related appurtenances approximately located as shown on attached Site Plans A and B.

1.1.4 The location of the facilities from which the discharge originates is District Lot 507, Range 5,

Coast District, Watson Island, B.C..

1.1.5 The location of the point of discharge is the main diffuser located mid-channel in Porpoise

Harbour approximately 80 metres offshore in a South-westerly direction from Building #4 on

Watson Island.

1.2 This subsection applies to the discharge of clean hot water from THE HOT WATER DIVERSION to

THE MAIN OUTFALL LINE . The site reference number for this discharge is E225839.

1.2.1 The maximum authorised rate of discharge is 42,200 m 3 /day.

1.2.3 The authorised works are hot water diversion piping, effluent monitoring station, evaporators,

1.2.4 The location of the facilities from which the discharge originates is the same as that listed in

Section 1.1.4.

1.2.5

The location of the point of discharge is just downstream of the monitoring station for the secondary treatment system. This discharge enters the main outfall pipe, which discharges to

Porpoise Harbour as indicated in Section 1.1.5.

1.3

This subsection applies to the discharge of water treatment plant filter backwash water, cooling water, gland water, woodroom waste water, landfill Site 3 runoff (PR03097) and storm water from

LAGOON #1 to LAGOON #2.

. The site reference number for this discharge is E216186.

1.3.1

The maximum authorised rate of discharge is 83,000 m 3 /day.

The compliance location is the monitoring station located at the discharge from Lagoon #1 to Lagoon #2, unless otherwise specified by the Regional Waste Manager.

Hourly average is the average of the readings from the continuous pH meter from zero to sixty minutes after the hour.

• Note: In the event that the raw water pH is less than 5.0, the lower limit for pH at the Lagoon #1 discharge will be equal to that of the raw water, provided authorised sampling and analytical procedures are followed.

1.3.3

The authorised works are the mill site storm sewers and discharge points, in plant purification and filtration systems, cooling systems, Lagoon #1 (polishing pond), effluent monitoring station, raw water monitoring equipment, and related appurtenances approximately located as shown on attached Site Plan A.

1.3.4

The location of the facilities from which the discharge originates is the same as that listed in

Section 1.1.4.

1.3.5 The location of the point of discharge is the south end of Lagoon #1 where the mill access road crosses the outflow weir. This is the entrance to Lagoon #2.

2.0 GENERAL REQUIREMENTS

2.1 ADDITIONAL TREATMENT

If a permitted discharge is not meeting the effluent characteristics specified in this Permit or the discharge is causing an adverse impact on the environment, the Regional Waste Manager may require the Permittee to install additional treatment works or implement other measures necessary to meet permit conditions or to prevent adverse impact on the receiving environment.

2.2 EFFLUENT QUALITY LIMITS

Based on the results of the monitoring program or other information obtained, the Regional Waste

Manager may specify additional effluent quality limits and sampling methods, or increase the sampling frequency.

2.3 ALLOWABLE EFFLUENT CONCENTRATIONS

The Regional Waste Manager may amend the allowable effluent concentrations based on the 90 th percentile production and flow rates as submitted annually or based on other information obtained.

2.4 PROCESS MODIFICATIONS, NEW WORKS

The Permittee shall notify the Regional Waste Manager prior to implementing any changes that may affect the quality and/or quantity of the discharge.

The Permittee shall submit plans and specifications of any alterations or additions to the works authorised in Section 1 to the Regional Waste Manager for his review before construction commences.

2.5 MAINTENANCE OF WORK S, BYPASSES AND EMERGENCY PROCEDURES

The Permittee shall inspect the pollution prevention works regularly and maintain them in good working order. Scheduled bypasses of designated treatment works are prohibited unless the prior consent of the Regional Waste Manager is obtained. The Permittee shall immediately notify the

Regional Waste Manager or designate of any emergency or other circumstance which prevents continuing operation of the approved method of pollution control and shall take appropriate remedial action. Written confirmation of the foregoing is required by facsimile within 24 hours of the original notification unless otherwise directed by the Regional Waste Manager.

Unless directed otherwise, in the event of a bypass of the designated treatment works, the Permittee is required to immediately collect discharge samples to be analyzed for Daphnia magna and rainbow trout acute lethality, as well as other parameters to be specified by the Regional Waste Manager.

2.6 NON-COMPLIANCE NOTIFICATION

The Permittee shall immediately notify the Regional Waste Manager or designate of any noncompliance with the requirements of this permit and take appropriate remedial action. In the event of a non-compliance situation, the Permittee may be required to immediately collect a discharge sample of sufficient volume that it may be analysed for Daphnia magna and rainbow trout acute lethality, as well as other parameters to be specified by the Regional Waste Manager.

2.7

ADDITIONAL NOTIFICATION

a) Use of neutralizing chemicals

The Permittee shall immediately notify the Regional Waste Manager or designate of the addition of acid or base into an effluent discharge, used solely to neutralize the effluent. In addition, unless directed otherwise, in the event of such a discharge, the Permittee is required to immediately collect a discharge sample of sufficient volume that it may be analyzed for Daphnia magna and rainbow trout acute lethality, as well as other parameters as specified by the Regional Waste Manager.

b) Lagoon #1

The Permittee shall immediately notify the Regional Waste Manager or designate of any effluent discharge to Lagoon #2 from Lagoon #1 that exceeds a total suspended solids concentration of 100 mg/l . In the event of such a discharge, the Permittee is required to have the composite analyzed for Daphnia magna acute lethality and metals concentration, as well as other parameters as specified by the Regional Waste Manager.

2.8 FOLLOW-UP REQUIREMENTS TO SECTION 2.5, 2.6 AND 2.7

Written confirmation of all immediate reporting events under Sections 2.5, 2.6 or 2.7 of this Permit, including available relevant test results, is required by facsimile within 24 hours of the original notification unless otherwise directed by the Regional Waste Manager. In addition, the Permittee shall submit to the Regional Waste Manager as part of the subsequent monthly report, details which include, but are not necessarily limited to, the following: a) all relevant test results related to the event, b) an explanation of the most probable cause(s) of the event, c) remedial action being planned and/or taken to prevent similar events in the future.

2.9 FOAM

Should objectionable amounts of foam, attributable to the effluent, occur on the receiving waters, measures will be required to either eliminate the cause of the foam or to eliminate the foam by additional treatment. The Permittee shall immediately notify the Regional Waste Manager or designate of any discharge of foam into the receiving environment and take appropriate remedial action.

2.10 COLOUR

Should colour, attributable to the effluent, become an objectionable feature in the receiving environment, then additional treatment shall be provided to remove colour forming constituents from the effluent prior to discharge when so directed in writing by the Regional Waste Manager.

2.11 EMERGENCY RESPONSE PLAN

The Permittee shall have an Emergency Response Plan that describes the procedures to be taken to prevent or mitigate any deposit of a deleterious substance out of the normal course of events. The

Emergency Response Plan shall be immediately implemented if there is a deposit, or any risk of a deposit, of a deleterious substance out of the normal course of events. In addition, an updated emergency response plan, including a report on any emergency responses taken in the previous year, shall be submitted to the Regional Waste Manager by January 31 of each year.

2.12 COMPLIANCE WITH FEDERAL REGULATIONS

The Permittee shall at all times comply with the provisions of the Fisheries Act (Canada), and the

Environmental Protection Act (Canada) with respect to its operations under this Permit.

Without limiting the generality of the forgoing, the Permittee shall ensure that all works and activities under permit meet the applicable requirements of:

The Pulp and Paper Mill Defoamer and Wood Chip Regulations (Canada Gazette, Part II, May 20,

1992),

The Pulp and Paper Mill Effluent Chlorinated Dioxins and Furans Regulation (Canada Gazette, Part II,

May 20, 1992), and

The Pulp and Paper Effluent Regulations (Canada Gazette, Part II, May 20, 1992).

Where there is a difference between the federal and provincial requirements, the more stringent requirements will apply.

2.13 EFFLUENT DIFFUSERINSPECTION

The Permittee shall inspect, and maintain as required, the effluent diffuser located in Porpoise Harbour.

The inspection will occur at a minimum three year frequency with the results to be submitted to the

Regional Waste Manager upon completion.

3.0 MONITORING AND REPORTING REQUIREMENTS

The Permittee shall undertake the following monitoring program. The Regional Waste Manager may modify the program based on the results submitted or any other data obtained by the Pollution Prevention staff.

3.1

DISCHARGE MONITORING

3.1.1 Grab And Composite Sampling

The Permittee shall install suitable sampling facilities and obtain grab and composite samples of the effluent discharges as specified below. Composite samples shall be taken using a method acceptable to the Regional Waste Manager. Proper care should be taken in sampling, storing and transporting the samples to adequately control temperature and avoid contamination, breakage, etc.

3.1.3 Toxicity Monitoring

In the event of a toxicity test failure, the Permittee shall immediately initiate the following sampling program: a) Failure of the Rainbow trout 96 hr toxicity test (LC

Daphnia magna toxicity testing shall be increased to three days per week until three consecutive tests are passed, at which time testing can revert to previous sampling schedule.

For the 96 hr toxicity tests, the percent mortality after 96 hours exposure of the test fish to

100% effluent shall be reported. For the 48 hr toxicity tests, the percent mortality after 48 hours exposure of the Daphnia magna fish to 100% effluent shall be reported.

3.1.4 Dioxin/Furan Monitoring

2,3,7,8-TCDD and 2,3,7,8-TCDF testing shall be conducted once per month as described above, with a minimum of 21 days between any sample collection. If three consecutive monthly samples of effluent meet the quality requirements as described in Subsection 1.1.2 above, testing may be reduced to once per quarter. If three consecutive quarterly samples meet the quality requirements as described in Subsection 1.1.2 above, testing may be reduced to annually. However, if any of the annual samples fail to meet the quality requirements, sampling shall revert to monthly. Annual samples shall be collected with at least 350 days between any sample collection.

3.1.5 Continuous Monitoring

The Permittee shall submit the daily minimum, maximum and average values for pH at the main effluent outfall, Zanardi outfall and the Hot Water Diversion. For Lagoon #1 discharge, in addition to the above, any hourly averages outside the permit limits shall be submitted. For conductivity, the daily maximum and average values shall be submitted for the main effluent outfall, Hot Water Diversion, Lagoon #1 and Zanardi discharges. The daily average and maximum temperature shall be submitted for the main effluent outfall and the Hot Water

Diversion. In addition, the daily average combined mill effluent temperature (TEMP) shall be submitted, as calculated using the following equation:

TEMP = [(TEMP1 x FLOW1) + (TEMP2 x FLOW2)] /(FLOW1 + FLOW2) where

TEMP1 is the daily average temperature ( o C) from the effluent from the secondary treatment system,

FLOW1 is the flow (m 3 /day) from the secondary treatment system,

TEMP2 is the daily average temperature ( o C) from the hot water diversion, and

FLOW2 is the flow (m 3 /day) from the hot water diversion.

3.1.6 Loading Values

The Permittee shall record the monthly minimum, maximum, and average values ( mg/L) for

TSS, BOD

and AOX.

In addition, the daily loading ( kg/d) and the monthly average loading (kg/ADt) values shall be recorded for TSS, BOD

5

and AOX, and are calculated as follows:

3.1.7 Flow Measurement

The Permittee shall provide and maintain suitable flow measuring devices to record:

Once per day the volume (m 3 /d) discharged over a 24-hour period via the outfalls specified in

Subsections 1.1, 1.2, 1.3 and 1.4. Once per month the total volume (m 3 /month) over the calendar month and the monthly average (m 3 /d) via the outfalls specified in Subsections 1.1,

1.2, 1.3 and 1.4.

Once per year, the annual average discharges (m 3 /d) from outfalls specified in Subsections

1.1, 1.2, 1.3 and 1.4.

Once per year, determine the yearly 90 th percentile of effluent volume discharged from the main effluent outfall, specified in Subsection 1.1. The yearly 90 th percentile is calculated using all effluent volumes recorded during the previous calendar. Only those days with flows greater than zero shall be included.

In addition, determine the highest yearly 90 th percentile volumes discharged from the main effluent outfall, specified in Subsection 1.1, for the previous three (annual) reporting periods.

Flow monitoring equipment shall be calibrated to be accurate within ±10 percent.

3.2

PRODUCTION FIGURES

The Permittee shall record, once per day, the total mill pulp production (ADt/d). Once per month, determine the monthly average of the daily production (ADt/d). The monthly average production is the sum of the daily production during the month divided by the number of days during the month. All data, including that corresponding to “zero” (or almost zero) production days shall be included for the purpose of averaging.

Once per year, determine the 90 th percentile of total pulp production based on daily production values recorded during the previous calendar year. In addition, determine the highest yearly 90 th percentile pulp production value, for the previous three calendar years. Only those days with production greater than zero shall be included.

3.3

ENVIRONMENTAL STUDY

As required by the Federal Regulation, the Permittee shall retain a qualified consultant to carry out a study, on the environmental impact of the effluent discharges on the receiving environment. The study shall be undertaken subject to consultation with and approval of the Regional Waste Manager.

Results of monitoring requirements for effluent and receiving environment (water, sediment and biota) shall be included, as specified in Aquatic Environmental Effects Monitoring Requirements (EPS

1/RM/18) by Environment Canada and the Department of Fisheries and Oceans, dated May 20, 1992, and the associated Annex 1 Aquatic Environmental Effects Monitoring Requirements at Pulp and

Paper Mills and Off -Site Treatment Facilities regulated under the Pulp and Paper Effluent Regulations of the Fisheries Act, also dated May 20, 1992.

3.4

ANALYSIS

Analyses are to be carried out in accordance with procedures described in the latest version of "British

Columbia Environmental Laboratory Manual for the Analysis of Water, Wastewater, Sediment and

Biological Materials, (March 1994 Permittee Edition)", or by suitable alternative procedures as authorised by the Regional Waste Manager.

9452, Stn. Prov. Govt, Victoria, British Columbia, V8W 9V7 (1-800-663-6105 or (250) 387-4609). A copy of the manual is also available for inspection at all Pollution Prevention offices.

3.5

SAMPLING PROCEDURES

Sampling is to be carried out in accordance with procedures described in the latest version of “British

Columbia Field Sampling Manual for Continuous Monitoring plus the Collection of Air, Air-Emission,

Water, Wastewater, Soil, Sediment, and Biological Samples. 1996 Edition (Permittee),” or by suitable alternative procedures as authorised by the Regional Waste Manager.

3.6

QUALITY ASSURANCE/QUALITY CONTROL (QA/QC) PROGRAM

Data Quality Assurance Regulation.

Pollution Prevention

1.

Obtain and keep current, the laboratory precision, bias and blank quality control data quality objectives(DQO’s), for each laboratory analysed parameter from the analytical laboratory(ies).

Develop, and keep current, precision and blank quality control DQO for field data. These

DQO’s must be acceptable to the Regional Waste Manger, and kept available for review.

Develop and keep current, QA/QC standard operating procedures, acceptable to the Regional

Waste Manager, and keep this information available for review.

3.

Obtain CAEAL certification for pH, BOD, TSS and daphnia toxicity testing.

4.

Collect one duplicate sample per week from one of the discharge points.

5.

Each duplicate sample shall be submitted to the laboratory; one of the pair identified as the regular sample, and the other, as a blind sample identified by a fictitious site-name established solely to identify the duplicate sample.

6.

For each parameter, record the results of the field duplicates in terms of the degree of variation as the relative percent difference (total assay error), and report the acceptance of these results. If the total assay error exceeds the field DQO (i.e. not acceptable), effort shall be made to determine and control the source of the variation. Results of these efforts shall be submitted with the subsequent monthly report.

A sample collection blank shall be prepared, containing distilled water, and preservative if required, and submitted as a blank sample with one sample set per month. If any result for any parameter indicates detectable concentrations, then efforts shall be made to determine and control the source of contamination. Results of these efforts shall be submitted with the subsequent monthly report.

Complete full calibrations, at a minimum of once per month, of all continuous monitors required under this permit and maintain these records for review.

The Regional Waste Manager may require submission of additional information pertaining to the

QA/QC program.

3.7

ENVIRONMENTAL IMPACT

Inspections of the discharge will be carried out by Pollution Prevention Program personnel as a part of the routine permit inspection procedure. Based on these inspections and any other information available to the Regional Waste Manager on the effect of the discharge on the receiving environment, the Permittee may be required to undertake additional monitoring and/or install additional pollution prevention works.

3.8

OPERATOR CERTIFICATION

The effluent treatment system shall be operated and maintained by persons who the Permittee can demonstrate to the satisfaction of the Director, are qualified in the safe and proper operation of the facility for the protection of the environment.

3.9

REPORTING

The Permittee shall electronically submit the data generated in accordance with the sampling and monitoring specified in Subsections 3.1 3.2 and 3.6 above, to the BC Environment database. The results of any additional testing conducted on the authorised discharges by the Permittee shall also be submitted. In addition, a monthly summary report, identifying all non-compliances, shall be

Pollution Prevention submitted to the Regional Waste Manager or designate. Both data submissions and reports shall be submitted within 30 days of the end of the subject monitoring period, in a format acceptable to the

Regional Waste Manager. Data collected to fulfil federal requirements shall also be submitted electronically, to the Environment Canada database, within 30 days of the end of the subject monitoring period.

The 90 th percentile flow volumes and production rates as specified in Subsections 3.1.7 and 3.2 shall be submitted annually by January 31 for the previous calendar year.

3.9.1 Annual Report

The Permittee shall submit a comprehensive annual report which includes a summary of the results of all monitoring programs as specified in this Permit, data interpretation and trend analyses, assessment of performance based on QA/QC data, as well as an evaluation of the environmental impacts of the discharges. The report shall be in a format acceptable to the

Regional Waste Manager and suitable for release to the public or other government agencies.

Each annual report shall be submitted by March 31 for the previous calendar year.

3.9.2 Spill Reporting

All spills to the environment (as defined in the Spill Reporting Regulation) shall be reported immediately in accordance with the Spill Reporting Regulation. Notification shall be via both the Provincial Emergency Program at 1-800-663-3456 and the regional contact person.

The Permittee shall report any deposit out of the normal course of events, in an acceptable format, as required by the federal regulations
