Frequently Asked Questions (FAQ’s ) raised while applying for Registration with DGS&D for Imported Stores : Application ‘Form E’ (Suppliers of Imported Stores) Although the application for Registration for Imported Stores and guidelines for Registration are available on DGS&D website and are quite clear, however, sometimes certain questions are raised by the applicants. The answers/ solutions to these questions are as below: 1. Who are eligible to sign a registration application? An application should be signed by authorized signatory (ies) as below: a) Proprietorship: Proprietor, b) Partnership: All the partners, c) Limited company: Managing Director or any of the Directors duly authorized ( by MD or by a Board of resolution) In case application is signed by an attorney on behalf of an authorized signatory (Proprietor/ Partners/ Directors), a copy of General Power of Attorney duly attested by a Notary public/ 1st class Magistrate, should be furnished. The firm should ensure that the GPA must authorize the person appointed as a constituted attorney to do the following acts: i) To sign for & on behalf of the firm, ii) To bind the firm in all contractual obligations, iii) To refer the disputes if any, arising out of contracts placed on the firm by DGS&D or any of its regional officers to arbitration under the Indian Arbitration Act 1996. 2. Should each page of the application be signed? Yes, each page of the application and its enclosures should be duly ink signed with the firm’s seal by the authorized signatory. A duplicate copy of the complete application should also be submitted along with the original one. 3. Should I submit IEC number? Yes, a copy of ‘Certificate of Import Export Code’ issued by DGFT, Govt. of India should be submitted. 4. Should I submit original catalogue for each item/ model? Yes, original catalogue from foreign principal or catalogue downloaded from the website of the foreign principal should be submitted. 5. What should I indicate as the firm’s performance? The firm should indicate its sales performance as regard to the applied/ similar items as per proforma given in the Annexure-IV of the Form E. The sale performance should be furnished for supplies to Government/ semi-Government/ Limited Companies for the last three years. 6. What should I furnish to indicate my sales turn over? The applicant firms are advised to give copies of their statement of profit and loss accounts and balance sheet for last three years, duly certified by their Chartered Accountant. 7. What constitutes import documents? 8. In this regard, bill of entry issued by Indian Customs, indicating the firms IEC Code, invoice number and indication of each item/ model applied for to be furnished. The copies of corresponding invoices/ packing list/ HAWB bills may also be submitted. (Notarized copy to be submitted). What information should I furnish as the Agency Agreement? The information asked in the corresponding columns against “Agency Agreement” in the application should be explicitly filled by the applicant. And the same information should be indicated very clearly in the “Agency Agreement” with their foreign principal. The Agency Agreement should be signed by both the authorized persons of the firm and their foreign principal. The name, designation and email ID of both the signatories should be very clearly indicated in the Agreement. They should also sign each page of the agency agreement. (Notarized copy to be submitted). 9. What should I furnish to confirm the names of the Directors of the firm? In a limited company, where a number of Directors are there, the latest form 32 preferably downloaded from the website of Ministry of Corporate Affairs should be submitted. 10. What is the road map of the product? The road map of each model is to be declared by the foreign principal and should indicate: a) Date of launch of the model by the foreign principal. b) Date of expected discontinuation of the model. c) Date up to which spares should be supplied. 11. Should I have a BIS License/ ISO 9000 etc. certificates? No, these are not mandatory requirement of the applications however if the applicant firm have any of such license/ certificate, copy of the same may be submitted. 12. What type of test reports should be submitted along with the application? Copy of Type test certificate/ OEM test report etc. as per the requirement of the corresponding DGS&D Tender Enquiry should be submitted along with the application.
