The Constitution of the Associated Students of Seattle Central Community College Sanctioned by the ASC on April 22, 1999, voted in by the Associated Students April 29, 1999, approved by the Board of Trustees on June 4, 1999. Preamble We, the students of Seattle Central Community College, in order to organize as an efficient political body with the purpose of promoting the general welfare of the students, by defining and protecting their rights, by representing and acting in an official capacity for the student body, with a concern for providing students with opportunities for participation in programs and activities designed to promote intellectual, emotional, physical and social development, do hereby enact this Constitution of the Associated Students of Seattle Central Community College. Article I Name Section I This organization shall be known as the Associated Students of Seattle Central Community College, also known as AS-SCCC. Section II AS-SCCC is to be governed by the Associated Student Council of Seattle Central Community College. Article II Authority Section I The Associated Student Council shall have authority as granted by the Board of Trustees of the Seattle Community College District, to interpret, perform and execute the duties and responsibilities as referenced in the AS-SCCC Constitution and Bylaws. Section II The Associated Student Council is to be governed by its said Constitution and Bylaws. The Constitution is to serve as a model of how the Associated Student Council is set up, and the Bylaws are to dictate how the Council will operate. The Bylaws are to be subject to the Constitution, which in turn is subject to Seattle Community College District Policies and Procedures. Article III Membership Section I AS-SCCC membership shall be limited to individuals who are currently enrolled students at Seattle Central Community College. Section II To be eligible to become and serve as a Representative or Associate member of the Associated Student Council students must: A. Be currently enrolled for a minimum of 10 credits in Seattle Central Community College; B. Have completed at least 15 credits; C. Have achieved and maintain a 2.5 GPA. Section III The Associated Student Council provides equal opportunity to all and does not discriminate on the basis of race, color, religion, sexual orientation, gender, national origin, age, marital status or the presence of any physical, sensory, or mental disability. 1 Article IV Offices Section I The Associated Student Council is made up of six voting student members, known as Executive Members, who make up the Executive Council. The Associated Student Council also includes up to six nonvoting student members, known as Associate Members. Also included in the Council is one Representative from each satellite campus. The primary advisor of the Council is the Associate Dean of Student Leadership. The Council will also include a Faculty Representative and a Classified Staff Representative, both of whom, along with the Associate Dean of Student Leadership, are nonvoting, ex-officio members. A. The Executive Council members are as follows: Chief Executive, Executive of Administration, Executive of Finance, Executive of Legislative Affairs, Executive of Communications, and Executive of Issues and Concerns. B. Associate Members have no individual designated position. C. Satellite Representatives have no individual designated position. Section II Associated Student Council shall be selected by students as set forth in the Associated Student Council Bylaws. A. Any system of selection is open to revision only after two consecutive years of use. Section III Associated Student Council Executives serve one-year terms, with a maximum of two terms. Executive terms do not affect Associate Member eligibility. A term, also known as a Council Year, starts on the first day of fall quarter and ends on the last day of summer quarter. The Council only meets during fall, winter, and spring quarters but maintains jurisdiction through summer quarter and until the first day of fall quarter. A. Associated Student Council Executives receive a stipend each quarter, up to a maximum of three quarters per year. The amount of the stipend is reviewed yearly and set annually for the following year, by the Associated Student Council. Section IV The Executive Council will recruit and select, as set forth in the Bylaws, and as needed, up to six Associate Members. A. Associate Members of the Associated Student Council can be selected for one, two or three quarters, and can serve up to the end of the term with no maximum term limit. A term, also known as a Council Year, starts on the first day of fall quarter and ends on the first day of the following fall quarter. B. Associate Members of the Associated Student Council receive a stipend each quarter, up to a maximum of three quarters, per year. The amount of the stipend is reviewed yearly and set annually, for the following year, by the Associated Student Council. C. Service as an Associate Member does not limit eligibility for selection as an Associated Student Council Executive. Section V Satellite Campus Representatives are an option open to all satellite campuses, but not required. Section VI The President of the College appoints the Faculty and Classified Staff Representatives no later than May 31. A. Faculty and Classified Staff Representatives serve a minimum of two years with alternating terms. 2 Article V ASC Rights Section I All Executives of the Associated Student Council have the right to: A. Bring topics to meetings to be discussed; B. Debate any and all topics brought up at the Associated Student Council meetings; C. Motion; D. Second, Amend or Strike Motions; E. Vote on all Motions; F. Abstain from voting. Section II Duties of Satellite Representatives: A. Act as Liaison between Satellite Campus and Associated Student Council, B. Fulfill all obligations set by Satellite Campus. Section III All Satellite Representatives, if they have declared at the beginning of the term that they will attend all Council Meetings, and do so, have the rights to: A. Bring topics to meetings to be discussed; B. Debate any and all topics brought up at the Associated Student Council meetings; C. Motion; D. Second, Amend or Strike Motions; E. Vote on all Motions; F. Abstain from voting. Section IV All Associates of the Associated Student Council have the right to: A. Bring topics to meetings to be discussed; B. To debate any and all topics brought up at the Associated Student Council meetings; C. Vote in all ASC subcommittee meetings, if and only if, they are part of the committee. Article VI Constitutional Interpretation Section I The ASC reserves the right to interpret this Constitution and its Bylaws, unless an appeal on an interpretation is requested whereupon the interpretation shall be forwarded to the Judiciary Council, which will then process the appeal, as set forth in the Bylaws. Article VII Removal from Office Section I The grounds for removing Executives and Associates from office on the Associated Student Council are malfeasance or nonfeasance in office or violation of the Constitution and Bylaws of the Associated Student Council of Seattle Central Community College or any policy of Seattle Community College District. The Associated Student Council shall determine malfeasance or nonfeasance in each instance. Section II Student members of the Associated Student Council may be removed from their offices by two-thirds majority vote of the other voting members of the Council, provided that the motion for removal has been introduced at a regularly scheduled meeting and is voted on at a subsequent regularly scheduled meeting. 3 Section III Procedures for removal from office must provide for due process and right of review in accordance with Seattle Community College District Policies and Procedures: Student Conduct 375.60.1 and 375.20, Appeal/Referrals. An appeal process shall be described in the A. S. C. bylaws. Article VIII Recall Section I Any member of the Associated Student Council may be subject to recall upon the filling of a petition of a minimum of three percent (or no less than three hundred) of the currently enrolled student population at Seattle Central Community College. Article IX Amendments Section I This Constitution may be amended by referendum from the Associated Student Council in a special election submitted to the students provided that: A. Such referendum has been approved by two-thirds vote of all voting members of the Associated Student Council; B. Such referendum is made public to the Associated Student Body within at least five instructional days following its favorable adoption by the Associated Student Council; C. Such referendum is brought to an election after at least five instructional days of being made public to the Associated Student Body; D. Such referendum receives a simple majority of votes cast in said elections. Section II The AS-SCCC Bylaws may be amended by a two-thirds vote of the ASC, with approval of the Associate Dean of Student Leadership and the President of the College. If the amendment is passed by the ASC during the first five council meetings of the year it can be enacted immediately after the administrator’s approval. If such an amendment comes before the ASC at any other time it is then enacted at the beginning of the next Council Year. 4
