Smoke-Free Campuses Procedure (MPF1261) GOVERNING POLICY This procedure is made under the Smoke-Free and Tobacco-Free Campuses Policy. SCOPE This procedure applies to: all University-controlled buildings and property all University-owned or controlled vehicles. PROCEDURE 1. Smoke free campuses 1.1. Staff, students, contractors, honoraries and visitors are prohibited from smoking: in University-owned or controlled vehicles in University-controlled buildings on University-controlled property, except for those areas established as designated smoking areas 1.2. The Executive Director, Property and Campus Services will ensure the entrances to the University's campuses are adequately signed (taking into account the likely use of the entrance) with information about the University’s smoke-free status. 2. Designated smoking areas 2.1. The Executive Director, Property and Campus Services may establish designated smoking areas at each University campus. 2.2. The Executive Director, Property and Campus Services must take into account the following requirements when establishing designated smoking areas: a. minimum distance of 5 metres from any building entrance, operable window or air intake b. minimum distance of 10 metres from any dangerous goods storage or delivery area c. provision of reasonable protection for non-smokers from environmental tobacco smoke likely to emanate from the designated smoking area d. provision of reasonable access for smokers located on the campus e. provision of adequate signage f. provision of information about smoking cessation assistance programs. 3. Exemptions Page 1 of 3 3.1. The Executive Director, Property and Campus Services, or delegate, may approve written requests for temporary exemptions to this procedure after taking into account: a. compliance with the Tobacco Act 1987 (Vic) b. provision of reasonable protection for non-smokers from environmental tobacco smoke, and c. the need for the exemption. 4. University-owned property outside the control of the University 4.1. The person responsible for approving new leases, licenses and other permission to use University space must include provisions restricting the occupants of the space from smoking and/or selling tobacco products. 5. Standard contracts 5.1. General Counsel must ensure that standard agreements include reference to the SmokeFree and Tobacco-Free Campuses Policy. 6. Smoking cessation support 6.1. The Associate Director, Wellbeing Services must ensure smoking cessation information and resources are available to support staff and students. 7. Compliance 7.1. Students persistently breaching the Smoke-Free and Tobacco-Free Campuses Policy may be subject to action through student discipline procedures. 7.2. Staff persistently breaching the Smoke-Free and Tobacco-Free Campuses Policy may be subject to action through staff misconduct procedures. 7.3. Contractors persistently breaching the Smoke-Free and Tobacco-Free Campuses Policy may be asked to leave the campus or may be subject to a breach of contract. 7.4. Visitors continuing to breach the Smoke-Free and Tobacco-Free Campuses Policy after being warned not to, may be asked to leave the campus by campus security. Page 2 of 3 For the purposes of this procedure, smoking also refers to: University-controlled building University-controlled property workplace any method of consuming by combustion of plant material, herbs, or drugs using any utensil or apparatus including cigarettes, pipes or cigars e-cigarettes chewing tobacco. Note: This procedure does not authorise the smoking or consumption of any substance prohibited by law. A building under the control of the University by virtue of a freehold title, lease or rental agreement and includes points of entry, windows, bridges, stairways and air conditioning vents and ducts. Any property under the control of the University whether by freehold title or by lease or rental agreement and includes any portions of such property. A place, whether or not in a building or structure, where employees or selfemployed persons work. IMPLEMENTATION OFFICER The Director, OHS & Injury Management is responsible for the promulgation and implementation of this procedure in accordance with the scope outlined above.
