GENERAL CONDITONS OF HIRE
The reservation takes effect upon receipt of the duly completed and signed reservation
form (which shows the value of the hire contract) together with the 40% deposit. The
definitive registration only occurs after the full payment of the hire has been paid. Should
the dates of payment not be respected, then it would be considered as a termination of the
contract by the hirer. The balance of the rental is payable no later than 4 weeks before the
start of the cruise. Confirmation will be sent to the hirer upon receipt of reservation. The
total invoice will be established at the end of the cruise.
2. Suitability
The driver of the boat or « Captain » must be an adult. He/She is responsible for the
boat and equipment which has been entrusted to him/her, and also for his/her crew and
everyone on board. Should the driver be unfit to assume this responsibility, the boat hire
company reserves the right to offer a holiday tied up to the quayside or to limit the extent
of the cruise during some or all of the period, or to refuse to handover the boat altogether,
exclusively at the fault of the driver.
3. Cancellation Plan
The cancellation plan, amounting to 5% of the hire price, must be taken out at time of
booking, atleast 8 weeks prior to departure, and guarantees a refund of the amounts due to
CAMINAV in application of the "cancellation of reservation" section.
This plan is valid only in the case of cancellation before departure in the case of one of the
following events occurring subsequent to the date of reservation and which affects only
those members of the crew mentioned on the "reservation form": illness or serious
accident, death of the boat's driver him/herself, his/her spouse, ascendant or descendant
relatives/direct collateral, brothers and sisters, sons and daughters, serious damage to
his/her principle home.
Excluded are any events stemming from intentional acts, pregnancy, childbirth and its
consequences, normal diseases unconsolidated at the time of booking, accidents resulting
from the practice of any professional sport, drug addiction, alcoholism and the
consequences. Any cancellation must be in the form of a written statement addressed to
CAMINAV within 5 days of the event, along with all supporting documents, work
stoppage, death certificate, doctor’s prescription.
Administrative expense (150 €) and the cost of the plan are not refundable.
4. Cancellation of Resevation
- Notified by the hirer:
Regardless of the reason, if the hirer or the boat’s driver has not subscribed to the
Cancellation Plan, CAMINAV will invoice the following charges :
- More than 8 weeks prior to departure: 150 € file charges.
- Between 8 and 4 weeks prior to departure: 40% of the hire cost with a minimum of 150€.
- Less than 4 weeks prior to departure: 100% of the hire cost.
- Notified by CAMINAV:
If, as a result of unforeseeable and unavoidable circumstances which cannot be prevented,
the hire company is unable to place the boat hired at the disposal of the hirer or boat’s
driver, the hire company undertakes to use every means available to secure a replacement
boat, of comparable comfort and capacity to that initially reserved, for the hirer. Should
this prove impossible, the hire company will refund, without delay, the hirer or boat’s
driver, the amount paid for the hire of the boat, excluding any other type of compensation.
5. Insurance
The company declares that the boat is insured for accidental damage to the hull of the
vessel, or to others, because of the boat. Should any accident occur, the financial
responsibility of the boat's driver shall not exceed the amount of the damage deposit,
between 800 € to 1500€, except in the loss of rights or exclusions hereinafter mentioned
where the boat’s driver is responsible in full for all damages and claims. The driver and all
persons on board, along with their personal effects and their own third party liability, are
not covered by this insurance policy. The boat's driver and crew can take out individual
insurance for themselves and at their expense to cover these risks. Likewise, breakage or
loss of the boat's equipment, as well as a lack of care of the boat, are not covered by this
policy.
Exclusions :
Damage, loss, third party claims and expenses resulting from intentional or inexcusable
misconduct, willful disregard of navigation or safety rules, not taking into account weather
warnings, violation of navigation restrictions or stoppages, criminal use of the boat,
driving while intoxicated, under the influence of drugs or substances which affect
consciousness or the ability to respond, use of the boat for purposes other than its intended
purpose, exceeding the number of passengers permitted on board by the hire company,
navigation outside authorised areas, driving at night, false declarations, as well as any
malicious acts committed in collusion with any persons on board.
6. Damage Deposit or Damage Waiver.
Before boarding the boat the hirer must leave a damage deposit or opt for the damage
waiver to cover costs in case of damage to the boat, loss, theft or damage to the boat’s
equipment. The hirer can choose between:
a) Refundable Damage Deposit or b) Non-refundable damage waiver.
a) Refundable Damage deposit: The damage deposit is refunded at the end of the cruise if
the boat and all of its equipment are returned in good condition, at the agreed time and
place, if the boat has not been subject to or has caused any damage to third parties, and if
all amounts due, pertaining to the trip or services, have been paid. This deposit guarantees
payment for expenses resulting from: - accidental damage done to the boat, the boat
equipment or inventory, - breakage or loss of materials or equipment, poor maintenance of

the boat and its equipment or inventory during the trip, the abandonment or late return of
the boat.
b) Non-refundable damage waiver: Package option of between 110 € to 250 €. With this
package you are fully covered if the boat, its equipment or inventory are returned damage
or lost, as well as the cost of accidental damage or injury of third parties. This provision
applies only if the driver has not committed any intentional misconduct or if there is
evidence of gross neglect, breach in security, has complied with the rules of navigation
(especially in case of running the boat aground, damage to the superstructure and deck
fittings in a collision with a structure), has respected the information stipulated in the hire
company’s log-book, provided on departure from the base, pertaining to the cruise and
piloting of the boat. The package does not cover loss or theft of bicycles, chairs, outdoor
table and umbrella. This package is not available to groups (from two boats booked under
the same name).
7. Accident
The driver must report any accident to the hire company immediately, by telephone, who
will then advise which steps to follow. The driver may not have the boat repaired without
prior consent of the hire company. In addition, the driver must complete and sign an
accident report and obtain the signature of any third party and witnesses involved. The
driver, whether the cause or victim of the accident, can not claim any compensation if the
cruise is compromised. The driver remains, at all times and in all cases, personally and
fully responsible for the consequences of any accident arising from an exclusion stipulated
in the “Insurance” section, or for which the civil or criminal liability of a crew member is
sought after without pertaining to the boat or its equipment.
8. Embarkation
The boat is made available to the driver after completion of the following formalities:
payment of the damage deposit, signing of the hire contract, issuing of the ‘pleasure craft
card’ and verification of the inventory. The driver will receive all necessary information
for the cruise, as well as a cruising brief, before departing from the base.
The company reserves the right, for reasons beyond its control, (including flooding,
repairs to locks, closure of the canal, lockkeeper strike, drought, etc. etc.) to change the
port of embarkation or disembarkation, reverse the direction of a one-way cruise, change a
one-way cruise to a round trip or vice versa. All these may not be considered as grounds
for cancellation. The company will reimburse any extra charges paid in the case of special
cruise arrangements, except for changing the direction of a one-way cruise.
The boat will be handed to the hirer in a clean condition, in a good condition for
navigation, equipped and maintained in accordance to the laws and regulations issued by
the proper authorities of navigation. By signing the undertaking, the hirer acknowledges
that the boat is clean and in good working order, with the exception of latent defects.
9. Disembarkation
The boat must be returned to the designated port and vacated at the time specified on the
contract. The cleaning time and inventory check are part of the hire period. The company
reserves the right to charge an indemnity equal to twice the daily price of the hire contract
for an unreasonable delay or for the abandonment of the boat during the cruise by the
hirer. The hirer must return the boat and its equipment in the same condition as received.
If the boat is returned dirty, the company will charge for the additional hours spent
cleaning, between 25 € and 105 €.
10. Use of the boat by the boat’s driver
The hirer or boat’s driver agrees to use the boat prudently and in compliance with the rules
of waterways navigation; to comply with instructions given by the hire company and the
waterways authorities. The hirer undertakes to allow only the authorized number of people
on board and agrees to use the boat for recreational boating purposes only, in areas
authorized by the hire company. The hirer shall not engage in any commercial operations,
sub-hiring, lending the boat out or other. It is strictly prohibited to tow a boat, navigate
after dark and navigate in unauthorized maritime waters.
11. Non- navigable waterways / Navigation restrictions
CAMINAV cannot be held responsible or liable to pay compensation for any interruption
or limitation of the cruise planned for in the contract, resulting from closure of the
waterways for technical reasons or administrative police reasons, strikes, fuel blockade,
flood or drought and other adverse weather conditions, as well as for any other
circumstance beyond its control. Under these circumstances, CAMINAV can alter the
departure ports and dates of embarkation or disembarkation, on an equivalent boat or
larger. If these same events render the entire cruise impossible, the sums paid will be valid
for a future cruise by agreement between the parties. The hire company is not obliged to
provide a refund. Any temporary interruption of the cruise does not give right to a refund.
12. Breakdowns
In case of a breakdown or damage, technical assistance is provided by the company during
normal working hours, seven days a week, depending on the availability of personnel and
equipment. If the damage results from negligence of the hirer, the company reserves the
right of redress.
The loss of use resulting from damage incurred during the hire period, will not be
refunded, even partially, whatever the cause of the damage, unless it is not attributable to
the hirer. Even in this case, a 24 hour insurance waiver is applied.
In the event of litigation, the law applicable to this contract is French law, only the French
version of conditions of hire is valid, and is in the jurisdiction of the court of Montpellier.
