Sample Agreement with County
for Fire Service Within a Prescribed Area
Outside a Municipality’s Corporate Limits
Pursuant to T.C.A. Section 6-54-601
THIS AGREEMENT made as of the ______ day of __________, 20___, by and between
the (City) (Town) of _________-, Tennessee, and the County of _____________, Tennessee.
Pursuant to Tennessee Code Annotated, Section 6-54-601 and the mutual covenants
contained herein, the parties agree as follows:
1.
The (City) (Town) of _______________ may provide fire protection to properties located
outside the municipality but within a ____ mile radius of the (fire station), (courthouse),
(city hall), (etc). (Some other determination of area may be used).
2.
The fire department of the (City) (Town) of ___________ may answer any fire calls to
the area defined in paragraph 1 and will, to the best of its ability, respond with suitable
fire fighting apparatus and equipment, consisting of at least the following __________,
accompanied by at least ______members of the fire department, who will render all
assistance possible in the saving of life and property.
3.
The failure to furnish the service agreed upon because of weather, road conditions, the
unavailability of equipment or personnel in connection with the fighting of other fires, or
for any other good reason shall not be taken as a breach of this agreement. The decision
of the Chief of the Fire Department or other fire department officer in charge not to
respond to a County fire call, or to return to a (City) (Town)_________because of an
emergency within the city limits of the (City) (Town) shall be final.
4.
The County agrees not to make a claim against the (City) (Town) of
____________________ for loss or damage of any kind whatever resulting from any
failure to prevent or extinguish any fire, whether the loss or damage is cause by
negligence of the officers, agents, or employees of the city of its fire department, or
otherwise.
5.
The (City) (Town) will make no claim against the County on account of damage to the
property of the (City) (Town) while in the fire service of the County and will carry
Workers insurance protecting itself against personal injury damage claims of its fire
fighters for personal injuries sustained while providing service in the County. The (City)
(Town) will protect itself against claims resulting from the negligent acts of the fire
fighters in the employ of the (City) (Town), in compliance with those amounts of liability
established in Tennessee Code Annotated, Section 29-20-101, et seq.
6.
The County shall compensate the municipality for rural fire protection service as follows:

PAYING FOR RURAL FIRE PROTECTION, AND SEVERAL FACTORS SHOULD
BE CONSIDERED. CONTACT A MANAGEMENT CONSULTANT FOR
ASSISTANCE IN THIS AREA.)
7.
This Agreement shall automatically renew for successive terms of one fiscal year.
