DUTY CARE AND NEGLIGIENCE IN TEACHING
According to the week three lecture, duty care are what we owe each other. What
teacher owe students, parents, schools, but in most cases the teacher are at centre.
It means we should not do anything that would imperil or harm something else. It
involves pupil teacher relationship, is the teacher exercising authority and control
over students? The duty care of teacher according to the materials in this course is
seen over and above that which a normal parent would experience over the child.
The following are conditions for duty care
1. The teacher must be accountable for students in their class, this means the
teacher owes each student duty care of knowing what is going on with them,
their academic and so on.
2. The teacher reserves the right to know and they learn , this will enable the
teacher to use appropriate pedagogy in order to improve on their learning
3. The teacher must give meaningful feedback of their learning, this will make
the learners to know what they are doing well or not and heat to do more.
4. The should not impose punishment on students , this one can lead to the
breaches of duty care in as much as the students didn’t see it as a punitive
case and the corporal punishment but forbidden in education
5. The student should see the students as a role model in the class, the teacher
should lead by examples through which the students can pick good behavior.
6. The teacher must play the role of parent just as said in one of the lecture that
the teacher play the role of parents in the school to create a very relax and
safe environment for them .
7. The teacher must give each students each opportunity to say or express
themselves irrespective of their religion, culture, ethnicity gender, politics,
background etc.
NEGLIGINCE
It is considered a civil wrong or action against individual or individuals
through which damages can be sought in civil court according to the course
material. There is no criminal sentences or imprisonment involved except if
it involves assault which is physical beating of the learners. By civil law we
mean where individual, corporations or state bring an action against
activities of individual or state. The main of it is monetary payment or
damages.
The following are the test of negligence according to the lecture
1. The duty care exists, there is duty care between teacher and students.
2. There was a break of duty care , teacher did not act reasonably and as
expected from the unusual behavior
3. The injury or damages results, if no case of injury, no negligence if there
is negligence has succeeded.
WAYS IN WHICH NEGLIGIENCY OCCURS
It occurs by;
1. Not adhering to safety use of equipment in the class.
2. Teacher feeling larger by students
3. Teacher going beyond qualification training e.g. a mathematics teacher
leading sport team.
4. Not monitoring pupils at the play group or schools
5. Teaching leaving the class without informing the next teacher to him or her
6. Teacher leaving the class on a regular basis to by something.
7. Teacher not complaining of additional task that can reduce his efficiency
which can lead to negligence
IMPLICATIONS OF NEGLIGINCY IN THE SCHOOL
1. It can lead to injury of the students.
2. It can results in bullying environment
3. It can lead to poor academic performance
4. It can lower the self-esteem of the students if not properly managed by
the teacher.
