WAIVER AND RELEASE FROM LIABILITY I, the undersigned, wish to participate in and attend one (1) or more sessions of Camp Beezy (collectively with any and all ancillary activities, the “Event”). I understand that participation in the Event is strictly voluntary, that there are certain dangers inherent in the activities held at and/or during the Event and that it is possible that accident, property damage or loss, and/or personal injury could occur while I am attending and/or participating in the Event. I have full knowledge of the risks involved in attending and/or participating in the Event and verify that I am physically able to participate. In consideration of the opportunity to participate, I, together with my heirs, successors and assigns, hereby expressly release and discharge the Event, the owners of the Event, Cam Bynum, the Event volunteers, the Event coaches, the Event sponsors, the Event promoters, the Event site location on whose premises the Event will occur, and all of their respective officers, directors, employees, agents, affiliates, stockholders, trustees, partners, physicians, contractors, subsidiaries, insurers, parent entities, affiliates, and consultants (collectively, the “Released Parties”) from any liability whatsoever for any claims or causes of action I may now or in the future have for damages for property, personal, or bodily injury, including illness, death, and/or loss or damage to property belonging to me or others, arising out of or in any way connected with my attendance and/or participation in the Event (collectively, “Damages”). This Waiver and Release shall include, but not be limited to, liability caused by the negligence, recklessness and/or willful acts and/or omissions of any of the Released Parties. In addition, I hereby grant to the Released Parties, in perpetuity, the rights to use my name, likeness, photograph, statements, endorsement, caricature, biographical information, nickname, and the like, in any manner whatsoever in connection with my participation in the Event. I agree that I shall have no approval rights whatsoever in connection with such use by the Released Parties. I authorize and permit the Event (including its agents, employees, contractors, and Event personnel) to administer first aid to the Participant, and to authorize such other medical treatment and transportation as may be recommended by physicians, and other medical personnel, in the event of any illness, accident or injury to the Participant (and to release and hold harmless each of the Released Parties including any and all medical, training, or similar staff) in connection thereto. KNOWING THE RISKS OF PARTICIPATING IN AND ATTENDING THE EVENT, I HEREBY AGREE TO ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ANY DAMAGES THAT MAY ARISE OUT OF MY ATTENDANCE OF THE EVENT. I AGREE (INCLUDING MY HEIRS AND ESTATE) NOT TO SUE ANY OF THE RELEASED PARTIES FOR ANY DAMAGES THAT I HAVE WAIVED, RELEASED AND DISCHARGED HEREIN. THIS WAIVER AND RELEASE SHALL BE GOVERENED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS IN THE PHILIPPINES, ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THIS WAIVER AND RELEASE, THE SUBJECT MATTER HEREOF, OR ANY BREACH HEREOF, SHALL BE SUBMITTED TO AND FINALLY SETTLED BY ARBITRATION WHICH SHALL BE CONDUCTED BY THE PHILLIPINE INTERNATIONAL CENTER FOR CONFLICT RESOLUTION. The undersigned warrants that: (a) the Participant is physically fit to participate in the Event; and (b) the undersigned will not allow the Participant to participate in the Event if the undersigned has any concerns about the Participant's overall health, fitness, or medical condition. The undersigned further acknowledges and understands that the undersigned will be responsible for any and all medical and related bills that may be incurred for any illness or injury. I am the parent/legal guardian of Participant.
