The petitioner named above begs to submit as under:1.
That,
the
present
petition
is
directed
against
the
communication impugned dated 26/04/2021, whereby the
petitioner,
who
Superintendent
holds
in
the
post
of
Government
Assistant
Workshop
Polytechnic
College,
Ashoknagar, is sought to be retired from service on attaining
the age of 62 years whereas, the age: of superannuation ‘of
‘teachers’ serving in the colleges under Technical Education
Department has been prescribed to be 65 years.
That, the respondent State has filed a cursory return without
touching to the legal and factual aspect of the matter, though
it is made parawise. The claim of the petitioner has been
opposed on the sole ground that the post of Assistant
Workshop Superintendent does fall within the purview of
‘teacher’ and it is mentioned as ‘a Class-II post in
the
recruitment rules. It is further contended that in the AICTE
Regulations notified in the year 2010 and 2019 do not include
the
post
of
Assistant
Workshop
Superintendent
for
the
‘purpose of Career Advancement Scheme.
That,
the
respondents
have
made
all: such
contentions
oblivious to the undisputed facts that there is
hardly any
difference between the post of Workshop Superint
endent and
Assistant Workshop Superintendent, as far
as the nature of
duties are concerned. There is no rebuttal to
the syllabus with
Norms and Standards for Polytechnic (Dip
loma Programs)

issued by the AICTE in the year 1989, copy of which is placed
on record in the petition at annexure-P/10, wherein, the ‘job
description’ of both the posts includes ‘guide the students in
the performance of practical tasks and skill exercises and to
evaluate their performance’. Ample material has been placed
on record to demonstrate that the post of Assistant Workshop
Superintendent is throughout engaged’ in the classroom and
work-shop teaching in the faculty of Mechanical Engineering,
to which no justifiable rebuttal has been offered in the return.
Yet
another order engaging
the
petitioner
in
classroom
teaching by the Principal of the College dated 20/10/1987 is
filed herewith as Annexure-RJ/1.
That, it is submitted that the AICTE has time and again has
expressed and communicated to the State Government that
the
post
of
Assistant
Workshop
Superintendent/Foreman
Instructor in the engineering and Polytechnic colleges is a
teaching post at par with the post of Lecturer, firstly in the
initial regulations/norms of 1989 then followed by the
clarification dated 22/02/2008 and 07/04/2009, annexure-P/5
& P/6, respectively. Copy of the AICTE Regulations/norms of
1989 is filed herewith as Annexure-RJ/2.
That, the respondents have impressed upon the fact that post
of Assistant Workshop Superintendent ‘is a
Class-II post,
whereas, the post of Workshop Superintendent and
Lecturer
are Class-I post in the Recruitment Rules of 2004. Such
a
contention has no legs to stand to address the contr
oversy
involved in the petition, particularly in view of the expre
ssion
by the Full Bench in the case of Yugal Kishore
Sharma
(supra) that the nomenclature of a post in the recrui
tment
rules is not the decisive factor to determine the natur
e of duty
~as to whether such a post is a teaching post or
‘by whatever designation called’, placed in the
not. The term
main provision
of amended Adhivarshki Aayu Adhiniyam is suffic
ient to
convey the legislative intent. It is highly
misconceived to
=
a
disown
the
Full
Bench judgment
in
the
return
without
conceiving the issue involved in the petition.
That, the return is also silent on the legal proposition that the
age of superannuation with regardtoall faculty members of
the Polytechnic Colleges has been enhanced to 65 years in A//
India
Council for Technical Education Pay Scales,
Service
Conditions and Minimum Qualifications for the Appointment of
Teachers and other Academic Staff such as Library and
Physical Education Personnel in Technical Institutions and
Measures for the Maintenance of Standards in
Technical
Education - (Diploma) Regulation, 2019, which arein force at
present.
Even
appreciated
if,
the
contention
that
the
post
of the
of
respondents
Assistant
is
Workshop
Superintendent was not expressly included in the Regulations
of 2010, then in the Regulations of 2019 all the designations
of teaching posts are omitted for the purpose of the age of
superannuation
under
Regulation
2.9
and
the
age
of
superannuation of 65 years has been made applicable to ‘all
Faculty Members’. Copy of the Regulations of 2019 is filed
herewith as Annexure-RJ/3.
That, there is also no specific reply to the legal proposition the
AICTE Act,
1987 which
came
in
force w.e.f.
28/03/1998
enacted by the Parliament occupies the field. It is submitted
that this is an enactment by the Parliament within the scope of
legislation mentioned in Entry-66 of List-I (Union List) read
with Entry-25 of List-IIJ (Concurrent list) of Seventh Schedule
of the Constitution. It is only the Council constituted under the
Act which is authorized to lay down norms and standards for
courses,
curricula,
qualifications,
instructional
quality
facilities,
instructions,
staff
pattern,
assessment
and
examinations under sub section (1)(i) of Section 10. Council
is
also competent to lay down the norms and standards other
than prescribed under sub section (1)(i) under sub section
(1)(v) thereof. ©

That, the Council is empowered to make regulations in the
manner prescribed under Section 23 to carry out the purposes
of
the
Act.
Exercising these
powers,
formulated the Regulations of 2019,
the
Council
has
laying down various
conditions of service for.the Teachers and other Academic
Staff in Technical Institutions imparting
Diploma courses,
including age of superannuation. By the application of Article
254
(2) of the Constitution, the field
related to service
conditions of the Teachers and other Academic Staff serving in
the Polytechnic Colleges of the State was no longer governed
by any State Legislation on and after 22/01/2010 as well as
01/03/2019 in respect of all the Faculty Members.
That, the respondents are oblivious to the fact in the return

Department
by the AICTE,

comparatively much involved in administrative functions, but
still it has not been excluded from the impugned ‘explanation’.
10. That, the respondents have referred to the respective AICTE
Regulations in order to assert that the posts mentioned
therein are eligible for getting the benefit of CAS, to whom
the
enhanced age of superannuation is applicable, whereas,
the
incumbents
holding
the
posts “of
Assistant
Workshop
Superintendent have also been extended the benefit of CAS.
The petitioner has been extended the benefit of CAS from
time
to time through his service career and in receipt of
AICTE
Scale of Rs.37,400 - 67,000 + 9000 GP w.e.f. 01/01/2006,
which is the scale at par with the post of Lecturer (Sele
Grade).

11. That, it is pertinent to mention here that during pendency of
the writ petition,
the respondent
No.1
has
rejected the
representation of the petitioner on the claim of enhanced age
of superannuation vide order dated 09/05/2022. The only
reason assigned in the rejection order that if the claim of the
petitioner is accepted then all the incumbents holding such
posts will claim the same benefit. However, the fact establish
by the petitioner with the documentary evidence showing
involvement of classroom teaching has not been discarded in
the order. Thus, all the contentions raised in the return are
nothing but the afterthoughts having no nexus with the actual
reason, as expressed in the rejection order, deny the just and
valid
claim
of the
petitioner.

12. That, all the other averments or allegations against the claim
of the petitioner are hereby denied, if not so specifically
denied hereinabove.
. That, is view of submissions made hereinabove and in
