For that reason, she made a down payment of PHP 17,0000 for your catering services. However, on 12 March 2020, the President of the Philippines declared a travel ban, to and from Metro Manila. As a result, the celebrator herself, and her friends would not be able to go to Cavite. Necessarily, she had to cancel her birthday celebration. Cancelling that gathering is likewise a cautionary step to prevent the further spread of the COVID-19 virus. However, my client informed me that you do not wish to honor her intentions. Instead, you wish to keep her PHP 17,000 for the reason that “Cavite is not part of it.” Your posture is against the National Government’s drive to enforce social distancing. Even if Cavite is outside Metro Manila, three reasons weigh against your retention of my client’s hard earned money: (1) she can cancel her event as no one from her friends and family in Metro Manila, including her, would be able to attend her catered party; (2) she could not hold a party for that would be irresponsible given the present health scare; and (3) COVID-19, its widespread effects, and the Government’s Community Quarantine measure, are all unforeseen events which would negate your withholding of the PHP 17,000 down payment. Truth be told, your posture would also be against the policy of the Department of Trade and Industry, which protects the rights of consumers. So as to prevent any untoward conflict at this time, please amicably settle this issue by returning to my client the PHP 17,000 down payment. Otherwise, your failure to pay the aforesaid amount will definitely lead my client to file the necessary criminal and civil actions in court to enforce her rights. She will likewise ask for moral and exemplary damages to compensate for the stress and anxiety you have personally caused her. Furthermore, recourse to any legal action will make you liable for attorney’s fees, costs of suit, as well as legal interests and sheriff’s fees in the event of levy of property, garnishment of funds, or closure of any business needed to satisfy a judgment award.
