CONSTITUTION AND BY LAWS
PREAMBLE
We, the member of the Tupi South District Teachers Association, dedicated to the pursuit of
our social, economic, as well as professional advancement, committed to the promotion of the public
good and development of a closer bond with the Tupi South District Teachers and Retirees whom we
have sworn to serve, and conscious of our inalienable fundamental rights inherent to us, civil servants
and citizens of the country, and furthermore in our development towards the attainment of the
aforementioned aspirations and ideals, with the aid of the Almighty God, do hereby promulgate this
Constitution.
ARTICLE I:
NAME, DOMICILE and LOGO
Section 1. The association shall be known as the TUPI SOUTH DISTRICT TEACHERS
ASSOCIATION (TSDTA)
Section 2. The domicile and office of the association shall be in Polonuling Central Elementary
School , Tupi South District, Polonuling, Tupi South Cotabato.

ARTICLE II:
OBJECTIVES
Section 1. The ASSOCIATION commits itself to the pursuant of the following objectives:
1.1. To establish an organization that will represent the teachers of Tupi South District;
1.2. To promote the moral, social, and economic well being of all the members;
1.3. To protect and uphold the individual rights of all members;
1.4. To foster harmonious and progressive teacher-management relation;
1.5. To strive for the adoption of legislation, policies and other measures that will promote the
economic, social and general well being of all the members in particular, and the working class,
in general;
1.6. To promote the enlightenment of all the members in regard to their rights and obligations
as ASSOCIATION members and as employees, and all other matters that directly or indirectly
affect the ASSOCIATION.
ARTICLE III
NAME OF THE EMPLOYER AND PLACE OF OPERATION
Section 1. The definite employer is the Department of Education, Tupi, South District hereinafter
referred to as the agency, the Principal place of operation of which is in Polonuling, Tupi, South
Cotabato.
ARTICLE IV:
MEMBERSHIP
Section 1. Permanent teachers within the District who are active in the service are automatically
members of the association.
Section 2. All members shall accomplish the membership form as basis of their membership in the
Association duly signed by the President and the Secretary.
Section 3. All qualified members shall pay the membership fee of P100.00 and P20.00 monthly due.
Section 4. Foregoing members’ membership shall be forfeit automatically upon their transfer of
designation/assignment outside the district.
Section 5. Retired teacher shall no longer be members of the Association after the date of his/her
retirement for the disqualification of her/his membership stated in Article 4 Section 1.
ARTICLE V
ORGANIZATION
Section 1. The structure and composition of the Association:
1.1. General Assembly (GA)
a. The General Assembly is the highest decision-making body;
b. The General Assembly is composed of all the official members of the Association.
1.2. The Executive Board ( EB )
a. Shall administer Association affairs, formulate policies, and implement programs to
effectively carry out the objectives of the Association.
1.3. The Executive Board shall consist of officers hereafter:
President;
Vice President;
Secretary;
Associate Secretary;
Treasurer;
Associate Treasurer;
Auditor;
Public Information Officer;
Business Managers;
Sergeant at Arms
1.4. Board of Directors (BODs)
a. The Board of Directors is the highest policy making-body;
b. The President of each School Teachers Association shall be automatically a
member of the Board of Directors;
c. The Board of Directors duly represented by (1) from the Administrators, two (2) from
Central School one (1) from Non-Central School and the EB who are still elected until
he/she finished their consecutive terms of office:
d. The Board of Directors shall represent their school and in aide in planning the
activities of the Association;
e. The Board of Directors shall be in-charge of the legislative functions of the
Association under the guidelines to be issued by the Executive Board.
ARTICLE VI:
OFFICERS
Section 1. There shall be a set of officers for elementary teachers in the District level.
Section 2. The Association shall have the President, Vice President, Secretary, Asst. Secretary,
Treasurer, Asst. Treasurer, Auditor, PIO and Two (2) Business Managers, Sergeant at Arms
Section 3. All non-elected members in Major positions will be the Board of Directors.
ARTICLE VII:
DUTIES AND FUNCTION OF OFFICERS
Section 1. The President shall:
a. Be the head of the Association;
b. Preside all meetings and deliberations of the Executive Board of general membership;
c. Represent the Association in the public occasions of vital interests to the association, and
in case of emergency of any member or such matter of urgency vital to the interests of the
Association;
d. Appoint a temporary Officer in case of vacancy and call for a special election to fill in any
vacant position;
e. Call special meeting of the Association;
f. Perform duties prescribed by the board;
g. Be one of the major signatories in the bank account of the Association;
h. Be a member of Municipal School Board.
Section 2. The Vice President shall:
a. Assume the position and functions of the President in case of his/her absence, disability,
death, resignation, transfer into other district or designation;
b. Act as the Property Custodian of the Association.
Section 3. The Secretary shall:

Keep all the records of the Association;
Take down minutes during meetings and General Assemblies;
Call the roll of the members and read the Minutes of the previous meeting;
Provide copies of all approved Minutes to the Executive Board and Board of Directors;
Prepare written and online communication among members.
Section 4. The Assistant Secretary Shall:
a. Assume the position and function of the secretary in his/her absence, disability, death,
resignation or transfer;
b. Perform functions that may be assigned to him/her by the President.
Section 5. The Treasurer shall:
a. Collect all funds and fees of the Association and record them in the Book of Account with
receipts;
b. Prepare and present audited financial report every BOD meeting and Assembly meetings;
c. Be one of the major signatories of the bank account of the Association;
d. Endorse all records and remaining financial collections to the new elected treasurer;
e. Authorized to withdraw any account approved and duly signed by the President.
Section 6. The Assistant Treasurer shall:
a. Assume the position and function of the Treasurer in his/her absence, disability, death,
resignation or transfer;
b. Perform functions that may be assigned to him/her by the Treasurer or the President.
Section 7. The Auditor shall:
a. The Auditor shall audit, verify and examine all financial accounts of the Association;
b. He shall supervise the entries in the Book of Accounts of the Association and shall render
report of his audit as may be required by the Executive Board or by resolution of majority
c. Conduct the audit of the Book of Account of the Association;
d. Perform other function as may be provided by the Executive Board.
Section 8. The Public Information Officers (PIO) shall:
a. The Public Information Officers (PIO) shall be in charge of matters involving public
relations and information of the Association;
b. Disseminate information to all members of the Association;
c. With the approval of the Executive Board, he may establish an official publication of the
Association.
Section 9. The Business Managers shall:
a. Take charge all of the business transactions and in behalf of the Association.
Section 10. The Sergeant at Arms shall:
a. Secure the peace and order during all meeting of the Association;
b. Ensure that safety protocols every meeting, within the members of the Association are
strictly followed;
c. Perform other functions as may be provided by the Executive Board.
ARTICLE VIII
TERMS OF OFFICE
Section 1. All elected Officers and Board of Director of the Association shall serve for two (2) years
and shall be eligible to serve for two (3) consecutive terms.
ARTICLE IX
MEETINGS
Section 1. The Executive Board and the Board of Directors shall hold its regular Association Board
Meeting every first Friday of every quarter.
Section 2. Appropriate notice shall be sent out by the Secretary to each member of the Board at least
(3) working days prior to such meeting.
Section 3. Special meetings shall be held as may be needed.
Section 4. The Executive Board and the Board of Directors shall conduct regular Association General
Assembly Meeting once a year.
Section 5. Any member of the Board with three consecutive absences from any regular or special
meeting without justifiable grounds therefore, may be expelled or suspended from the Association by
a vote of the majority of the Board.
ARTICLE X
ELECTION
Section 1. The election of the new set of officers shall be conducted every two (2) years on the first
Friday of the year end or the beginning of the fiscal year.
Section 2. The outgoing officers shall facilitate the conduct of the election of the new set of officers
through secret balloting and/or upon the approval of the quorum.
Section 3. The set of Association officers shall be elected from the composition of officers stated in
Section 2 of Article VI.
Section 4. Qualified candidate for the elective position in the Association must be a member of the
Association Board (Executive Board, Board of Directors).
ARTICLE XI
IMPEACHMENT
Section 1. Any Officer of the Association found guilty of any crime, felony or misdemeanor by any
Court of Law shall be removed from office.
Section 2. Any Officer found incapable of discharging his duties as evidence by lack of interest shall
be removed from office by two-thirds (2/3) vote of the Officers and the Board of Director of the
Association.
ARTICLE XII
VACANCY OF OFFICE
Section 1. In case of the vacancy of the Office of the President, the Vice-President will assume.
Section 2. In case of vacancy of the Office of the Vice-President, Secretary, Asst. Secretary, Treasurer,
Asst. Treasurer, Auditor, PIO, Business Manager, Sgt. at Arm, the President shall appoint a temporary
Officer for any vacant office until a new officer is elected from the members of the Board of Directors
in the Association.
Section 3. Special elections for the purpose of filling up the vacancy of any position shall be called
by the President of the Association as stated in the Article VI Sec. 1.
ARTICLE XIII
QUORUM
Section 1. A majority of the members of the Association shall constitute a quorum.
Section 2. A total of two-thirds (2/3) of the members constitute the quorum.
ARTICLE XIV
TEACHERS’ WELFARE/BENEFITS
Section 1. There shall be a Mutual Aid System (MAS) wherein all members of the Association shall
be legible to Hospitalization and Death Aid and retirement benefits as per stated in Sec.4,5 and 6 of
this Article
Section 2. No other fees except those duly recognized and approved by the Association shall be
collected or imposed without the approval of at least two-third (2/3) of the members present.
Section 3. Every member is entitled of the benefits upon the approval of his/her membership by the
President.
Section 4. Death Aid Benefit:
a. In case of death of any bonafide member, the legal family shall receive in cash amounting
to P 15,000.00 from the Association.
b. In case of death of any immediate family of the bonafide member (Spouse, Children,
Father/Mother) shall receive in cash from the Association amounting to P 6,000.00.
Section 5. Hospitalization Benefit:
a. In case of hospitalization of any bonafide member, he/she shall receive in cash
amounting to P 3,000.00 assistance from the Association once a year.
Section 6. Retirement Benefit:
a. In case or retirement of a bonafide member, he/she shall be granted a cash incentive
amounting to P10,000.00;
b. The said incentive shall be collected from all the members amounting to P100.00
individually before the date of his/her retirement.:
c. The retiree will receive the cash incentive after the date of his/her retirement.

ARTICLE XV
POLICIES AND GUIDELINES OF THE DEATH AID & HOSPITALIZATION BENEFITS
Section 1. Every member must pay the amount of P500.00 for the first year after the date of approval
by the GA as starting Death Aid and Hospitalization Fund.
Section 2. Bonafide Member should pay the amount of P500.00 in full or in installment basis (Three
gives only) within the first quarter of the fiscal year.
Section 3. New member must also pay P 500.00 to be intitled to benefit in Article XIV Section 4 and
Section 5
Section 4. The payment for death aid and hospitalization in the succeeding year depends on the
expenditures within a year and shall be divided into all the members in the association.
Section 5. Members who failed to pay the said amount in the Article XV section 1 are not intitled to
the benefit in Article XIV Section 4 and Section 5.
Section 6. The Association Treasurer shall collect, every first quarter of the year, the amount
approved in Article XV, Sec.1.
Section 7. The Association Treasurer shall release the approved amount in the article XIV Section 4
and Section 5 to the entitled members/beneficiaries of the Association immediately.
Section 8. The beneficiary or beneficiaries shall submit a photo copy of Death Certificates or Hospital
bills and accomplish the voucher for record purposes.
ARTICLE XVI
AMENDMENTS
Section 1. The Constitution and By-Laws shall be amended upon proposition by any member of the
Association Executive Board and Board of Directors and be approved by at least two-thirds (2/3) of
the members.
ARTICLE XVII
EFFECTIVITY
Section 1. The Constitution and By-Laws shall be enforced upon approval of simple majority (50%+1)
of the General Assembly.
