The parking violation has led to a decrease in production and morale in the workplace. We wish to resolve this conflict by signing a contract that would help us clarify the correct parking and timeframe for the vehicles in question. The main disagreement is that the co-worker has assumed that the parking space was reserved for him while I believe that the parking spot is reserved for whoever arrives first. The difference in opinion and lack of clarity of who deserves the parking space is causing unnecessary stress in the workplace. This would benefit both the co-worker and me by having clear boundaries on who is allowed to use that particular parking space. This would also increase general morale by reducing the friction that we have with each other. I am excited to have management be involved in this issue and have clarity on this problem. The Parties. This contract dated 21 of February 2021 by and between Zhida Tai and Sam Cook for a parking space located at #3 North West Plaza outside XYZ Manufacturing. 2. The Terms. Sam Cook will get the parking spot every 1st and 3rd week of the month. While Zhida Tai will get the parking spot every 2nd and 4th week of the month. 3. This will be re-evaluated on a yearly basis. Termination will be decided by management, with a minimum of the 30-day notice. 4. Failure to follow the contract. In case of failure to follow this contract, the offending party will be required to move their car from parking space #3. 5. Substitution clause. If both parties agree the parking spot can be taken by either party with prior written notice. 6. Restrictions. The consideration is a rotation of the parking spot. With management’s agreement, we are also stating that we are both contractually capable to sign. With the purpose of this contract to enforce parking restrictions and limitations, it is a legal contract. This contract would be considered a bilateral contract with a “promise for a promise”. The most common type of bilateral contracts are business contracts, in this case, we would be exchanging parking spots on a weekly basis (“Bilateral Contract”, 2020). This would be an enforceable contract since both parties have agreed to it and there is no legal defense against not parking in spot #3. The decision for management to make the two conflicting co-workers work out a contract could be seen as giving the employees a voice.
