Facts:
On October 31, 1998, Feliber Andres, a pregnant woman was tragically murdered on a day set
aside to remember the deceased, because of her husband's argument with the accused-appellant,
Incencio Gonzales Jr., and his son in the Garden of Remembrance at Loyola Memorial Park in
Marikina.
Issues:
Whether the accused-appellant Gonzales Jr. is guilty of murder, frustrated murder, and attempted
murder based on the circumstances of the shooting.
Ruling:
The trial court found the accused guilty of the complex crime of murder with double frustrated
murder and attempted murder. Gonzales Jr. was sentenced to death by lethal injection and ordered
to pay various civil liabilities to the victims' families. The court ruled that treachery was present in
the shooting, qualifying it as murder.
