The History Battalion Statutes Written 16th July, 2023. Definitions. Owner - The owner of the History Battalion discord server. (The) server - The History Battalion discord server. ARTICLE I. - ALL PERSONS SUBJECT TO REGULATIONS (1) All persons within the server are subject to the statutes as defined in this document, and no position of power shall reduce or abrogate an individual’s responsibility to follow the regulations as defined in this document. ARTICLE II. - ENFORCEMENT OF REGULATIONS (1) Moderators and Administrators, as appointed by the owner, are solely responsible for identifying violations of the regulations as defined in this document, and as a result the enforcement and interpretation thereof. (2) Moderators and Administrators, as appointed by the owner, have the power to define violations of the regulations within this document at their discretion, if the purported violation is not explicitly defined. ARTICLE III. - ALL PERSONS OBLIGATED TO RECOGNIZE REGULATIONS (1) All persons shall be obligated to recognize and agree to these regulations on the date of it coming into effect or upon entering the server, for those in the server on the date on which this document takes effect, or those entering the server thereafter, respectively. Without such a recognition and agreement, members will not be permitted to act within the server at the capacity as afforded to ordinary members, as defined by the owner. ARTICLE IV. - OFFENCES AGAINST THE PERSON (1) Every person who, with intent to harm, provoke, or offend, uses profane language or insults against another person under any circumstances is guilty of an offence and is liable to various sentences as determined by precedent; once being a 12 hour mute, twice being 24 hours, thrice being 48 hours, four times being 5 days, and five times being a week(7 days)-long ban. (2) Every person who, with malicious intent, intimidates or threatens another person with death, harm, disclosure of information, or any other detrimental action, under any circumstances is guilty of an offence and is liable to various sentences as determined by precedent; once being a 3 day mute, twice being 7 days, and thrice being a permanent ban. (3) Every person who, under any circumstances and without permission, discloses information from another person who has not previously done the same in this server is guilty of an offence and is liable to a permanent ban. ARTICLE V. - OFFENCES RELATING TO SPEECH (1) Every person who, for any purpose, “spams”, or by definition of the word, sends many messages in quick succession in a channel, as to interrupt the activity within the channel or to cause disruptions, under any circumstances is guilty of an offence and is liable to various sentences as determined by precedent; once being a 12 hour mute, twice being 24 hours, thrice being 48 hours, four times being 5 days, and five times being a week(7 days)-long ban. (2) Every person who, regardless of intent, sends any content or media containing gore, violence, pornography, or any otherwise inappropriate material under any circumstances is guilty of an offence and is liable to a permanent ban. (a) No person commits an offence under (2) if the content posted is a primary historical source intended for educational or informational purposes, and is censored through the “spoiler” function and captioned as displaying such types of material. (3) Every person who, regardless of intent, causes destruction to the server in any way, including but not limited to deleting or rendering channels unusable and/or removing members without a statutory reason, under any circumstances is guilty of an offence and is liable to a permanent ban. (a) Every person who, in any way, directly aids or abets the person(s) responsible for any acts as defined in (3), under any circumstances is guilty of an offence and is liable to a permanent ban. (4) Every person who, regardless of intent, promotes, advertises, or publicises anything including but not limited to groups, content, brands, and companies, under any circumstances is guilty of an offence and is liable to various sentences according to precedent; once being a 3 hour mute, twice being 12 hours, thrice being 24 hours, four times being 3 days, and five times being a week(7 days)-long ban. (a) No person commits an offence under (4) if the promoted, advertised, or publicised content or such is intended for educational or historical purposes. (5) Every person who, regardless of intent, uses a channel for purposes not intended for it as defined by the name of the channel, under any circumstances is guilty of an offence and is liable to various sentences according to precedent; once being a written warning, twice being a 10 minute mute, thrice being 30 minutes, four times being 2 hours, and five times being 4 hours. (6) Every person who, regardless of intent, sends messages and/or content in any other language than English under any circumstances is guilty of an offence and is liable to various sentences according to precedent; once being a written warning, twice being a 10 minute mute, thrice being 30 minutes, four times being 2 hours, and five times being 4 hours. (a) No person commits an offence under (6) if the content posted in any language other than English is used for educational or historical purposes. (7) Every person who willingly promotes, through messages or content, extremist ideologies of any sort, advocates for genocide, violence, or discrimination against any group under any circumstances is guilty of an offence and liable to a permanent ban. (a) No person commits an offence under (7) if content depictions of extremist ideologies are primary historical sources posted for educational or historical purposes. (8) Every person who, regardless of intent, discusses political or religious issues under any circumstances is guilty of an offence and is liable to various sentences according to precedent; once being a 3 day mute, twice being 7 days, and thrice being a permanent ban. (a) No person commits an offence under (8) if such discussions of political or religious issues are solely regarding such topics during the Second World War, and purely for educational or historical purposes. (9) Every person who, regardless of intent, sends messages or content containing racial or otherwise discriminatory slurs is guilty of an offence and is liable to various sentences according to precedent; once being a 12 hour mute, twice being 24 hours, thrice being 48 hours, four times being 7 days, and five times being a permanent ban. (a) No person commits an offence under (9) if the content is a primary historical source used for educational or historical purposes. ARTICLE VI. - OFFENCES RELATING TO INFORMATION INTEGRITY (1) Every person who, with intent to misinform, willingly shares or information known to be false under any circumstances is guilty of an offence and is liable to various sentences according to precedent; once being a 3 day mute, twice being 7 days, and thrice being a permanent ban. (a) Notwithstanding (1), every person who denies the existence of historical genocides, especially the Holocaust, and/or promotes the ideals of genocide or Holocaust denial, under any circumstances is guilty of an offence and is liable to a permanent ban. ARTICLE VII. - SENTENCING FOR OFFENCES (1) All persons shall receive the maximum sentence in all cases for an offence if all lesser sentences have been served for the same offence committed by the same person. (2) If two or more offences are committed at the same time by an individual, they will receive the combined sentence of all offences, other than cases of a permanent ban, in which such a sentence overrides all others. ARTICLE VIII. - OFFENCES CONCERNING DISCORD REGULATIONS (1) Every person who violates any part of Discord’s Terms of Service and/or Community Guidelines is guilty of an offence and liable to a permanent ban. ARTICLE IX. - COMING INTO EFFECT (1) This document, with all regulations included, shall come into effect and be fully enforceable on the 16th of July, 2023. Written by maplesyrup1_
