The Philippine National Police (PNP) is the primary law enforcement agency in the
country, mandated to uphold the rule of law, protect the people’s rights, and maintain

August 23, 2021.
The Cavite incident, where PNP personnel allegedly robbed a drug suspect of
P6.8 million worth of shabu during a buy-bust operation in Bacoor City on August
25, 2021.
The Rizal incident, where PNP personnel allegedly shot and killed four Army
intelligence operatives who were conducting surveillance on suspected terrorists
in Jolo, Sulu on June 29, 2020.
The NCRPO incident, where PNP personnel allegedly shot and killed an
unidentified suspect during a hot pursuit operation in Quezon City on September
1, 2021.
The Navotas incident, where PNP personnel allegedly shot and killed two men
who were mistaken for robbery suspects in Navotas City on August 31, 2021.
The Nueva Vizcaya incident, where PNP personnel allegedly set up an
unauthorized checkpoint and extorted money from motorists in Solano town on
August 29, 2021.
The Misamis Occidental incident, where PNP personnel allegedly tortured and
humiliated four drug suspects by shaving their heads, eyebrows, and pubic hair
in Oroquieta City on August 26, 2021.

management and supervision, and actual implementation and performance of the PNP
in law enforcement operations. They have also exposed the gaps and weaknesses in
the PNP’s internal cleansing strategy, accountability mechanisms, and human rights
compliance. Moreover, they have eroded the public’s trust and confidence in the PNP
as a professional and competent organization.
The incidents mentioned are unfortunate and highlight the need for continued
improvement in the management and implementation of policies and guidelines within
the Philippine National Police (PNP). Despite the existence of numerous policies and
guidelines, there may be shortfalls in their implementation, which can result in incidents
such as those mentioned.
One possible shortfall could be a lack of effective communication and training on
the policies and guidelines. This could result in misunderstandings or misinterpretations
of the policies, leading to improper actions by PNP personnel. Another possible shortfall
could be a lack of accountability and oversight, which could result in PNP personnel not
following the policies and guidelines.
Incidents like the ones mentioned, despite the existence of policies and
guidelines, can occur due to several reasons. Shortfalls in policy and directives,
management, and actual implementation could contribute to such incidents. Here are
my analysis and recommendations for each level of the Philippine National Police (PNP)
– strategic, operational, and tactical.
Strategic Level (Commander):
1. Policy and Directives:
One of the main shortfalls could be inadequate or outdated policies and directives.
There may be a need to review and update existing guidelines to address the evolving
challenges faced by law enforcement.
Ambiguity: Lack of clarity and specificity in policies and directives can lead to
misinterpretation and inconsistent application. Policymakers should ensure that
guidelines are detailed, comprehensive, and leave no room for misinterpretation.
Lack of Regular Review: Policies should undergo periodic review to keep them up-todate with any emerging challenges or changing circumstances. Regular revisions can
rectify any shortcomings or gaps in current guidelines.
Recommendations:
-The PNP leadership should conduct a thorough review of policies and directives,
incorporating feedback from field personnel and experts. This review should consider
the changing landscape of criminal activities, emerging technologies, and human rights
concerns.
-Establish and enforce strict ethical guidelines: Clearly define and communicate the
expected behavior and code of conduct for all personnel, emphasizing integrity,
professionalism, and respect for human rights.
-Strengthen recruitment and selection processes: Ensure rigorous screening and
background checks while selecting candidates for law enforcement positions. This can
help identify individuals with a high risk of misconduct.
-Improve training and education programs: Enhance training on conflict resolution, deescalation techniques, and human rights to ensure that personnel are equipped with the
necessary skills to handle various situations without resorting to violence.
-The PNP leadership could review and update their policies and guidelines to ensure
that they are clear, comprehensive, and up-to-date. They could also improve
communication and training on these policies to ensure that all PNP personnel
understand them.
Operational Level (Supervisor):
1. Training and Education: Insufficient training and education on proper enforcement
techniques, use of force, and human rights can lead to misconduct during operations.
Lack of Training and Accountability: It is possible that some police personnel may not
have received adequate training on appropriate conduct, conflict resolution, and the use
of force. Additionally, there may be a lack of accountability mechanisms in place to
ensure adherence to established protocols, leading to misconduct going unpunished.
Recommendations:
- Enhance and regularly update training programs to cover areas such as ethics, deescalation techniques, and community engagement.
- Strengthen internal affairs units to ensure thorough investigations and swift disciplinary
actions for policy violations.

their subordinates are following the policies and guidelines. This could include regular
performance evaluations, spot checks, and disciplinary actions for non-compliance.
- Strengthen the supervision and accountability of PNP personnel. This should include
establishing clear standards and expectations, conducting regular performance reviews
and audits, imposing swift and fair sanctions for violations or misconduct, and rewarding
exemplary behavior or achievements.
Tactical Level (Operative/Patrollers)
1. Organizational Culture and Leadership: The prevailing culture within law enforcement
agencies can influence behavior and shape attitudes. If an organizational culture
tolerates or even encourages aggressive tactics or corruption, it can contribute to the
occurrence of such incidents. Leadership plays a crucial role in setting the tone and
expectations for conduct.

Recommendations:
- At the tactical level, individual PNP personnel could take personal responsibility for
understanding and following the policies and guidelines. They could also speak up if

standards. The manual should also provide specific guidelines for different types
of operations such as buy-busts, checkpoints, hot pursuits, surveillance, etc.
Furthermore, the manual should emphasize the importance of proper planning,
coordination, communication, documentation, and reporting of all operations.
At the operational level (Supervisor), I recommend that the PNP supervisors
should exercise effective management and supervision of their subordinates by
conducting regular inspections, evaluations, feedbacks, and coaching. They
should also ensure that their subordinates are properly trained, equipped,
briefed, debriefed, and debriefed for every operation. Moreover, they should

enforce strict discipline and accountability among their subordinates by imposing
sanctions for violations of rules and regulations.
At the tactical level (Operative/Patroller), I recommend that the PNP
operatives/patrollers should perform their duties with professionalism,
competence, integrity, and respect for human rights. They should follow the
operational procedures manual and adhere to the rules of engagement. They
should also coordinate with other units or agencies involved in the operation.
Moreover, they should report any irregularities or anomalies that they encounter
or witness during the operation.
By implementing these recommendations at different levels of the PNP hierarchy, I
hope that the PNP can prevent or minimize the occurrence of incidents like those
mentioned above. I also hope that the PNP can restore its image and reputation as a
reliable and trustworthy law enforcement agency that serves and protects the Filipino
people.
There are many possible reasons why incidents like the ones you mentioned are still
happening despite the existence of numerous policies and guidelines in law
enforcement operations. Some of these reasons may include:


Foster a culture of professionalism, integrity and service among PNP personnel
Promote a collaborative, responsive and adaptive approach to PNP operations

various law enforcement operations are alarming and unacceptable. These incidents
not only violate the rights and dignity of the people, but also tarnish the reputation and
credibility of the police force. They also undermine the trust and confidence of the public
in the rule of law and the justice system.
There are several possible factors that contribute to these incidents, such as:

Lack of proper training and education on human rights, laws of engagement,
rules of evidence, and police operational procedures. Some PNP personnel may
not be fully aware of or updated on the policies and guidelines that govern their
