GENERAL The importance of the correct recovery and maintenance of physical evidence at the WEC cannot be overstated in relation to disciplinary or legal procedures. The guidelines covering rules of evidence and the chain of accountability for all recovered evidence, as contained herein, are directive in nature and must be obeyed. PROCEDURE EVIDENCE A. Evidence Storage Areas There is one evidence storage area within the facility located in room A188, which is restricted exceot to the following team members: Warden, SecurityAdministrator, LieutenanUshift Supervisor, Evidence Custodians, Shift Sergeant, Key & Tool Control, and Maintenance. This area is the onlv one where evidence is stored unless unique conditions exist. All evidence concerning lnstitutional Disciplinary Committee (lDC) or Unit Disciplinary Committee (UDC) Hearings (with the exception of currency/coin subject to special handling, paragraph V.D. below) is stored in this area untilthe conclusion of the IDC or UDC hearing and authority for destruction or return of evidence is given. Any deviation(s) requires the approval of the Shift Supervisor/designee on a case-by-case basis. B. V , Evidence Custodians There will be one Sergeant and one other Security team member appointed by the Security Administrator to act as Evidence Custodians. The Sergeant will be designated as the Primary Evidence Custodian and the other Security team member appointed will be designated as the Alternate Evidence Custodian. C. Then place it in a plastic evidence container and secure it with tow file labels. c. When collecting liquids in containers (with the exceotion of taking urine specimens), place a seal over the opening of the container and mark it with initials, date, and time. Then place in evidence bag. t. When collecting urine specimens, the specimen containers must be labeled with the inmate's full name, identification number, the date and time, name of team member and witnesses, and any other relevant identifying information, including whether or not the inmate is currentlytaking prescribed medications, type of test such as "R.U.A." for random testing, or "R.S." for reasonable suspicion. Plastic gloves must be worn by any inmate giving a urine specimen and by team member supervising the urine collection. Refusal by the inmate to wear gloves while providing the specimen will be considered a refusalto submit to the urinalysis. iii. lnmates will be safety searched prior to providing a urine sample. iv A "statement of Testing Blood or Urine for Drugs and/or Alcohol" form must be completed prior to each urinalysis. Similarly, whether or not an inmate is taking any prescription or over-the-counter medication must be recorded on this form. Forms indicating refusal will be attached to the lncident Report, a copy of which will be sent to the Security Administrator and Unit Manager. V The Evidence Tag (Attachment 1) will be marked "R.U.A.", "R.S.", to identify the specimen, and will be placed in a specially marked box in the Admissions' freezer. The Evidence Tag must be completed thoroughly. Onlythe person who administers the UA test will sign the area "From". Only the team member transporting the UA specimens will sign the areas designated as'To," and "Date and Time". vl. The U/A will be placed in the freezer in the Admissions Property Room after it has been sealed and secured in an evidence bag. The freezer will be secured with a locking mechanism. d. Carefully, place any needles in individual, hard plastic containers and seal with office labels signed by the team member securing the evidence. g. Evidence Containers/Evidence Bagsffags Whenever physical evidence is collected it will be properly secured and marked through the use of evidence containers/bags and tags. lf the evidence is too large to be placed in a bag, place an evidence tag on it. The information on these containers/tags must be complete and accurate. lf quantities are significant, prepare a typed listing showing: item, owner, taken from/to, date, storage location, finaldisposition, and authority. Evidence containers/tags can be obtained from the Housing Unit Work Station or the Sergeant's Office (See Attachments '1,2,3, and, 4 on the proper filling out of evidence information. E. V ) Rules of Evidence Whenever there is an incident that requires collection of physical evidence, the following steps shall be taken. 1 2. Protect the scene as much as possible by allowing no team member or inmate traffic through the area. After preliminary investigation and collection of the pertinent physical evidence, the area may be sealed or opened for normal use, as appropriate to the infraction. The first team member on the scene will protect the area until relieved by the Assistant Shift Supervisor. Prepare a description of the scene. Show the entire area encompassed at the scene through: a. b. c. d. Photographs (properly labeled Photo l.D. Label - Attachment 3). Video (properly labeled Video Evidence Label - Attachment 4). Drawing (hand-drawn sketch of entire room, area, etc.) Written description, noting the exact location of all evidence located within the scene area. Be sure not to damage or deface the property. Place the evidence in an evidence bag. Attach the completed evidence tags onto the bag and properly seal the bag. After the evidence has been marked (also photographs or video tapes), the reporting team member places it in an evidence drop box. (Any evidence to be immediately submitted to outside law enforcement authorities will be processed through the Evidence Custodian. A copy of the evidence tag, for evidence transferred to outside authority, shall be retained by the Evidence Custodian, and the Evidence Log will reflect that this evidence has been turned over to another law enforcement jurisdiction). 4. Maintain accurate chain of accountability for evidence. This will be accomplished by having each person who has had possession of the evidence from the time of collection until the final disposition, after case disposition, affix signature, date, and time when the evidence was taken possession of/relinquished. This must be done without fail. (See Attachment 1 on Proper Filling Out of Evidence Tag) NOTE: Each party signing the evidence tag will be responsible for the evidence until signed off to another person. DUTIES OF CUSTODIANS A. The Primary Evidence Custodian is responsible for the handling, storage, records, providing the evidence for the IDC or UDC Hearing and the disposition of evidence after the hearing. The Evidence Custodian will submit an itemized list of evidence that has been placed into evidence every 30 days to the Security Administrator, and an itemized list of evidence for final disposition of evidence every 90 days to the Security Administrator. B. ItI. The Alternate Evidence Custodian performs duties of Primary Evidence Custodian in the absence of the Primary Evidence Custodian and assists in other evidence handling duties as needed. SUBMISSION OF EVIDENCE A. Evidence confiscated by team members will be placed in an evidence container or bag. An evidence tag will be properlyfilled out and attached. The evidence will be placed in a secure evidence depository by the reporting team member. Physical evidence subject to confiscation shall be defined as any documents, property, photographs, body hair/fluids, or contraband relating to specific rules violations. Evidence may be confiscated at the time of the occurrence or as soon thereafter as it becomes available to a team member with knowledge of the rules infraction. B Evidence in the form of photographs will have a completed Photo l.D. Label affixed to each photo, and will be placed in an evidence bag with a completed evidence tag. DVD's and videotapes that are submifted into evidence will have a completed Video Evidence Labelaffixed to the videotape along with a completed evidence tag. (NOTE: Videotapes of Use-of-Force will be retained for at leastfive years). c. Team member completing the Evidence Tag will sign the "FROM" area. 'TO", "DATE", and'TlME" will be left blank for the Evidence Custodian to sign. The evidence willthen be placed in the Evidence Drop Box. Upon recovery of the evidence from the Evidence Drop Box, the Primary or Alternate Evidence .DATE', and "TIME" section of the Evidence Tag as well as the next Custodian will fill in the 'TO", "FROM" area. Whenever possible, evidence should be turned into the Primary or Alternate Evidence Custodian, in person, in order to avoid any possible break in the Chain of Evidence Possession. When this becomes necessary, the discovering team member will photograph the evidence and make comment on the lncident Report as to why the evidence was so disposed of. E. IV. When evidence is confiscated and placed in the evidence container, it is important that the label on the Evidence Bag be filled out properly and completely. Make sure the Evidence Bag is properly sealed so the evidence will not fall out when placing it into the evidence drop box. PROCEDURES FOR EVIDENCE CUSTODIAN IN HANDLING OF EVIDENCE A Upon receiving evidence from the investigating team member, the Evidence Custodian will ensure the evidence tag is complete, prepare an Evidence Record (Attachment 5), and make entryof evidence on the Master Evidence Log (Attachment 6). ln the case of evidence being used in disciplinary actions against more than one inmate, the evidence materials are to be labeled with all suspect's names and numbers to represent each inmate charged. 1 lnformation on the left side of the Evidence Record pertains to information of the Evidence Bag or Tag. 2 The right side of the Evidence Record pertains to information dealing with the handling of the evidence by the Evidence Custodians. 3. All entries on the Evidence Record Card should be typewritten or printed in ink. Blue and black ink are the only ink colors to be used. 4. Block 3 - Enter last names and numbers of other suspects. When more than one suspect is involved, an Evidence Record Card will be filled out for each suspect. Each card will contain the names and numbers of other suspects. il. lnformation pertaining to the handling of the evidence when multiple suspects are involved will be documented on one Evidence Record Card. il1. Make cross-reference entries to Official Disposition Report to Warden Upon receipt of evidence consisting of U.S. currency or coin, the Evidence Custodian will provide a receipt to the reporting team member and a copy to the Business Manager for the evidence received. The cash/coin evidence will remain in the Evidence Locker until after disposition is made by the IDC or UDC. lf, after a minimum of 90 days has passed and no legal action involving the evidence is pending, the Evidence Custodian will deliver the evidence to the Business Manager so it may be credited to the appropriate inmate's confiscated cash account. The Business Manager will sign and date the Evidence Bag and also provide a detailed receipt to the Evidence Custodian for the money received. All cash/coin evidence will remain in the Evidence Locker until the first business day when the Business Manager is available to receipt it properly. All currency is to be secured with the Business Manager/designee as soon as possible. FINAL DISPOSITION OF EVIDENCE A. Disposition of evidence may be obtained after IDC or UDC has determined the status of the evidence and annotated the evidence's disposition on the IDC or UDC Action Sheet. B. Items of evidence for IDC hearings or items which may be used in possible criminal investigations will be stored for a minimum of ninety days, with the exception of alcohol or perishable goods such as bread and milk. Positive urinalysis specimens shall be maintained in accordance with Policy 211.01, lnstitutions: Drug Testing Program. c. After evidence has been stored for a minimum of 90 days and no legal action involving the evidence is pending, authorization for final disposition of evidence may be obtained by notifying the Security Administrator/designee of disposal intent. This will be accomplished in writing, giving an itemized list of the evidence to be disposed. When sending drugs to be tested at the State Crime Lab, team member will complete a Nebraska State Patrol Evidence and lnventory Submittal Form and Receipt (Attachment 7). The State Crime Lab will only test drugs if the NDCS is going to press charges. Evidence that is not considered contraband will be returned to the owner(s) after g0 days or immediately after the investigation has determined the status of the evidence. The owner will sign for the returned property on the Evidence Record Card. Confiscated items that cannot be returned to the owner of record due to discharge or death shall be donated to a charitable organization. Anydisposition of evidence will be reflected on the Evidence Log. F The Evidence Custodian will retain records in the form of Evidence Cards, Tags, and Evidence Logs for five years after the disposition of evidence. The Evidence Log will show the final disposition and date. A report detailing the materials disposed of, by date and witnesses will be submitted on a routine basis to the Security Administrator/designee for permanent file. Evidence Logs will be routinely audited by the Security Administrator to ensure that all entries are correct.
