RA 6770 RA 6770,otherwise known as "The Ombudsman Act of 1989",was enacted to enable the Office of the Ombudsman to function and organize itself in accordance with the constitutional provisions and to exercise powers for the effective deterrence of corrupt activities by public officials and employees. This Act shall be known as "The Ombudsman Act of 1989". Section 2. Declaration of Policy.The State shall maintain honesty and integrity in the public service and take positive and effective measures against graft and corruption. What cases are covered by Ombudsman? A complaint filed in or taken cognizance of by the Office of the Ombudsman charging any public officer or employee including those in the government-owned or controlled corporations, with an act or omission alleged to be illegal, unjust, improper or inefficient is an Ombudsman case. What are the grounds for administrative case? a) contrary to law or regulations; b) unreasonable, unfair, oppressive or discriminatory; c) inconsistent with the general course of an agency’s functions though in accordance with law; d) based on a mistake of law or an arbitrary ascertainment of facts; e) in the exercise of discretionary powers but for an improper purpose; f) otherwise irregular, immoral or devoid of justification; g) due to any delay or refusal to comply with the referral or directive of the Ombudsman or any of his deputies against the officer or employee to whom it was addressed. h) such other grounds provided for under E.O. 292 and other applicable laws.
