AFFIDAVIT OF SEPARATION and PARAPHERNAL PROPERTY
I, BEN B. DAMPAG, of legal age, Filipino, and presently residing at Loo, Buguias,
Benguet, after having been duly sworn to in accordance with law, do hereby depose and
say that:
1. I have been married to ELFREDA B. CADINGAL (hereinafter referred to as the
(“wife”) on APRIL 11,1996 at ABATAN, BUGUIAS, BENGUET;
2. Irreconcilable differences have caused the irretrievable breakdown of our marriage
since 2009. All efforts at reconciliation of the differences between us have
heretofore failed and future attempts at reconciliation would be impractical and not
for our best interest;
3. Though there is no judicial process of annulment or legal separation, we have lived
separately and apart for a continuous period of more than thirteen (13) years prior
to the date of this affidavit and we have remained living separately and
independently for all times thereafter;
4. I have applied for a loan at the Cooperative Bank of Benguet-La Trinidad
(hereinafter referred to as the “bank”) for the purpose of purchasing one (1) unit
Isuzu Aluminum Wingvan and this document, and my wife’s consent and signature
are requirements from the bank;
5. The loan proceeds used to purchase the abovementioned property do not form
part of our absolute community of property or conjugal partnership but my
personal/paraphernal/separate fund and obligation and hereby absolve my wife,
defend, and render her free and harmless from any possible suit, liability and or
obligation which may arise from my failure in fulfilling my obligation with the Bank;
6. Under penalties of perjury, I voluntarily certify the above representations to be true
as of the date shown below and for all legal intents this may serve best.
IN WITNESS WHEREOF, I have hereunto set my hand this 17th day of February,2022 in
La Trinidad, Benguet, Philippines.
