COMMENCEMENT 1.1 This is the contract for a specified period of time and shall commence on the …………… and proceed until the ………….. day of …………. In the Year of Our Lord 2022 2. PLACE OF RECRUITMENT 2.1 For the purpose of this Contract, and for any such other purposes, current and future, the Place of Recruitment is ……………….. 3. PLACE OF WORK 3.1 The working for the Employee shall be …………………………. and such other places as they may be assigned by the Employer 1 4. JOB POSITION/DESCRIPTION 4.1 The Employee shall serve the Employer in the Capacity of [SALES MANAGER] 4.2 The employee shall perform roles described in the Job Description Attached and such other roles ancillary thereto as well as such other roles and responsibilities as they may be assigned b the Employer from time to time 5. PROBATION 5.1 This contract is subject to a probationary period of three (3) months, starting from the commencement date of employment. 5.2 The purpose of this probationary period is to assess whether the employee has the capacity or capability required for the job. 5.3 Where the contract is terminated during the first month of employment, seven days’ notice shall be given 6. REMUNERATION 6.1 The employees’ wages shall be TSH _________________ per month. 6.2 The wage period is monthly and the wages shall be paid on: Second day of the following month. 7. HOURS OF WORK 7.1 The ordinary daily working hours shall not exceed 12 hours in day. 7.2 Normal working hours start from _________to _________Monday to Friday and _________to__________ on Saturday. 7.3 Or as maybe agreed between employer and employee depending on the nature of work and job requirements. 7.4 Overtime may be worked when agreed. 2 8. PUBLIC HOLIDAYS & WORK DURING REST PERIODS. 8.1 Work on a public holiday shall be agreed upon between the employee and employer. 8.2 Where the employee works on a public holiday, or during his scheduled days off; he shall be paid double the basic wages for each hour worked on that day. 9. ANNUAL LEAVE. 9.1 The employee is entitled to 28 consecutive days of paid leave during each leave cycle. These days shall be inclusive of any public holidays falling within the leave period. 9.2 A leave cycle for the purpose of annual leave means a period of 12 months of consecutive employment from the commencement date of employment or the completion of the last leave cycle. 9.3 The number of days may be reduced by the number of days’ of occasional leave granted at the request of the employee. 9.4 Leave pay shall be paid in advance of the leave. 9.5 The employer shall not require nor permit an employee to work for the employer during any period of annual leave. 10. SICK LEAVE 10.1 Subject to section 32 of the Employment and Labor Relations Act 2004, the employee is entitled to 126 days of paid sick leave in any leave cycle if supported by a medical certificate on each occasion when sick leave is taken. 10.2 Payment by the employer shall however not be required if the employee is entitled to paid sick leave under any law, fund or collective agreement 3 10.3 Payments for sick leave shall be calculated as follows; a) The first 63 days shall be paid at the basic wage; and b) The second 63 days shall be paid at half the basic wage. 10.4 For the purpose of sick leave, a leave cycle means a period of 36 months of consecutive employment or the completion of the last 36-month leave cycle. 10.5 The employee shall notify the employer as soon as possible in the event of absence from work through illness. 11. PATERNITY AND MATERNITY LEAVE 11.1 The employee shall have the rights to maternity or paternity leave. 12. TERMINATION OF EMPLOYMENT 12.1 This contract may be terminated by either party giving the other 30 days’ notice. 12.2 Notices shall be given in writing within the specified period stating the reason for termination and the date on which the notice is given. 12.3 Upon termination of the contract of employment, the employer must furnish the employee with a prescribed certificate of service. 13. SEVERANCE PAY 13.1 The employee shall be entitled to severance pay of not less than seven days basic wage for each completed year of continuous service up to a maximum of ten years, where employment is terminated by the employer and the employee has completed a minimum of 12 months continuous service. 13.2 The employee shall not be entitled to severance pay if the termination of employment was on the grounds of Misconduct; or Non compliance to HSE policy, procedures and systems of work, Willful and permanent leaving the work area, Repeated disobedience in very grave circumstances (with very grave consequences) Incapacity, incapability or operational requirements, and the employee unreasonably refuse to accept alternative work employment. 4 14. APPLICATION OF THE ACT. 14.1 This agreement shall be interpreted and applied in accordance with the provisions of the Employment and Labor Relations Act 2004 (as amended from time to time). 14.2 Where any conflict arises between this agreement and the Act, the provisions of the Act shall apply as if it is a term of this agreement. 14.3 The employee shall be entitled to any other benefit stipulated by the act even if not stated in this agreement or as agreed between the parties.
