568 PÀ£ÁðlPÀ gÁdå¥ÀvÀæ, ªÀÄAUÀ¼ÀªÁgÀ, ¥sɧæªÀj 15, 2022 ¨sÁUÀ 6J APPENDIX IV MEMORANDUM OF UNDERSTANDING 1. This Memorandum of Understanding (MOU) is entered into on this by ………………………and between: The Karnataka State Open University, Mysore, represented by the Registrar and hereinafter referred to as FIRST PARTY And …………………………………… having its head office at ………............................. hereinafter referred to as the SECOND PARTY, and represented by ………………………………….. who has been specifically authorized by the Second Party, to enter into this MOU. 2. WHEREAS the Second party which has been in existence for years and conducting programmesin had submitted an application in Annexure I (the form prescribed in the Statutes for the purpose) for recognition to conduct programmes hereinafter mentioned; AND WHEREAS the Academic Council of the First Party, having regard to the Report submitted by the Expert Committee in Annexure-II (the form prescribed in the Statutes for the purpose) has accorded recognition to the Institute of the Second Party, to conduct following Programmes: Programmes approved: (i) (ii) (iii) 3. TERMS AND CONDITIONS OF THE MOU: It shall be the responsibility of the Second Party to arrange the following: 3.1. The Second Party shall arrange to impart teaching only in respect of the Programmes approved by the First Party, in accordance with the Ordinance of the First Party; The Second Party shall also arrange to get recognition for the technical programmes from the Regulatory Bodies, if need be. 3.2. The Second Party shall be responsible to ensure that adequate arrangements are made to popularize the programmes by advertisement to attract large number of applications. The Second party shall prominently display the name of the First. Party in its logo. It shall prepare and print the prospectus with the application for the students to apply, after the approval of the First Party. The cost of printing of prospectus shall be borne by the Second Party and shall however retain the sale proceeds of the prospectus. ¨sÁUÀ 6J 3.3. PÀ£ÁðlPÀ gÁdå¥ÀvÀæ, ªÀÄAUÀ¼ÀªÁgÀ, ¥sɧæªÀj 15, 2022 569 The Second Party, wherever necessary, permit Study Centre(s) to assist the Second Party to impart education in approved programmes, after obtaining prior approval of the First Party so as to extend proper and effective student support. Such Study Centre(s) shall pay non‐ refundable deposit of Rs…………………… (Rupees………………………………………) to the First Party; Such Study Centre(s) shall submit all its particulars and undertaking in the Form, specimen of which is appended to these Statutes in Annexure III, through the Second Party to enable the First Party to accord approval. 3.4. The Second Party shall permit the Study Centre to make admission of students not less than 20; The Second Party holds complete responsibility on the Study Centre(s) for proper discharge of academic works assigned to it/them; For all complaints from students and litigations before any Court of Law against the Study Centre, the Second Party shall deal with them and contest legal disputes if any, under intimation to the First Party; 3.5. On receipt of applications from the students, the Second Party shall make sure that the students fulfill the minimum eligibility conditions prescribed by the First Party and laid down in the prospectus approved by the First Party; 3.6. A list of selected students in the Second Party Institute and also in the Study Centre(s), with enclosures to show their eligibilities shall be forwarded by the Second Party to the First Party for approval. Thereafter, the First Party shall send identity cards with authorised signature to be distributed to the students. 3.7. Along with the list of students admitted by the Second Party and its approved Study Centre(s), the Second Party shall also forward D.D. to the First Party towards the amount collected from the students and payable to the First Party as per this MOU and such DD may be drawn in favour of the Finance Officer, Karnataka State Open University, payable at Mysore; 3.8. The Second Party shall ensure that the study materials prepared by the subject experts are ready before the admission of students, for distribution to the students admitted in the recognized Institute and its Study Centre(s). The printing of study materials is at the cost of the Second Party. 570 PÀ£ÁðlPÀ gÁdå¥ÀvÀæ, ªÀÄAUÀ¼ÀªÁgÀ, ¥sɧæªÀj 15, 2022 3.9. ¨sÁUÀ 6J The Second Party shall provide necessary infrastructure in the Institute and its approved Study Centre(s) for effective teaching with adequate facilities to students, such as, the Library, Laboratory, Class rooms, Computers with all its accessories, drinking water, rest rooms etc.; 3.10. The Second Party shall organize Contact programmes, class room lectures wherever applicable and practical classes if any, at appropriate time before the term days; 3.11. The Second Party shall make all necessary arrangements for conducting examinations at its Institute and its approved Study Centre(s), with the ,assistance of the First Party. The First Party shall arrange to send the question papers confidentially and also blank answer scripts to the Second Party safely. Proper invigilation must be arranged by the Second Party and the First Party may also send its Special squads to make sudden inspection during the examinations to avoid malpractices. The secrecy of the examination must be well maintained by the Second Party. The internal assessment marks must be secured well before the theory examination and kept separately, by the Second Party and produced the same to the First Party when asked for; Examination shall be in semester/annual scheme and shall be of credit based as suggested by the DEC. 3.12. The project reports/Dissertations submitted by the Students wherever prescribed for UG and PG Programmes shall be treated as the property of the First Party; 4. FINANCIAL ARRANGEMENTS: As already stated above, the Second Party shall meet the expenditure towards4.1. Notifying the programmes conducted to invite applications from students through advertisement in news papers and in web‐site; 4.2. Printing of prospectus with application for students to apply (and however shall retain the sale proceeds of prospectus); 4.3. Printing of Study materials and supply them to students; 4.4. Meeting of the expenditure towards TA and DA to the staff of the First Party when they visit the Institute and its Centres for Inspection before recognition of the Institute of the ¨sÁUÀ 6J PÀ£ÁðlPÀ gÁdå¥ÀvÀæ, ªÀÄAUÀ¼ÀªÁgÀ, ¥sɧæªÀj 15, 2022 571 Second Party; and also when they visit to handover the examination materials, and for return journey with sealed answer scripts; 4.5. The First Party shall have no legal, financial or any other responsibility towards employees and teachers working with the Second Party and its approved Study centre(s). Similarly, the First Party shall not be responsible for any debt incurred by the Second Party and its approved Study Centre(s); 4.6. The First Party shall not at all responsible for any lapses either in academic matter or in any financial issues concerned with the Study Centre(s) of the Second Party. The Second Party shall take all responsibility to make sure that its Study Centre(s) are fairly discharging its functions in imparting education in approved courses; 4.7. Any financial, academic and administrative lapses on the part of the Second Party and its approved Study Centre(s) have no bearing on the First Party. 4.8. The Second Party shall deposit non‐refundable deposits to the First Party through DD payable at Mysore and drawn in favour of the Finance Officer, Karnataka State Open University, as follows: 4.9. Examination fee will be notified by the Registrar (Evaluation) of the First Party separately. 1. IT SHALL BE THE RESPONSIBILITY OF THE FIRST PARTY TO : 5.1. finalise theapproval of admissions of students and to provide registration number of each student admitted through identification cards; 5.2. decide the approval or otherwise of the Study. Centre(s) of the recognized Institute; 5.3. keep its web site updated on information on the programmes offered by the Second Party from time to time. 5.4. arrange to send question papers in sealed covers and blank answer books to the Centres of the Examination of the Second Party; 5.5. make payments towards expenses to conduct examinations at the rate fixed by the First Party. 5.6. evaluate answer scripts and project reports and arrange to announce the results as per the time schedule; 5.7. arrange to send Marks cards, Certificates/Degree of each candidate who took the examination, on requisition with fee prescribed by the First Party.
