(Work at height) Specific legal arguments (100-150 words): As per ILO Convention C167, safety and health in convention, 1988, Article 18(1), preventive measures shall be taken against fall of workers, if workers are working on the height where structure or its slope exceeds that prescribed by national lows and regulation. I.e. if the height of a platform is more than 2-meter guard rail, top tail and toe guard must be provided as a fall protection. As per ILO Recommendation R053, safety provision (Building) Recommendation, 1937 regulation 18. 11 (a & b). Every working platform including scaffold which exceeds the height prescribed by national lows and regulation and from where there is chance of fall of person must be provided with adequate fall protection system i.e. top-rail, mid-rail and toe guard. As per ILO code of practice on safety and health in construction, section 4.3.12, as far as practicable, to work at height more than 2 meter, every part of working platform, gangway or stairway of a scaffold form which workers can fall or as prescribed by national laws or regulations, should be provided with guard rail and toe guard Likelihood & severity (75-150 words): - (also mention no of workmen and duration of being affected) The likelihood of fall of workers from scaffold is very likely because 4 workers are engaged at 15 meter on an unguarded scaffold platform. Work at height is the routine activities which carried for more than 5 hours on daily basis. The rating of severity of the hazard is Catastrophic, because workers are working at 15 metre height if any workers fall from that height it will result in serious injury e.g. multiple bone fracture, permanent disability and even fatal. I have given a timescale of 2 months to provide edge protection because, for this work company have to hire trained scaffolding gang and a scaffolding supervisor for proper supervision and inspection of scaffold. Yes, this action will prevent workers to fall from height during working on scaffold, except edge protection proper supervision to be provided to look after workers that they are anchoring their harness in life line during work. If any action has not completed on given timescale I will remind responsible person through Email and if the action being postpone from more than 2 week of given timescale I will remind and inform to project manager and call him for a formal meeting.
