Outline of State case
Facts
1. The accused person is a male adult residing at house number 2305 Old
Tafara Harare, and is employed at Inso Aluminium, Masasa Harare.
2. The Complainant is PRIMROSE NYAMAHARO a female juvenile aged
13residing at number 2305 Old Tafara, Harare years and is a grade seven
student at Liberty Little Academy Eastview Harare.
3. The accused person is complainant’s step farther.
4. On a date unknown to the prosecutor, during the month of February
2022 at around 1200hrs the accused person asked the complainant to
accompany him to his friend’s house, on their way the accused person
proposed love to the complainant and she refused.
5. On another day in February 2022,at around 1800hrs the complainant’s
mother went to church and left her alone at home, after about 30
minutes the complainants mother left the accused person come home
and asked the complainant to give him food and the complainant
complied.
6. After eating, the accused person called the complainant to collect plates.
As the complainant intended to collect plates, the accused person
grabbed her by the neck, closed her mouth with a blanket and pushed
her on the bed.
7. The accused person removed complainant’s pant and skirt, he also
lowered his trousers and pants, got on top of the complainant, inserted
his erect penis into the complainant’s vagina and have sexual
intercourse with the complainant once without her consent.
8. The accused person threatened to kill the complainant with a knife if she
reveals the matter to his mother.
9. The accused person continued having sexual intercourse with the
complainant whenever he got the chance until the 2nd of February 2023
when the complainant decided to reveal the matter to her mother
Noreen Mhembere.
10.The accused person acted unlawfully.
