JUDGMENT
In the instant case, a Charge sheet was filed by C.B.I.
S.B.B – 1, Delhi, against accused Surinder Koli in the
case arising from R.C. No. 2(S)/2007 under Sections
302, 364, 376 read with Sections 511 and 201 I.P.C.
Thereafter Accused Moninder Singh Pandher was
summoned by Court vide its order dated 28.11.2007
under Section 310 (1) Cr. P.C. to face trial under
Section 302 read with Section 120-B, Section 201 read
with Section 120-B I.P.C. and Section 376 I.P.C.
The case file of accused Surinder Koli was committed to
the Court of Sessions as the case of this accused was
exclusively triable by Court of Sessions and thereafter
this case was transferred to this Court on 11.4.2007
and case of the accused was tried by this Court.
Brief facts of the case according to prosecution are that
a Complaint was lodged by the Complainant of this
case, Jaitin Sarkar, S/o Bhanu Sarkar, R/o House of Om
Prakash Pandit, Village Nithari before the Station House
Officer of Police Station Sector 20. This report of the
above named complainant was written by Shambhu
Kumar, S/o Ram Bahadur, R/o Sector 20. In this
Complaint, the Complainant had stated that – My
married daughter Pinki, aged 20 years having one son
aged 1½ years had left the house on 5.10.2006 for her
work. But she did not return. Thereafter we searched
for her everywhere. But could not find her. On
29.12.2006, we came to know that some human
skeletons and clothes of children have been recovered
from House no.D-5, Sector 31. Thereafter myself and
my wife Vandana Sarkar went to the above house and
identified the salwar, suit and chappals of our daughter
Pinky. It amply shows that the owner of the said
house, Mahinder Singh, S/o Sampooran Singh and his
servant Surinder alias Satish Koli, S/o Shankar Ram,
R/o D-5, Noida, first called my daughter Pinki to their
house and thereafter they raped her and then they
killed her and buried her dead body in the backyard of
their house. I did not lodge any report earlier in this
regard. It is, therefore, most respectfully prayed that a
case be registered against Mahinder and Surinder alias
Satish and legal action be taken against them.
Based on the above report, the Police of Police Station
Sector 20, Noida, District Gautam Buddha Nagar,
registered Crime No.1025/2006 against the above
named accused persons.
Later on, the investigation of this case was handed
over to C.B.I. and C.B.I. registered Case no.2(S)/07
against accused Surinder Koli, S/o Shankar Ram Koli
R/o Margu Khala, Police Station Jolly Khaal, Amroha,
present address D-5, Sector 31, Noida (Uttar Pradesh)
and accused Moninder Singh Pandher, S/o Sampooran
Singh, R/o 1021, Sector 17, Chandigarh, present
address D-5, Sector 31, Noida (Uttar Pradesh).
Thereafter C.B.I. investigated the case and collected
evidence and on the basis of prima facie evidence
collected against accused Surinder Koli, a Charge sheet
was filed against him only under Sections 302, 364,
376 read with Sections 511 and 201 I.P.C. No charge
sheet was found by the C.B.I. against the co-accused
Moninder Singh Pandher because no prima facie
evidence was found/available against him.
Thereafter
the

Corruption, Ghaziabad, framed charges under Sections
302, 364, 376 read with Sections 511 and 201 I.P.C.
against the accused Surinder Koli, on 4.6.2007. But
said accused denied to the charges and claimed trial.
An Application 131K under Section 319 Cr. P.C. was
filed by Smt. Vandana Sarkar and thereafter an order
was passed by the then Special Judge, C.B.I., Anti
Corruption,
Ghaziabad,
