Advocate ways to improve its performance. 3 Vocabulary List ❑ EXECUTIVE – branch carries out laws. It is composed of the President and the Vice President who are elected by direct popular vote and serve a term of six years ❑ POWER – capacity of an individual to influence the actions, beliefs, or conduct (behavior) of others. ❑ WRIT OF HABEAS CORPUS – is a legal action or writ by means of which detainees can seek relief from unlawful imprisonment. 4 5 Roles and Powers of the Philippine President and the Vice President 6 THIS IS A SLIDE TITLE ▰ We have a presidential form of government in the Philippines. The president of the Philippines is the center of power, the head of both government and state 7 THIS IS A SLIDE TITLE ▰ This also means that he/she is not constrained by both the judicial and legislative branch in the performance of his/her duties as the country’s chief executive (Watson in Ramirez 1969). ▰ The executive power vested upon the president and the executive branch basically means ‘the power to enforce and administer the laws” 8 Qualifications of the President and Vice President 1. a natural born Filipino citizen 2. a registered voter 3. able to read and write 4. at least forty (40) years of age on the day of the elections, and ▰ 5. a resident of the Philippines for at least ten years immediately preceding such election. ▰ ▰ ▰ ▰ 9 10 YOU CAN ALSO SPLIT YOUR CONTENT ▰ The president and vice-president are elected through direct voting by the majority of the voters and will begin their six-year term on the 30th day of June following the day of election. ▰ The president cannot run for re-election for the said office again unless that person who served as president only held office for four years or less. White 12 13 POWERS OF THE PRESIDENT POWER OF APPOINTMENT ▰ provided in Section 16, Article VII of the Constitution. The president can appoint the heads of the executive departments, ambassadors, other public ministers and consuls, officers of the armed forces from the rank of colonel or naval captain and other officers whose appointment are vested in him/her by the Constitution. 14 POWERS OF THE PRESIDENT ADMINISTRATIVE POWER ▰ as stated in Section 17, Article VII. The president shall have the control of all executive departments, bureaus, and offices. He shall ensure that the laws be faithfully executed. 15 POWERS OF THE PRESIDENT MILITARY POWER ▰ The third major power is the military power for being the commander-in-chief of all the armed forces in the Philippines under Section 18, Article VII. 16 POWERS OF THE PRESIDENT MILITARY POWER ▰ Along with this power is the power to suspend the privilege of the writ of habeas corpus and to place the country or any part of the Philippines under martial law in cases of invasion or rebellion or when public safety requires it. The president is given 48 hours from the proclamation of martial law to submit a report regarding such proclamation to the Congress which will decide if the proclamation be revoked or suspended. 17 POWERS OF THE PRESIDENT POWER TO GRANT PARDONS AND AMNESTY ▰ Pardon is the power to release a wrongdoer from punishment after conviction. Amnesty is a pardon extended to a group of persons and abolished the offense before or after conviction. 18 POWERS OF THE PRESIDENT LEGISLATIVE ▰ He/she can make policies through Executive Order, Administrative Order and other special orders and proclamations in performing official function. ▰ He can also prevent the passage of a law and reject bills passed by the legislature. He also can address the legislature and present his agenda. 19 POWERS OF THE PRESIDENT DIPLOMATIC ▰ He receives foreign diplomatic agents, appoint and send diplomatic agents, negotiate and sign treaties and international agreement. 20 Other powers of the president include: ▰ ▰ the power to contract or guarantee foreign loans on behalf of the Republic subject to prior concurrence of the Monetary Board and subject to limitations as may be provided by law; the power to sign a treaty or international agreement provided that the validity and effectiveness of such treaty will be ratified first by at least twothirds of all the members of the Senate; 21 Other powers of the president include: ▰ and the of the budget under Section 22, Article VII, where the president submits to the congress a budget of the expenditures and sources of financing, including receipts from the existing and proposed revenue measure. 22 ▰ The president exercises a lot of powers, but he/she should be reminded that the true power rests in the people and that the Office of the President, as well as the other branches of the government, exists to serve the populace. 23 WHAT HAVE YOU LEARNED IN THE LESSON? 24 As citizen of this country, what is the significance of knowing the functions of government officials? 25 ANY QUESTIONS? 26 THANK YOU FOR LISTENING! 27 Functions of the Legislative Branch 28 29 30 OBJECTIVES After the lesson, you are expected to: 1. Appreciate the roles and contributions of the members of the Legislature VOCABULARY LIST LEGISLATIVE BRANCH – refers to the branch of the government that can create laws or change existing laws. LEGISLATION – means law-making, law formulation or law enactment CREATION - the action or process of bringing something into existence 32 VOCABULARY LIST ENACTMENT - the process of passing legislation AMENDMENT - a minor change or addition designed to improve a text, piece of legislation SENATOR - elected by voters to represent them in a state HOUSE OF REPRESENTATIVE -they are elected to a three-year term by voters in their respective legislative districts 33 COMPOSITIONS AND FUNCTIONS OF THE LEGISLATIVE BRANCH • The Senate of the Philippines is composed of 24 Senators elected at large while the House of Representatives is composed of not more than 250 members, 20% of which is composed of partylist representatives. 34 The Senate QUALIFICATIONS • Natural – born citizen of the Philippines • Able to read and write • A registered voter • At least 35 years old on the day of election • Resident of the Philippines for not less than 2 years immediately before the day of election. 35 House of Representatives QUALIFICATIONS • Natural – born citizen of the Philippines • Able to read and write • A registered voter • At least 25 years old on the day of election • Resident of the District in which he shall be elected for not less than one year immediately coming before the day of election 36 • The term of office for the elected Senators and Representatives starts at noon of the 30th day of June following their election. • The Senators will serve for six years and shall not serve for more than two consecutive terms. • The Representatives, also known as Congressmen / women, will serve for three years and shall not hold office for more than three consecutive terms. 37 • In case of vacancy in the Congress, under Section 9 of Article VI, a special election may be called to fill such vacancy in the manner prescribed by law, but the Senator or Member of the House of Representatives thus elected shall serve only for the unexpired term. 38 FUNCTIONS OF CONGRESS The primary function of the Legislative branch is the creation, enactment and amendment of laws. Proposed laws may come from the Senators or Representatives themselves, the people they represent (district, province or the party) or the other two branches of the government. 39 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 1. Congress has the power to remove from office impeachable government officials, including the President, Vice President, members of the Supreme Court, members of constitutional commissions, and the Ombudsman. The House of Representatives can tackle impeachment complaints and submit the resolution setting the Articles of Impeachment. The Senate, meanwhile, decides on cases of impeachment in a fullblown trial. 40 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 2. Congress has the “sole power to declare the existence of a state of war,” according to Section 23 Article VI of the Constitution. A vote of two-thirds of both Houses, voting separately, is needed. 41 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 3. Congress can revoke the President’s proclamation of martial law by a vote of at least a majority of all members of the Senate and the House. If requested, Congress can also extend the period of martial law beyond the mandated 60 days. 42 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 4. Congress may authorize the President to exercise powers to carry out a declared national policy “for a limited period and subject to restrictions” in times of war or other national emergency, 43 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 5. Congressional committees can conduct hearings “in aid of legislation” on various issues that affect the nation and release a report based on findings. For example, the Senate committee in August 2018 conducted a hearing on the TRAIN law’s impact on inflation amid rising prices of commodities. 44 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 6. Congress is also involved in the national budget process. It can decide whether or not to add or reduce a government agency’s budget, effectively overseeing budget appropriations and being on guard against suspected corruption. This, however, may lead to several clashes, as seen in the 2019 budget that was just passed on Friday, February 8, after months of delay. 45 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 7. Congress, through the Commission on Appointments, can approve or reject some key appointments made by the president to government agencies. 46 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 8. Congress needs to concur with any amnesty granted by the president, according to Section 19, Article VII of the Constitution. A vote of majority of all members is needed. 47 The 1987 Philippine Constitution provides many instances when Congress can invoke this power: 9. Congress is heavily involved in starting charter change.
