Degree of Distinctiveness of Trademark
1. Fanciful Mark – imagination, invented 100% registrable; not found in the dictionary thus, it
will have a high degree of distinctiveness
2. Arbitrary Mark – they are also registrable. Although generic marks but they do not refer to
the product it seeks to identify
3. Suggestive Mark – to suggest or imply the quality, characteristic or usage of the product.
-weak marks but they are registrable
4. Descriptive Mark – describes the product itself, the use of the product or the process and
manner. (Generally, not registrable)
5. Generic Mark – describes the very product or service it identifies; as a rule, lack the element
of distinctiveness. (Generic marks is not registrable. It talks about the product itself)
