Independent Living Resident Agreement This Agreement is between Collaborative Housing Management LLC, also known as Faith and Fellowship Housing and/or FFC Housing, and the resident______________________________. The undersigned resident acknowledges and attests that he is living in a shared housing property for individuals with disabilities and that he qualifies as having a disability. The undersigned acknowledges and agrees to the following terms and conditions as part of living at New England House, including the house rules: 1) The name of the Property is New England House 2) The location of the Property is 1731 S New England Street Los Angeles, CA 90006 3) The property is a Transitional Living Program for adults with disabilities who are able to live independently and function independently. The rent is $______ per month, which is due and payable on the ________ of the Month, with a grace period lasting until the ______ of the month. The rent shall be considered late if paid on or after the ______ of the Month and a $35 late fee shall apply to all late rent payments. If the rent is still not received seven (7) days after the initial due date, the resident must vacate the premises and failure to do so may constitute trespassing. Collaborative Housing Management LLC reserves the legal remedies available to a Sober Living Home and/or Independent Transitional Living Program for adults with disabilities California Health and Safety 50582 (g)(2) - 42 USC §11384 4) A coin operated washer and dryer in available in the laundry room for residents 5) The resident shall be provided with a bed, linens, towels, pillowcase, cleaning supplies and shall have access to kitchen facilities, refrigerator, and cutlery 6) Resident is responsible to supply all his/her own meals 7) Resident shall receive a copy and comply with all house rules. Failure to comply with house rules is grounds for expulsion from the residence 8) All utilities are included in the rent 9) There is a security deposit of _____________ 10) There is a $25 fee for any returned checks 11) All utilities—gas, electric, wifi, and water—shall be included in the rent 12) There is no parking for residents 13) Residents shall not sublet their rooms or bunks 14) Management reserves right to change the arrangement of furniture, beds, and/or number of persons living in the bedrooms at anytime. 15) Residents shall comply with all inspections and participate in the residence council per the House Rules 16) Rent is payable to Collaborative Housing Management LLC and may be mailed to 326 N Western Ave #326 Los Angeles, CA 90004 or given directly to Larry Rago or his designated house manager. Residents shall receive a signed and numbered receipt for any payments made in cash. Residents may only mail checks or money orders, payments in cash must be made in person directly to Larry Rago 17) Residents shall be responsible for any costs of litigation necessary for nonpayment 18) Any grievances or reasonable accommodation requests must be made in writing and given to Larry Rago or mailed to Larry Rago at the Collaborative Housing Management office location at 326 N Western Ave #326 Los Angeles CA 90004. Larry Rago shall respond to resident within one week of receiving any grievance or request for reasonable accommodation 19) Resident understands that living in an Independent Living Program as a single family of disabled adults is different to standard forms of renting. Compliance with the house rules is mandatory for continued lodging. Landlord reserves right to change bunking configuration, move residence to other rooms as determined in the best interest of the program, or make other changes necessary for efficient operations. 20) Resident agrees to submit to submit to random drug testing completely at Landlord’s discretion. 21) Resident agrees to comply with terms of any medical treatments or action plans made with outside agencies and/or case managers, including but not limited to attending self-help sessions, taking prescribed medications, or receiving continued medical care related to their disability 22) Resident agrees to submit to an initial 30 day probationary period in which he/she is evaluated by landlord to determine if he/she is a good fit for the program. 23) Resident understands that Collaborative Housing Management LLC and/or FFC Housing is a Christian organization. Resident understands that a Bible study or other Christian fellowship shall take place in the Living Room once per week and fair notice shall be given as to what days and times. Residents are not required to join but are invited and encouraged to attend. Being Christian or not, or choosing whether to attend the Bible Studies shall in no means affect one’s residency. 24) A 30 Day written notice shall be given when resident intends to vacate property 25) There are no refunds on rent after rent is paid. Rent is is accepted monthly, weekly and daily rates shall not apply. 26) All rooms are furnished with minimum of 2 persons per room 27) No more than 6 persons shall share a bathroom at New England House 28) No drugs, alcohol, or criminal activities shall be allowed. There shall be zero tolerance 29) No smoking is allowed in the house. All smoking must be at least 20 feet from the building. 30) Residents must share in the responsibility of doing chores around the house per the House Rules. Failure to follow any of the house Rules is grounds for expulsion from the property. 31) Residents shall keep a tidy living space and clean up after themselves. Residents shall at all times show each other respect in both words and actions 32) Residents living in the back of the house may visit the living room or dining room areas to the front of the house between the hours of 10am and 10pm daily. Exceptions to visit outside of these hours may be granted for scheduled movie nights or by request of resident to management. 33) Any form of sexual harassment or disrespectful behavior shall be grounds for termination. Males and females are never allowed in the bedrooms of the opposite sex. No pursuing romantic relationships with other residents. Failure to comply with any of this and more which is covered in the house rules, is grounds for expulsion from residence. 34) Resident is hereby notified and gives consent to video monitoring in shared spaces and outside upon the property grounds. Video monitoring shall not take place within bedrooms or bathrooms 35) Resident agrees to abide by curfews and sign in and out when leaving if they are required to do so. All housing units are properly furnished and must be kept clean and orderly. Collaborative Housing Management operates the New England House, a Christian transitional living home for adults with disabilities who can live and function independently. This is Shared Housing, communal living, different to tenancy in a private apartment. All policies and procedures outlined within this contract and any applicable subsequent amendments are in full force and effect during Resident’s stay. Any violation of policy, house rule, or procedure outlined below can result in sanction, disciplinary action, including but not limited to, fines, fees, House probation/restriction, and possible expulsion from the home. I. II. Upon Arrival 1. Resident will commence a 30 day probation period. Management may determine at its sole discretion that Resident is not a good fit for the program and terminate residency within the first 30 days. Expenses & Responsibilities 1. 2. 3. 4. 5. III Rent is $________________ per month. The length of residency shall be month-to-month. Groceries are not supplied by the house. Advance payments can be made for rent and/or other charges. There will be a $25.00 fee for all returned checks. Immediate dismissal will occur for the following: 1. Disruptive behavior 2. Disruptive behavior is defined, but is not limited to: i. _____Violence or threats of physical violence. ii. _____Abusive verbal behavior. iii. _____Physical violence. iv. _____A "chronic" bad attitude v. _____Gambling. vi. _____Destruction of house property. vii. _____Loud music, television, radio or instrument. viii. _____Theft. ix. _____Arson x. _____Breaking confidentiality. xi. _____Abusive/loud arguments. xii. _____Violation of House policy and procedure. xiii. _____Use of drugs or alcohol on or off the property xiv. _____Possession and/or use of weapons. xv. _____Refusal to provide a urine sample and or alcohol test if asked xvi. _____Not paying rent. xvii. _____Failure to comply with curfew xviii. _____Failure to attend self-help groups or engage in constructive activity xix. _____Failure to perform chores or participate in resident council IV. Resident Responsibilities 1. Resident must respect the anonymity of all residents. Resident and House business is confidential and must not be discussed outside of the house. Violation of this policy will be grounds for immediate expulsion. 2. Resident will be responsible for completing assigned chores. Chores will be assigned by House manager and will be posted in both the front and back of the house, Resident must also participate in the Residents Council weekly house meeting on Sunday nights, which shall also be posted 3. Resident must complete any requirements of the referring agency, which may include attending self-help meetings 4. Rooms are subject to inspection at any time by Choices Staff or Head of household. Room should be kept neat and clean, and the beds should be made daily. V. Overnights and Visiting 1. Overnight stays off premises must be approved 2. Visitors and guests at New England House must be preapproved by management 3. Overnight stay requests must be received no later than one day before the requested date. 4. Never are visitors allowed to stay overnight in residents room 5. Residents are responsible for the conduct of their visitors 6. Visiting hours are 9am to 9pm daily unless otherwise approved VI. Medicine 1. Resident must self-administer medication as prescribed by a physician. 2. Resident must not discontinue medication for any reason without a physician’s order. 3. Resident may not be prescribed narcotic medications. 4. Medication must be stored out of plain view from other Residents. For example, in a dresser, closet, or in a container under the bed. VII. Curfew 1. House curfew is 11:00pm. 2. House curfew may be extended on a case-by-case basis with approval of management. Plan ahead 3. Exceptions will be made for employment-related reasons (verification will be required). VIII. Visitors 1. 2. 3. 4. All visitors must be pre-approved Visitors are not allowed in the bedrooms Visitors must have a minimum of 30 days of sobriety Management reserves right to cancel or refuse visitors in the best interest of the Program IV. Smoking 1. Smoking is prohibited in the house. 2. Smoking is permitted only 20 feet from building. Resident must clean up their own cigarette butts V. Lock Down 1. The House is subject to lock 2. Lock down is defined as, but not limited to: i. No television. ii. No telephone. iii. Leaving House for work only. iv. No outside meetings. Meetings will be brought into House for Residents. XV. Termination of Residency 1. A 30 day notice is requested 2. Upon leaving, Resident’s bedroom should be thoroughly cleaned. 3. Any Resident expelled for any reason will not be permitted to return to the premises as a Resident for a minimum of 5 to 7 days, and must go to the mission, a shelter, hospital, or detox. Expelled Resident must have a clean urine test in order to return. 4. Resident will not be permitted to return to the premises as a Resident if they used any illegal drugs or alcohol or possession of illegal drugs and alcohol on promises. 5. Upon expulsion, personal belongings must be picked up within three days or the storage fees shall incur at $20 per day up to one week, at which time any belongings shall become the property of Collaborative Housing Management 6. Resident’s Account must be current in order to receive personal belongings. This Contract and rules are subject to change without prior notice. Resident shall be informed of any changes in writing. By signing below, I indicate that I understand the terms and conditions set forth in this agreement and I hereby agree to abide by them.
