Case: Abbas VS SET G.R. 83767. October 27, 1988
Facts: Petitioners filed before the SET an election contest against 22 candidates of the LABAN coalition
who were proclaimed senators elect. Petitioners moved to inhibit or disqualify them from the hearing
and resolution as they are all interested parties in the case.
Issue: Whether or not it is unconstitutional to involve senators who are currently seated in the tribunal
Ruling: No
Ratio decidendi: There is no provision in the constitution that states a scheme for settling a substitution
of senators designated to the tribunal. Litigants must simply have trust in the sense of justice of the
tribunal. s
