(1.) Whether the government is liable for the negligence for the quality of the materials used to build the bridge? (ANS.) State is Liable for their negligence because negligence is a civil tort which occurs when a person breaches his duty of care which he owed to another due to which that other person suffers some hard or undergoes some legal injury. The Public authority are liable to damages for the act in which they have to take due care and in this case there is a duty of Government to check the quality of the material being used during the construction of the bridge but it has not been done by them that’s why the state is liable in this case. (2.) Whether the government is vicariously liable for the act done by the M/S Rockson Pvt. Ltd? (ANS.) Both the Government of India and the State Government of Jammu & Kashmir are liable to pay the compensation for the act done by M/s Rockson Pvt. Ltd. Because as per the statement given in the preposition, the Construction Company was carrying that another work in joint collaboration with Government of India and the State Government that’s why the Company is working as an agent for Government when this incident had taken place. So, The Government is Vicariously Liable for the Act done by the Construction Company. (3.) Whether the state is liable to pay more compensation? (Ans.) The Government is liable to pay the compensation to the deceased and injured ones because as per the statement given in the preposition the State was acting as the master for its agent and servant as everything was under the control and supervision of the state. PRAYER Therefore, In the light of the issues raised, arguments advanced and authorities cited, it is most humbly and respectfully prays before the Hon’ble Court to adjudge and declare that: (1.) The Compensation Amount of Rs. 10,00,000 to be awarded to the family of deceased and Rs. 1,00,000 for the injured because the compensation given by the government does not meet the requirement of the company as the person dead is the sole Provides of the family the court.
