If you want to quote the book or letters, please email me for permission. That way, you will be legally protected. Partial Account Number: Reference the partial account number on your credit report. Don’t include the entire long number in your letter. You can even challenge that the number belongs to you when the entire number has not been provided. Auto Repo: First, look at the Statute of Limitations in your state to see if the account is still legally collectible. Handle an auto repossession like any other large collection account. You might need to negotiate a settlement to get rid of an auto repo on your credit report. Please refer to Chapters 15 and 16. However, if the company violated the law in the repo process or if the balance is wrong, you could have a loophole for disputing the entire account to get it removed. If the creditor was Santander, Google search “Santander settlement” to see if the terms apply to you. Correction: Chapter 15, page 94, A collector cannot report a debt that is more than seven years past the date of first delinquency with the original creditor (not date of last activity). Bankruptcy? Do not send this form to the individual creditors, such as Visa or a collection company. For the individual creditors, send a letter. If you have multiple old (3+ years) charge-offs or collections that have been paid with a $0 balance, then you can dispute them on one form. If your derogatory accounts are related in some way (such as all are medical, all were the same time period due to the same event, they are the same incident with one being the original creditor and the other being the collector that the original creditor sold to), then you can dispute them on one form. It is best if you handwrite something. Your handwriting must be neat and legible. Keep it super short. See the samples at the end for ideas on what can be written. If your derogatory accounts are completely unrelated, then it’s best to use a different form so that it doesn’t look like your dispute is phony and that you’re just trying to “blanket remove” all bad credit at once in a false manner. I have disputed this account formation as being unverified and inaccurate with you, and you have come back to me and stated you were able to verify this debt. How is this possible? Under the laws of the FDCPA, I have contacted the collection agency myself and have been unable to get them to respond or to verify that this is indeed my debt. After careful research, I have determined that this is not mine, and I was given no evidence of my obligation to pay this debt to this collection agency. The FCRA requires you to verify the validity of the item within 30 days or remove it. If the validity cannot be verified you are obligated by law to remove the item. There is a clear case of unverified debt here, and I demand that you delete this item before I am forced to take legal action. In the event that you can not verify the item pursuant to the FCRA, and you continue to list the disputed item which I have researched and determined does not belong to me, then I will find it necessary to sue you for actual damages and declaratory relief under the FCRA. According to this regulation, I may sue you in any qualified state or federal court, including small claims court in my own area. If you use this and the names are not deleted, send it again, but add this sentence: SECOND REQUEST TO REMOVE ERRONEOUS NAMES THAT DON’T BELONG TO ME.) Note: I added a nonsense sentence about phone numbers. Citizens’ phone numbers are not on a credit report. The purpose of this sentence is a strategic move to show you are sincere and that you aren’t using a professional credit repair service or a template. I do not believe this is accurate, because my own accounting shows that I was not late <add date if desired>. Under the Fair Debt Collection Protection Act, I have the right to request that incorrect and unverified information be deleted from my credit file. Accordingly, delete <90 day late or whatever you want them to delete> immediately, because my credit is important to me and this is unfairly penalizing my credit score. I would like to maintain a good relationship with <company name>, so I will appreciate your cooperation in getting this fixed in a timely manner. Sincerely, <Type your name> #11 (Send this letter to the credit bureau after you have settled an account “paid as agreed.” Ideally, you want the creditor to report it to the bureaus for you, but since you cannot trust that they will do so, here is a letter you can use. This goes with Chapter 15. Be sure to read the chapter before doing this!) Credit Bureau PO Box City, State Zip Date Re: Account # Dear Credit Representative: I have discovered an inaccurate account on my credit report that is unjustly harming my score. The above account was not late; but in fact, PAID AS AGREED. Enclosed is copy of my check and a letter (or log), which is legal confirmation that the account was paid in full as agreed. This erroneous entry is negatively impacting my credit. I’m sure you are aware that the law requires that a credit report is 100 percent accurate. I look forward to a swift and amicable resolution with this negative entry deleted at once. Sincerely, <Type your name> Notes about the previous letter: If the credit bureau sent you the name of a creditor that reported your name incorrectly, then contact that creditor and get a letter from them on company letterhead as shown below. Then forward a copy of that letter to the credit bureau. That will do it! On the other hand, if the credit bureau did not provide you with that information, cut-andpaste to add this sentence to the above letter: It is a violation of the Fair Credit Reporting Act to report false information. Therefore, I demand that the incorrect spelling of my name be deleted. If you think you have evidence of another spelling belonging to me, promptly provide me with the name, telephone number, and address of the corresponding creditor, so I can get that corrected and follow up with you again. Otherwise, delete the other names now. ----To Whom It Concerns: We regret that we had on file the incorrect spelling of the name for our customer. Please correct his/her name as follows: Sincerely, #12 Sample Letter to Send to the Credit Bureaus If You Have Duplicate Accounts Credit Bureau PO Box City, State, Zip code Date Re: Account # <fill in number> Dear Credit Representative: This is a formal complaint about a duplicate collection account appearing on my credit report. This inaccurate reporting is penalizing me unfairly and illegally; and this is causing me distress as it is damaging my credit. Delete the account stated above immediately. It does not belong on my credit report as it is (1) inaccurate, (2) duplicate, and (3) outdated. I look forward to a swift and amicable resolution to this matter. Sincerely, Your name typed Letter #13 Letter to Creditor Requesting the Removal of an Unauthorized Inquiry Note from Carolyn: I strongly suggest that you either include a copy of the one page of your credit report that shows the inquiry or include a snippet of the inquiry. That way, it will prevent them from denying it or from saying, “There was no hard inquiry from us.” Also note that you should include a competitor they hate in the last sentence. Most banks dislike Wells Fargo, so you can use them unless you are writing to Wells; in that case, use Bank of America. (Or whatever bank is in your community.) <Creditor Name> <Creditor Address> <Date> Dear <Bank of America or creditor name>: I have been a customer of <creditor name> for X years, and I have always enjoyed the good customer service that you provide. However, upon checking my credit report recently, I was surprised to see a hard inquiry by <creditor name> on <date>. I did not authorize this inquiry, nor was I informed about it. As you might know, inquiries make up 10 percent of a person’s credit score, and my credit report indicates that one of the reasons my score is not higher is due to credit inquiries. Therefore, this unauthorized inquiry is harming my credit score —on illegal grounds. Please send notification to the credit bureaus <name bureaus that the inquiry appears on> and a duplicate copy to me to remove this inquiry. I am looking for this to be done in a timely manner in order to continue our good business relationship rather than switch to <Wells Fargo or other competing bank>. Previously, I disputed this inquiry as being mine and requested deletion accordingly. You responded by stating you were able to verify this inquiry. But how is that possible? 1) I did not apply for credit from <company> on <date>. 2) I did not receive nor was I denied credit from <company> on <date>. If you did, in fact, verify the validity, then send me the following: 1) The method you used to verify. 2) The name of the person who verified. 3) The contact info of the person who verified. If you do not send me the above items, then it is my right and your duty for this (erroneous) inquiry to be permanently deleted from my credit report! Include these 2 sentences if it is at least 20 people. Otherwise, you can delete it. There are 100 (change to correct # for your name) individuals named <First, Last Name> on LinkedIn alone!!! I do not want someone else’s inquiry on my credit report. I look forward to a swift reply stating this false inquiry has been deleted. Thank you in advance, First, Last Name #14 Sample Letter to Send to the Credit Bureaus to Delete a 90-day late payment if you did not receive satisfactory results after sending the Credit Investigation Form Credit Bureau PO Box City, State, Zip code Date Re: Account # <fill in number> Dear Credit Representative: This is a formal complaint about a 90-day late payment appearing on my credit report. I am aware that being 90 days late is significantly worse than being 60 days late, and my records do not show that I was 90 days late. This inaccurate reporting is penalizing me unfairly and illegally; and this is causing me distress as it is damaging my credit score. Promptly delete the 90-day late payment, as per the Fair and Accurate Credit Reporting Act. A credit report is supposed to be 100 percent accurate, not 98 percent accurate. I look forward to a swift and amicable resolution to this matter. Sincerely, <Your name typed> Letter 15: Letter to the credit bureau when a previously deleted account reappears on your credit report Name Address Date Dear <Credit Bureau> Representative: On <date>, you investigated the following collection account and determined that it did not belong to me; and thus, you deleted it from my credit report. (See attached verification.) Account # <fill in> Account name <fill in> Now, it has reappeared on my credit report, which is a violation of law. The Fair Credit Reporting Act states: “The information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate.” In addition: The consumer reporting agency is required to send the consumer written notification within five business days that the information has been reinserted and provide contact information for the company that furnished the information. And, they are required to “maintain reasonable procedures designed to prevent the reappearance in a consumer’s file, and in consumer reports on the consumer, of information that is deleted.” I was not notified within five days (or at all). Nor was I given the opportunity to explain that this does not belong to me. Per law, delete this immediately and permanently! Otherwise, I will be happy to file a claim and collect damages. By studying these, you can see examples of how you can take a template and customize it for yourself. Please notice that these letters do not go overboard in telling too much. Don’t fall into that trap! But do use these to help guide your own customization. As in the first letter, you can do a Google search of your name and then use that information in the dispute. If you have a common name, that strategy might work for you as well. If you have a unique name that no one else in the country has, then it won’t apply to you. There are 25 individuals with my same name on LinkedIn alone, not to mention non-professionals, the dead, and the notorious Paul Mxxxx (last name deleted to preserve the individual’s privacy) who is serving jail time. Needless to say, I am concerned about my identity and good name! Please remove this erroneous account from my credit file, per the Fair Credit and Accuracy Act, because it is hindering my ability to get the best credit score and best financing. Sincerely, Paul Mxxxxx <Verizon bill dispute> Your Name Your Address City, Sate Zip Credit Bureau Address City, State Zip Date Regarding Account # _________________ Dear Credit Representative: I recently reviewed my credit report and was dismayed to see an inaccurate and false account regarding my previous cell phone. Evidently, when I changed carriers from Verizon to my current carrier, they made a reporting error. I always paid on time as agreed. My credit is very important to me, and a review of my report shows that I am in the habit of maintaining perfect credit. There is no reason I would sacrifice my good credit for a small end-of-contract bill! I have a fairly common name, so I am concerned that someone else’s information might be showing up on my report. This inaccurate charge-off is a violation of FACTA and it is hindering my ability to obtain the best financing. Please delete this account immediately. This demand is within my rights under Federal law. Re: Aurora Loan Services #360000 Countrywide Home Loans #4190000 Dear Credit Bureau Representative: This letter is a formal complaint that you are reporting mortgage lates that never happened on my credit report. According to The Fair Credit Reporting Act, inaccurate information cannot be included on a credit report when it is damaging to the individual. On 11/13/2008, I was denied for a refinance by Shelter Mortgage/Guaranty Bank based on the false information you are reporting. Explanation: When I purchased my home, my loan was rapidly sold three times to three lenders, including Aurora and Countrywide. I made my payment on time each and every month, but because of the loan transfers, my payments were not properly recorded. Then to further mess things up, Countrywide put one of my payments toward extra principle balance and reported me late on top of it! I immediately called Countrywide and they apologized and assured me they would take care of it and correct all the errors. I thought it had been done, so I was stunned to discover on 11/13/2008 that the false late payments were still there. Please delete these immediately! This is negatively impacting my life as it is prohibiting me from refinancing—and my current loan has just adjusted!
