Portfolio Project Directions and Rubric
This Portfolio Project is worth 35% of your grade

Completing this Assessment will help you to meet the following:

Deadline
Deliverable items for the Portfolio Project will be required at different points during the course.
Details for each submission are included below in the Deliverable Descriptions.
In each week, use the information from the emails and the research materials you are given to
prepare the documents outlined below. All deliverables should be in the following format: 12 point
Times New Roman or Arial font, one inch margins, and double spaced. Edit your work for spelling
and grammar and use proper legal citations pursuant to The Bluebook. Please refer to the grading
rubric for each deliverable for specific grading criteria.
Purpose of Assessment
Bryant & Stratton College is committed to your personal, academic, and professional success. PLEG
120 is a foundational course for the Paralegal Studies Program in which students are immersed in the
field of civil litigation and related topics. The purpose of this Portfolio Project is to give you real
world experience as a future paralegal and to aid in building your employability portfolio.
Your portfolio is intended to be a place where you collect your work and demonstrate your
achievements; a place where you can showcase your intellectual growth and career readiness through

the compilation of various pieces of work you have accumulated throughout your degree program.
By the time you complete the Paralegal Studies Program, included in your portfolio will be a
narrative, a professional marketing plan, job seeking documents (resume, cover letter, and
references), evidence of program specific knowledge and learning, and life-long learning competence.
Building the portfolio throughout your academic career will allow you to set goals, establish a plan
for growth, and stay on course for graduation and life-long learning achievements. The Portfolio
Project for PLEG 120 was designed to not only to give you a thorough and practical introduction to
the field of civil litigation, but also to provide you with a number of pieces of work that you can
include in your portfolio.
Directions
For this Portfolio Project, you are being placed into a hypothetical situation in which you are working
as a paralegal at a law firm and are working closely with an attorney on a personal injury case. As
you would in practice, you will be following this case through to trial and working on various
projects for the Managing Partner during the course of this session.
There are five (5) separate parts to this Portfolio Project, each with a separate submission deadline.
Carefully review all project directions closely and contact your instructor with any questions.

Week 3: Part 1 Directions - Interview Memo to the Managing Partner


Scenario: You are working as a paralegal at the law firm of Chase & Chase P.C. Knowing that you
recently have graduated with your degree in Paralegal Studies and that you have taken a course
specifically in civil litigation, the Managing Partner has sent you the following email for your
assistance on a project regarding a potential new client.

(“Office-Mart”). Office-Mart is a national, office supply store that does business in this state and
throughout the country. According to Mrs. Henderson, two winters ago she was entering an Office-Mart

Mrs. Henderson claims to have suffered a number of injuries as a result of her accident, but we did not get
into much detail over the telephone.
Mrs. Henderson will be coming into the office next week to meet with me and I would like you to not only
sit in on the meeting, but also help me prepare. In that regard, I need you to prepare a list of at least
twenty questions that I should address with Mrs. Henderson in order to determine whether we should take
this case. Specifically, I need you to prepare a list of at least twenty questions that will enable us to:




Identify any ethical concerns (such as potential conflicts of interest);
Identify any procedural concerns (such as the statute of limitations);
Identify any legal concerns (such as jurisdiction and venue)
Conduct a factual and legal evaluation of the case to determine whether there is a likelihood of
success.

Scenario: It has been two weeks since you and the Managing Partner at Chase & Chase, P.C. met
with Mrs. Henderson when you receive the below email.

After our meeting with Bella Henderson, I reviewed my notes and conducted some legal research in order
to determine whether there is any merit to Mrs. Henderson’s case and, by extension, whether we should
take the case on. Unfortunately, with a trial beginning next week I simply do not have the time to devote to
this. Since you already are familiar with the case, I would like your continued assistance.
Two years ago in January, Mrs. Henderson was entering the Office-Mart store located at 7272 Thomas
Drive when she slipped on a patch of “black ice” on the sidewalk right in front of the store. Although it had

snowed earlier that day, the parking lot had been plowed and the sidewalk shoveled. After Mrs. Henderson
fell, the Store Manager came outside to attend to her, and she heard the manager (whose name she did
not get) yell “James, I thought I told you to get that salt out here two hours ago!” Mrs. Henderson filled out
an accident report, but was never given a copy.
Mrs. Henderson suffered a bi-malleolar fracture of the right ankle as a result of the accident. The fracture
was severe enough to require surgery that included the insertion of plates and screws into her right ankle.
Mrs. Henderson has extensive medical bills (she does not know how much) and has missed a significant
amount of time from work. She is a pediatric nurse at Children’s Hospital. Mrs. Henderson indicates that
her treating orthopedic surgeon is uncertain about what will be the full extent of her recovery. She
continues to suffer significant pain and limitation of range of motion in her right ankle. Her surgeon is
unsure whether she will ever be restored to 100% of her pre-accident level of physical health. It also is
possible that she will require future surgery.
I have researched the law and have located three relevant sources. Please review and analyze these
sources, apply them to the facts I have outlined above and draft a predictive memo to me in which you
apply the law I have given you to the facts outlined above in order to make a prediction about whether Mrs.
Henderson is likely to prevail in court. DO NOT CONDUCT ANY EXTERNAL RESEARCH.



Scenario: After reviewing your Predictive Memo, the Managing Partner decided to take on
Mrs. Henderson’s case. Because of the good work you have done on the case thus far, the Managing
Partner has opted to continue to have you work on the case through to conclusion (trial).
It has been eight months since you and the Managing Partner first met with Mrs. Henderson and six
months since litigation was commenced against Office-Mart with the filing of the complaint that you
prepared. Your firm presently is in the middle of discovery on the case when you receive the below
email from the Managing Partner about a motion that needs to be drafted and filed relative to a
discovery dispute.

Scenario: It has been 6 months since the motion to compel that you drafted was argued and granted
by Judge Scolaro. Discovery has been completed and the defendant’s motion for summary judgment
has been denied. That means Mrs. Henderson’s case is going to trial! You are working at your desk
one afternoon when you receive the below email from the Managing Partner.

with your Midterm Exam and Final Exam into one Word document. Incorporate instructor feedback,
make any additional corrections, and submit to your ePortfolio.

your Reflection, include an Introduction and Conclusion, and address the following items:
1. Reflect on and assess the value of what you have learned through the completion of this
project.
2. Explain how you believe you could apply what you learned in order to become more
successful in the workforce.
3. Identify how your thought process may have changed as a result of working on this project
and explain how.
4. Describe what you might do differently if asked to complete similar projects in the future and
explain why.
5. Describe what advice you would give to a student who is just beginning this project.
6. Identify what program outcomes you believe were fulfilled by this project and justify your
