These are being gender and culturally sensitive and caring for the environment. As these topics may not be new to all of you, but the challenge in this module is how to concretize our knowledge of these topics, and embed these to our very own personalities and personhood. A On Gender and Development Topic Learning Outcome Discuss the concept and legalities of gender and sensitivity in the Philippine Context Express commitment for gender sensitivity The Magna Carta of Women (Republic Act No. 9710) defines Gender and Development Program (GAD) as the development perspective and process that is participatory and empowering, equitable, sustainable, free from violence, respectful of human rights, supportive of selfdetermination and actualization of human potentials. It seeks to achieve gender equality as a fundamental value that should be reflected in development choices and contends that women are active agents of development, not just passive recipients of development. GAD focuses on Gender Mainstreaming or a strategy for: • Making women’s as well as men’s concerns and experiences an integral dimension of the design, implementation, monitoring, and evaluation of policies, programs and projects in all social, political, civil, and economic spheres so that women and men benefit equally. • Assessing the implications for women and men of any planned action, including legislation, policies or programs in all areas and at all levels 4 Updated February 2022 Republic of the Philippines PHILIPPINE STATE COLLEGE OF AERONAUTICS INSTITUTE OF LIBERAL ARTS AND SCIENCES The Gender and Development paradigm in the Philippine context was discussed and stipulated in the The Philippine Plan for GenderResponsive Development (1995-2025) The PPGD lays out development goals and strategies that will make gender equity innate in public programs and policies. This 30-year perspective plan ensures that women-friendly policies can take root and flourish despite the barriers posed by traditional attitudes and stereotyping. For instance, Equal Employment Opportunity also becomes a mandate in line with promoting the equality to all Filipinos, which also included the indigenous people and person with disabilities. Below are related laws for every Filipino to know regarding Women’s Rights: 105-Day Expanded Maternity Leave Law Signed into law on February 2019 by President Rodrigo Duterte, Republic Act 11210 or the Expanded Maternity Leave Law extends the previous 60-day (78 days for caesarian section delivery for women workers in the private sector) paid maternity leave to 105 days. The law also entails an option to extend for an additional 30 days of unpaid leave. Additional 15 days paid maternity leave shall also be granted to female solo parents. Prohibition on Discrimination Against Women RA 6725 prohibits discrimination with respect to terms and conditions of employment solely on the basis of sex. Under this law, any employer favoring a male employee over a female in terms of promotion, training opportunities, and other benefits solely on account of sex is considered discrimination. Anti-Violence Against Women and Their Children Act of 2004 RA 9262, or An Act Defining Violence Against Women and Their Children, Providing Protective Measures for Victims, Prescribing Penalties Therefor and for Other Purposes, recognizes the need to protect the family and its members particularly women and children, from violence and threats to their personal safety and security. RA 7882, or the act that states the Provision of Assistance to Women Engaging in Micro and Cottage Business Enterprises, and for other purposes, was approved in February 1995. Anti-Sexual Harassment Act of 1995 RA 7877 addresses the issue of sexual harassment committed in employment, education or training environment. It was signed into law on February 14, 1995, under former President Fidel Ramos' administration. Sexual favors made as a condition in the employment or granting promotions or privileges; or the refusal to grant the sexual favor results in limiting, segregating or classifying the employee which in any way would discriminate, deprive or diminish employment opportunities or otherwise adversely affect is punishable by law. The Anti-Rape Law of 1997 RA 8353 states that any person having carnal knowledge of a woman through force, threat, or intimidation or by means of fraudulent machination or grave abuse of authority will be punished. Depending on the severity of the case, the offense may be punishable reclusion perpetual or life imprisonment. 7 Updated February 2022 Republic of the Philippines PHILIPPINE STATE COLLEGE OF AERONAUTICS INSTITUTE OF LIBERAL ARTS AND SCIENCES Rape Victim Assistance and Protection Act of 1998 RA 8505 declares the policy of the State to provide necessary assistance and protection for rape victims. The government shall coordinate its various agencies and nongovernment organizations to work hand in hand for the establishment and operation of a rape crisis center in every province and city that shall assist and protect rape victims in the litigation of their cases and their recovery. Magna Carta of Women RA 9710 is a comprehensive women's human rights law that seeks to eliminate discrimination through the recognition, protection, fulfillment, and promotion of the rights of Filipino women, especially those belonging in the marginalized sectors of the society. It conveys a framework of rights for women based directly on international law. Pursuant to this law is Executive Order 273 that states the approval and adoption of Philippine Plan for Gender-Responsive Development, 1995-2025. National Women's Day RA 6949 declares the eighth day of March every year as a special working holiday. Just a Thought: If only these laws are properly implemented, enforced and followed, then, a more humane Philippine society would be at hand. Caring for our Environment While we promote gender sensitivity, it is also our task as PhilSCAn to care for our environment. Needless to say, Mother Nature has her own life. We are already experiencing the wrath of nature as calamities have pounded us for the last decades. Flood, volcanic eruption. earthquake, drought, among others, brought so much destructions and devastations. Natural calamities cannot be avoided. Hence, causing nature to be catastrophic must be avoided. It was construed that mankind itself ahs caused nature to act unpredictably. For instance, climate change is an effect of the continuous damage of the ozone layer due to carbon dioxide emissions. Most flash floods were caused by depleted forest and earthquakes cause more damage because if sub-standard structures built by men. Again, to care for environment is not a new topic. In fact, in today’s generation, becoming pro-environment has been integrated in the basic curriculum. BUT, the greatest challenge is still at hand. Why are Filipinos continuously acting like gods in terms of abusing nature and environment? 9 Updated February 2022 Republic of the Philippines PHILIPPINE STATE COLLEGE OF AERONAUTICS INSTITUTE OF LIBERAL ARTS AND SCIENCES To note, there were about 118 “pro-environment ” laws that have been crafted and approved which was derived frm the 1987 Constitution. Some these are: REPUBLIC ACT 9003 ECOLOGICAL SOLID WASTE MANAGEMENT ACT OF 2000 In partnership with stakeholders, the law aims to adopt a systematic, comprehensive and ecological solid waste management program that shall ensure the protection of public health and environment. The law ensures proper segregation, collection, storage, treatment and disposal of solid waste through the formulation and adaptation of best eco-waste products REPUBLIC ACT 9275 PHILIPPINE CLEAN WATER ACT OF 2004 The law aims to protect the country's water bodies from pollution from land-based sources (industries and commercial establishments, agriculture and community/household activities). It provides for comprehensive and integrated strategy to prevent and minimize pollution through a multi-sectoral and participatory approach involving all the stakeholders. 10 Updated February 2022 Republic of the Philippines PHILIPPINE STATE COLLEGE OF AERONAUTICS INSTITUTE OF LIBERAL ARTS AND SCIENCES REPUBLIC ACT 8749 PHILIPPINE CLEAN AIR ACT OF 1999 The law aims to achieve and maintain clean air that meets the National Air Quality guideline values for criteria pollutants, throughout the Philippines, while minimizing the possible associated impacts to the economy. REPUBLIC ACT 6969 TOXIC SUBSTANCES, HAZARDOUS AND NUCLEAR WASTE CONTROL ACT OF 1990 The law aims to regulate restrict or prohibit the importation, manufacture, processing, sale, distribution, use and disposal of chemical substances and mixtures the present unreasonable risk to human health. It likewise prohibits the entry, even in transit, of hazardous and nuclear wastes and their disposal into the Philippine territorial limits for whatever purpose; and to provide advancement and facilitate research and studies on toxic chemicals. PRESIDENTIAL DECREE 1586 ENVIRONMENTAL IMPACT STATEMENT (EIS) STATEMENT OF 1978 The Environment Impact Assessment System was formally established in 1978 with the enactment of Presidential Decree no. 1586 to facilitate the attainment and maintenance of rational and orderly balance between socioeconomic development and environmental protection. EIA is a planning and management tool that will help government, decision makers, the proponents and the affected community address the negative consequences or risks on the environment. The process assures implementation of environment-friendly projects. ASSESSMENT / OUTPUT FOR MODULE 8 Creative Commitment Statement The purpose of the creative commitment statement is to express one’s personal commitment to GAD and Environment. To be creative, this commitment must be specific, measurable, attainable, and time-bound. Follow the mechanics below: 1. Form a small group with 4 to 5 members. (IF IT IS EASIER TO HAVE JUST A PRTNER, THEN DO SO) 2. Come up with a group’s (OR PARTNERSHIP NAME) name based from the purpose of the commitment, 3. Compose individual commitment statement. This can be ideal and theoretical. 4. After composing individual commitment statement, the group decides for a specific action that will be implemented on a specific date in the year 2025. The specific action MUST be anchored from the topics discussed int his module. 5. The group decides the exact schedule for the implementation of the plan. (Month and date) 6. The group prepares an advertisement –type virtual poster of the plan.
