Constitution of The Hong Kong Polytechnic University Students’ Union Chapter 1: General Each chapter contained herein interrelates with each other and the interpretation thereof shall be subject to the integral concept of the Constitution. 1.1 Name: The Union shall be named as “The Hong Kong Polytechnic University Students’ Union (H.K.P.U.S.U.)” (hereinafter referred to as “the Union”). (Amended GM1 of 1999) 1.2 Structure: The main associations and decision-making forms of the Union include: 1.3 1.4 1.2.1 Referendum (Amended GM2 of 2003) 1.2.2 General Meeting (Added GM2 of 2003) 1.2.3 Union Council 1.2.4 Union Judicial Council 1.2.5 Executive Committee 1.2.6 Press Committee 1.2.7 Campus Radio (Added GM1 of 2015) 1.2.8 Faculty/School Students’ Association (Amended GM1 of 2017) 1.2.9 Affiliated Associations Purposes: 1.3.1 Promote spirit of utility, cooperation and democratic autonomy. 1.3.2 Strive for welfare and safeguard interest of members. 1.3.3 Broaden the horizons in academy, culture and ideology of members. 1.3.4 Communicate with the University and the external organizations. 1.3.5 Cultivate the social consciousness and social responsibility of members. 1.3.6 Confront with social issues and promote the social development. Authority: The Union shall be the only association representing all students of the Hong Kong Polytechnic University (other than students withdrawing from the Union). (Amended GM1 of 1997; GM1 of 2020) -1- Constitution of The Hong Kong Polytechnic University Students’ Union 1.5 Year: The Union year commences from 1st March and ends on the last day ofFebruary of the following year. (Amended GM1 of 2000; GM2 of 2001) 1.6 Address: Shaw Amenities Building, The Hong Kong Polytechnic University, Hung Hom, Kowloon, Hong Kong. (Amended GM1 of 2005) 1.7 Legal languages: Chinese and English. 1.8 Conflicts: In the event of any dispute or misunderstanding as to the interpretation of the language or terms of the Constitutions, By-laws and any Rules of the Union,the Chinese language version shall prevail. (Added GM1 of 2020) Chapter 2: Members 2.1 Ordinary members: all students of the Hong Kong Polytechnic University (other than inbound exchange students, postgraduates and students withdrawn from the Union); excluding those with privileges suspended, hereinafter referred to as “the Members”. (Amended GM1 of 1997; GM1 of 2020) 2.2 Associate members: all postgraduates and inbound exchange students, upon settlement of annual subscription fee, shall become an associate member of the Union. (Added GM1 of 2020) 2.3 Honorary members: persons who once made specific contribution to the Union or obtained outstanding achievements in the society and shall be granted with permanent honor by the Union Council, provided that such members shall not be entitled to the rights of the full members. 2.4 Rights: 2.4.1 All ordinary members shall be entitled to the following rights: 2.4.1.1 to attend all General Meetings and the Union Council Meetings. 2.4.1.2 of speech and vote at a General Meeting and the voting right in a Referendum. 2.4.1.3 to run for election. 2.4.1.4 to assume any post of the Union in accordance with the regulations of the Union. (Added GM1 of 2020) 2.4.1.5 of nomination, seconding and voting in election. 2.4.1.6 to participate in the affiliated associations of the Union. 2.4.1.7 to use all facilities of the Union in accordance with the regulations of the Union. -2- Constitution of The Hong Kong Polytechnic University Students’ Union 2.4.2 2.5 to participate in any activity of the Union. (Amended GM1 of 1998; GM1 of 2020) 2.4.1.9 to be entitled to all interests granted by the Union Council. 2.4.1.10 to withdraw from the Union in accordance with the regulations of the Union. (Added GM1 of 1999) Except from clause 2.4.1.2 to 2.4.1.5 above, all associate members shall be entitled to hold all other rights as ordinary members. (Added GM1 of 2020) Obligations: 2.5.1 2.5.2 2.6 2.4.1.8 All ordinary members and associate members shall: (Amended GM1 of 2020) 2.5.1.1 comply with the Constitution, By-law and any rules of the Union. 2.5.1.2 comply with all resolutions approved in a Referendum, a General Meeting and the Union Council Meeting and verdicts of the litigation meetings of the Union Judicial Council. The honorary members shall comply with the Constitution of the Union. Suspension of Privileges (Added GM1 of 2017) Any member who fails to pay the membership subscription shall be suspended from any or all privileges of membership of the Union automatically. All privileges shall be resumed once whom has paid for the subscription. Chapter 3: Honorary Seats 3.1 The Union Council shall invite the honorary sponsors of the Union. 3.2 The Union Council shall invite the vice honorary sponsors of the Union. 3.3 The Union Council shall invite the President of the Hong Kong Polytechnic University as the Honorary President of the Union. 3.4 The Union Council shall invite the Deputy President of the Hong Kong Polytechnic University as the Vice Honorary President of the Union. 3.5 The Union Council shall invite honorary auditor(s). 3.6 The Union Council shall invite honorary legal advisor(s). 3.7 The Union Council shall invite a staff of the University as the honorary treasurer of the Union. (Amended GM1 of 2020) -3- Constitution of The Hong Kong Polytechnic University Students’ Union 3.8 The Union Council shall invite honorary advisors. 3.9 The term of office of every honorary seat commences from the date when relevant person accepts the invitation and ends at the first meeting of the Union Council in the following session. Chapter 4: Referendum 4.1 Referendum: A Referendum shall be conducted by all Union members on basis of secret vote. 4.2 A Referendum shall be the supreme decision-making authority of the Union. 4.3 With a written request of one-twentieth of the Union members or as deemed necessary by the Union Council Meeting or the Executive Committee, Union Council shall convene a meeting to appoint one (1) meeting member and conduct a Referendum within fifteen (15) working days. (Amended GM1 of 2017) 4.4 The notice of Referendum shall be posted on the notice board of the Union seven (7) working days thereto. 4.5 The voting time shall be at least eight (8) hours and all members shall vote directly. 4.6 The vote counting shall be conducted within twenty-four (24) hours after the voting. 4.7 During the vote counting, the staff of the University shall be the scrutineer to supervise the vote counting. 4.8 A Referendum shall take effect only with the voting of one-tenth or more of the Union members and the vote abstention less than half of the total votes. 4.9 Where without complaints, the voting results shall be formally announced by the Chairperson of the Union Council within two (2) working days after the vote counting. 4.10 In case of any complaint about a Referendum, a written proposal shall be filed to the Union Council within two (2) working days after the vote counting. The Union Council shall convene an extraordinary meeting for decision-making withinfive (5) working days after such complaint. 4.11 The voting results shall not be announced by the Union Council formally prior to the settlement of the complaint. (Amended GM1 of 2020) 4.12 A Referendum shall be not applicable to the settlement of the resolutions that violate or conflict with the Constitution of the Union. -4- Constitution of The Hong Kong Polytechnic University Students’ Union Chapter 5: General Meeting 5.1 The authority of a General Meeting shall only be inferior to the decision-making authority of a Referendum. 5.2 A General Meeting comprises all members of the Union. 5.3 The Chairperson thereof shall be assumed by the Chairperson of the Union Council. In case of the absence of the Chairperson, the Vice Chairperson of the Union Council shall provisionally assume the post thereof. In case of the absence of the abovementioned two persons, the President of the Union shall assume the Chairperson of the Meeting until a new decision shall be made. 5.4 The Secretary of the Meeting shall be assumed by the Secretary of the Union Council. In case of the absence of the Secretary, the Vice Secretary shall provisional assume the post thereof. In case of the absence of the abovementioned two persons, the Meeting shall select a member as the provisional Secretary. 5.5 The Vice Secretary of the Meeting shall be assumed by the General Secretary of the Executive Committee. 5.6 Where the Union Judicial Council, the Union Council meeting orthe Executive Committee meeting deems necessary and approves, or with a written request of more than one-twentieth of the members, the Chairperson of the Union Council shall convene a General Meeting to handle certain specific affairs within ten (10) working days, and other issues shall not be discussed in the Meeting. (Amended GM1 of 2020) 5.7 The notice and agenda of the Meeting shall be posted on the notice board of the Union seven (7) working days thereto. 5.8 The quorum of the Meeting shall be at least one-tenth of all Union members. 5.9 In case that the number of attendants shall be still less than the quorum half an hour after the official meeting time, the Chairperson shall declare aborting the convention of the Meeting. 5.10 The Chairperson of the Union Council shall reconvene the Meeting within ten (10) working days after the declaration of abortion. 5.11 The quorum of the reconvened meeting due to resumption and abortion shall be at least one-twentieth of the members. (Amended GM1 of 2017) 5.12 The quorum of each adjourned meeting shall be half of the meeting thereof, with at least one-eightieth of the members. (Added GM1 of 2017) -5- Constitution of The Hong Kong Polytechnic University Students’ Union 5.13 In respect of the meeting reconvened due to resumption or abortion, the notice thereof shall be posted on the notice board of the Union within three (3) working days prior to the meeting. 5.14 The Secretary of the Union Council shall be responsible for the minutes of themeeting, which shall be read out and approved at the Union Council Meeting and posted on the notice board of the Union within one (1) month after the meeting. (Amended GM1 of 2017) Chapter 6: Union Council 6.1 Definition: The Union Council shall be the authority responsible for all supervision and legislation affairs of the Union. 6.2 The authority of the Union Council shall be only inferior to a General Meeting. 6.3 Authorities: 6.4 6.3.1 Formulate the By-law of the Union and amend the Constitution of the Union in accordance with the Constitution of the Union. 6.3.2 Supervise and guide the work of organizations of the Union. (Amended GM2 of 2001) Duties: 6.4.1 Perform all duties described herein. 6.4.2 Be entitled to make decision on the financial affairs of the Union. 6.4.3 Establish and dissolve any Standing Committee. 6.4.4 May establish Select Committee(s). 6.4.5 Review and confirm regulations and authority scope of organizations affiliated to the Union. 6.4.6 Shall be entitled to accept or abolish the “affiliation” or “exempt from being affiliated” of any organizations to the Union. 6.4.7 All external affairs of all organizations of the Students’ Union shall be reported to the Union Council. (Amended GM1 of 1997) 6.4.8 Process the resignation of the directly elected councilors of the Union Council, the Executive Committee members, the Press Committee members and the Campus Radio members. (Amended GM1 of 2015) 6.4.9 The external affairs and the University administration affairs of the Students’ Union Executive Committee, where approved by the Chairperson -6- Constitution of The Hong Kong Polytechnic University Students’ Union of the Union Council, shall be ratified by the Union Council. Except the abovementioned organizations, the external affairs of all organizations of the Students’ Union shall not be ratified. (Added GM1 of 1997. Amended GM1 of 1999) 6.5 6.4.10 At a Union Council Meeting, where two-thirds or more of the attendants with voting right of the Union Council vote in favor, the regretful proposal of any member (including: the Executive Committee member, the directly elected councilor of the Union Council, the Press Committee member and the Campus Radio member) may be approved. Where necessary, the Union Council may even convene a General Meeting to decide to vote forno confidence in such Executives or members. (Amended GM1 of 1997; GM1 of 2015) 6.4.11 When two-thirds or more of the attendants with voting right vote in favor, the Executives and members of any organization of the Union (other thanthe Executive Committee members, the directly elected councilors of the Union Council and the directly elected members of Press Committee and Campus Radio) may be voted for no confidence. (Amended GM1 of 2015) 6.4.12 The Union Council may require any member to provide relevant materials of a certain affair, where such member shall be notified three (3) working days in advance in written. 6.4.13 May decide to establish or dissolve the Standing Departments subordinate to the Executive Committee at the Annual Meeting of the Union Council. Members: 6.5.1 One Chairperson. 6.5.2 One Vice Chairperson. 6.5.3 One Secretary. 6.5.4 President of the Students’ Union Executive Committee. 6.5.5 Six Executives of the Executive Committee. 6.5.6 The Editor-in-Chief and one of the generally elected members of the Press Committee. (Amended GM1 of 2017) 6.5.7 The President and one of the generally elected members of the Campus Radio. (Added GM1 of 2015. Amended GM1 of 2017) 6.5.8 Representatives of the Faculty/School Students’ Associations. (Amended GM1 of 2006) -7- Constitution of The Hong Kong Polytechnic University Students’ Union 6.5.8.1 Every Faculty/School Students’ Association shall select and appoint representatives at a proportion of one-eight-hundredth of the total number of members. 6.5.8.2 The Faculty/School Students’ Association with the total member number of less than eight hundred but more than four hundred shall be deemed as eight hundred and shall appoint one representative. 6.5.8.3 Every Faculty/School Students’ Association may appoint at most three and at least one representative. (Amended GM1 of 2005) 6.5.8.4 The representatives of every Faculty/School Students’ Association shall include the Chairperson of the Faculty Council or the President of the Faculty Executive Committee. (Amended GM1 of 2005) 6.5.8.5 The selection and appointment means of representatives may be at the own discretion of the Faculty/School Students’ Association. 6.5.9 Representatives of the Affiliated Clubs: Every affiliated club shall select a person from its subdivisions as a representative. The representative must be an Executive from one of subdivisions. There shall be four representatives in total. 6.5.10 Directly elected councilor: 6.5.10.1 The directly elected councilors shall be selected by every Faculty/School Students’ Association at a proportion of one eighthundredth of the total members. 6.5.10.2 The Faculty/School Students’ Association with the total member number of less than eight hundred but more than four hundred shall be deemed as eight hundred and shall select one representative. 6.5.10.3 Every directly elected representative shall be elected at the Annual Election of the Students’ Union. (Amended GM1 of 2008; GM1 of 2010) 6.5.10.4 There shall not be more than two (2) directly elected councilors in the same department. (Amended GM2 of 2001) 6.5.11 Statutory Observer: 6.5.11.1 All Executives of the Executive Committee who shall be not the representatives of the Union Council shall be the statutory observers. 6.5.11.2 Two Executives of every Faculty/School Students’ Association. 6.5.11.3 The Chairperson of every Standing Committee and one member appointed thereby. (Amended GM1 of 1997) 6.5.11.4 One Secretary of the meeting. -8- Constitution of The Hong Kong Polytechnic University Students’ Union 6.5.11.5 The President of the Union in the previous session (still being the Union member). 6.5.11.6 The Chairperson of the Union Council in the previous session (still being the Union member). 6.5.11.7 The Vice Chairperson of the Union Council in the previous session (still being the Union member). 6.5.11.8 The Editor-in-Chief of the Press Committee in the previous session (still being the Union member). 6.5.11.9 The President of the Campus Radio in the previous session (still being the Union member). (Added GM1 of 2015) 6.5.11.10 Two members appointed by the Union Judicial Council. 6.6 6.7 6.8 6.9 Chairperson of the Union Council: 6.6.1 Handles all administrative routines of the Union Council during adjournment. 6.6.2 Convenes and hosts all Union Council meetings and the General Meeting. 6.6.3 (Repealed GM1 of 2017) 6.6.4 Hosts the Internal Affairs Coordination Conference of the Union Council in case of absence or resignation of the Vice Chairperson. (Added GM1 of 1997. Amended GM1 of 2017) Vice Chairperson of the Union Council: 6.7.1 Assists in handling all administrative routines of the Union Council. 6.7.2 Assumes the position of Acting Chairperson or sub-Chairperson in case of absence or resignation of the Chairperson. 6.7.3 Hosts the Internal Affairs Coordination Conference of the Union Council. (Added GM1 of 1997) Secretary of the Union Council: 6.8.1 shall be responsible for the minutes of all Union Council Meetings and the General Meeting. 6.8.2 shall handle all paperwork of the Union Council. The Chairperson, the Vice Chairperson and the Secretary shall be publicly nominated by members but shall be elected at the annual meeting. The term of office thereof shall commence from the end of the annual meeting in the current session and end at the end of annual meeting of the following year. 6.9.1 By-Election: -9- Constitution of The Hong Kong Polytechnic University Students’ Union In case that Chairperson, Vice Chairperson or Secretary shall be vacant, as required by any Union member, the Election Committee of the Union Council shall restart the nomination period of two (2) weeks. The by-elected post(s) shall be publicly nominated by the Union members, handled at an Extraordinary Meeting, with the quorum thereof being two-thirds or more of the Councilors with voting right of the Union Council. The term of office expires at the end of the annual meeting in the following year. (Added GM1 of 1998. Amended GM2 of 2003; GM1 of 2006; GM1 of 2017) 6.9.2 The by-elected Chairperson, Vice Chairperson and Secretary shall be entitled to all authorities of such posts elected officially, and shall perform all duties of the posts elected officially. (Added GM1 of 1998) 6.10 Directly elected councilor: The directly elected councilor shall be elected at the Annual Election. The term of office thereof shall be the same as that of every Faculty/School Students’ Association (from 1st March of the year of the Union to the last day of February in the following year). (Amended GM1 of 1997; GM2 of 2001; GM1 of 2006) 6.11 Rights to Vote and Speak: 6.12 6.11.1 Except the statutory observers, all members shall have the rights to vote, speak, propose and second at a meeting. 6.11.2 The statutory observers shall only be entitled to the right to speak, propose and second but no right to vote at a meeting. 6.11.3 The person who fails to attend the Union Council Meeting for more than three (3) times, including the Union Council Meeting and the resumption to convene a meeting thereof (annual meeting and the resumption to convene a meeting thereof shall be calculated respectively) and without prior notice and reasonable explanations, the Union Council shall be entitled to freeze the right of such person to attend meetings, until otherwise decided by the Union Council Meeting. (Amended GM1 of 1999) Meeting: 6.12.1 Ordinary Meeting and Extraordinary Meeting. (Amended GM1 of 1997) 6.12.1.1 The Ordinary Meeting of the Union Council shall be convened at least once every three (3) months. 6.12.1.2 (Repealed GM2 of 2001) 6.12.1.3 In case that the Executive Committee or no less than one-quarter of the Union Council members with voting right require handling certain specific issue, the Chairperson of the Union Council shall convene an - 10 - Constitution of The Hong Kong Polytechnic University Students’ Union Extraordinary Meeting to handle such issues within seven (7) working days. (Amended GM1 of 2017) 6.12.1.4 Meeting materials shall be distributed to the Councilors twenty-four (24) hours prior to the meeting. (Added GM2 of 2001) 6.12.1.5 Other issues shall not be discussed at an Extraordinary Meeting. 6.12.1.6 The notice and agenda of an Ordinary Meeting shall be posted on the notice board of the Union five (5) working days prior thereto. (Amended GM1 of 1999) 6.12.1.7 The notice and agenda of an Extraordinary Meeting shall be posted on the notice board of the Union three (3) working days prior thereto. (Added GM1 of 1999) 6.12.1.8 Quorum of Meetings: 6.12.1.8.1 The quorum of meetings shall be half of the Union Council members with voting right. 6.12.1.8.2 In case that the number of attendants shall be still less than the quorum half an hour after the official meeting time, the Chairperson shall declare aborting the convention of the meeting and reconvene the meeting within ten (10) working days after such abortion. 6.12.1.8.3 The quorum of the meeting reconvened due to resumption or abortion shall be at least one-third of Union Council members with voting right. (Amended GM1 of 2017) 6.12.1.8.4 In respect of the meeting reconvened due to resumption or abortion, the notice of the meeting shall be posted on the notice board of the Union three (3) working days prior to the meeting. (Amended GM1 of 2017) 6.12.1.9 In case of absence, resignation or dismissal of the Chairperson of the Union Council at a meeting, the meeting shall be hosted by theVice Chairperson. To the extent of the same of the Vice Chairperson, the meeting shall be hosted by the President of the Union until new decision shall be made. 6.12.1.10 In case of absence, resignation or dismissal of the Secretary of the Union Council at a meeting, the post thereof shall be provisionally assumed by the General Secretary of the Union. To the extent of the absence of the General Secretary, one member shall be selected from the attendants to assume the Secretary. 6.12.1.11 The minutes of meetings shall be posted on the notice board of the Union within one (1) month after the meetings. - 11 - Constitution of The Hong Kong Polytechnic University Students’ Union 6.12.2 Annual Meeting 6.12.2.1 The Annual Meeting shall be convened by the Chairperson of the Union Council within one (1) month after the succession ofthe Executive Committee. 6.12.2.2 All Union Council members in the current session and the previous session shall attend the Annual Meeting. Such members shall become the members of the Annual Meeting only after registration to the Secretariat of the Union Council prior to the meeting. (Amended GM1 of 2006) 6.12.2.3 The quorum of every meeting (including resumption to convene a meeting) shall be more than half of members with voting right. 6.12.2.4 Rights to Vote and Speak: 6.12.2.4.1 Except the statutory observers, all Union Council members in the current and previous session (legal subject to the By-law for the Union Council) shall be entitled to vote, speak, propose and second for. (Amended GM1 of 1997) 6.12.2.4.2 At an Annual Meeting, the person assuming two posts with voting right may vote twice. 6.12.2.5 The notice and agenda of a meeting shall be posted on the notice board of the Union seven (7) working days prior thereto. 6.12.2.6 The notice of resumption to convene a meeting shall be posted on the notice board of the Union three (3) working days prior thereto. 6.12.2.7 The following issues shall be handled at an Annual Meeting: 6.12.2.7.1 Annual function report of the Executive Committee in the previous session. 6.12.2.7.2 Annual function report of the Press Committee in the previous session. 6.12.2.7.3 Annual function report and final financial report of the Campus Radio in the previous session. Amended GM1 of 2020) 6.12.2.7.4 Final financial report of the Union in the previous session. 6.12.2.7.5 Election of Chairperson, Vice Chairperson and Secretary of the Union Council. 6.12.2.7.6 Appointment of the Union Judicial Council members. (Amended GM1 of 1997; GM1 of 1998) 6.12.2.7.7 Year plan of the Executive Committee and master budget of the Union in the current session. - 12 - Constitution of The Hong Kong Polytechnic University Students’ Union 6.12.2.7.8 Year plan of the Press Committee in the current session. 6.12.2.7.9 Year plan and master budget of the Campus Radio in the current session. (Added GM1 of 2015; Amended GM1 of2020) 6.12.2.7.10 Establishment or dissolution of standing departments subordinate to the Executive Committee. 6.12.2.7.11 Circulation of annual function report and final financial report of the Faculty/School Executive Committee. 6.12.2.8 Issues other than the abovementioned shall not be processed. 6.12.2.9 In case that the Annual Meeting fails to be completed in the middle ten days of February, the Chairperson of the Union Council shall convene a meeting in the last ten days of February to declare the completion of the annual meeting of the current session. For unaccomplished issues, the Chairperson of the Union Council in the following session shall convene an Extraordinary Meeting to follow up relevant issues. In case of vacancy of the Chairperson of the Union Council, the Vice Chairperson shall take over; and in case of vacancy of the Vice Chairperson, the President ofthe Executive Committee shall follow up such issues. (Amended GM2of 2001) 6.12.2.10 In case that any issue related to the annual function reports of the Executive Committee of the previous two (2) sessions, the final financial reports of the Union of the previous two (2) sessions, the year plan of the Executive Committee of the previous session and the master budget of the Union of the previous session fail to be settled, the Union Council shall not formally process issues related to the yearplan of the Executive Committee and the master budget of the Union of the current session. (Amended GM2 of 2001) Chapter 7: Standing Committee 7.1 Definition Standing Committee shall be a standing association subordinate to the Union Council, and assists the Union Council in supervising, managing and guiding relevant affairs of organizations subordinate to the Union during the adjournment. 7.2 Duties: 7.2.1 Subject to the Terms of Reference of every Standing Committee. - 13 - Constitution of The Hong Kong Polytechnic University Students’ Union 7.2.2 The terms of reference of every Standing Committee shall be formulated by the Union Council. 7.3 The establishment and dissolution thereof shall be decided at a Union Council Meeting. 7.4 Members thereof shall be publicly nominated by all Union members and appointed at a Union Council Meeting. (Amended GM2 of 2001) 7.5 Work thereof shall be subject to the Union Council. Chapter 8: Union Judicial Council 8.1 Definition: The Union Judicial Council (hereinafter referred to as “UJC”) shall be the supreme judicial authority responsible for all arbitration and judicial issues of the Union. 8.2 8.3 Authorities: 8.2.1 The authorities of the UJC shall be only inferior to the General Meeting and any organization shall be subject to the verdict of the UJC. 8.2.2 The UJC shall not arbitrate any private dispute unrelated to the Constitution of the Union. Duties: 8.3.1 Punishes members and organizations violating the Constitution of the Union in accordance therewith. 8.3.2 Settles and arbitrates all prosecutions in the Union. 8.3.3 Settles prosecutions or arbitrates disputes among organizations and between members and organizations. 8.3.4 Verdicts in accordance with the principal spirit and purposes of the Constitution of the Union. 8.3.5 The UJC may require any member or organization of the Union to provide relevant materials of a certain affair, where such member or organization shall be notified three (3) working days in advance in written. 8.3.6 The UJC may summon any member or organization representatives to attend litigation meetings. 8.3.7 Settles appeals of the Union’s staffs on its regulations and contracts. The term of office thereof shall be the same as that of the Union Council. 8.9.2.2 Members are not elected as Chairperson or Vice Chairperson shall be the committee member of UJC. 8.9.2.3 In case of absence of the Chairperson, or when, is anticipated unable to act for three (3) months thereafter, members shall appoint mutually to assume the Acting Chairperson in Ordinary Meeting. Meeting: The meeting shall be classified into Ordinary Meeting and Litigation Meeting. 8.11 8.10.1 An Ordinary Meeting shall handle the routines of the UJC and be convened at least once every three (3) months. Results of motions shall bind the UJC members and the secretariat. The first Ordinary Meeting shall be convened between the annual meeting and first ordinary meeting of Union Council in the same session by UJC members. Chapter 13: Faculty/School Students’ Association 13.1 The representatives of the Faculty/School Students’ Association shall comprise the Union members studying in the same faculty or school, and the Faculty/School Students’ Association shall be the association representing the Faculty/School Students’ Association members, and responsible for striving for the welfare and the interests of the members thereof, and shall be supervised by the Union Council. 13.2 All Faculty/School Students’ Associations shall comply with the Regulations for Faculty Students’ Association formulated by the Union Council. 13.3 Structure of Faculty/School Students’ Association: 13.3.1 Referendum: A Referendum of the Faculty/School Students’ Association shall be the supreme decision-making authority of the Association. 13.3.2 General Meeting: A General Meeting of the Faculty/School Students’ Association shall be the decision-making authority of the Association. The authority thereof shall only be inferior to a Referendum. 13.3.3 Faculty Council: The Faculty Council shall be entitled to the right of legislation and supervision, with the authority thereof only inferior to the decision of a General Meeting of the Association. 13.3.4 Executive Committee: The Faculty/School Executive Committee shall be the supremeadministrative authority of the Association comprises members studying in the same faculty, and is responsible for the routines and administrative workof the Association, communicates with the external on behalf of the - 26 - Constitution of The Hong Kong Polytechnic University Students’ Union members of the Association and shall be subject to the Faculty Council. (Amended GM1 of 2017) 13.3.5 Departmental Students’ Society / Course Club: (Amended GM1 of 2017) The Departmental Students’ Society / Course Club comprises members studying in the same department or course, communicates with the external on behalf of members of the Society or Club, provides academic, cultural and recreational activities for members, and shall be subject to the Faculty Council. 13.3.6 (Repealed GM1 of 2017) Chapter 14: Annual Election 14.1 Definition: The Annual Election aims at electing the Executive Committee members of the following session, the Press Committee generally elected members, the Campus Radio generally elected members, all directly elected councilors of the Union Council, the Faculty/School Executive Committee members, the Departmental Students’ Society Executive Committee members and the Course Club Executive Committee members. Election of the Press Committee generally elected members: 14.5.1 Election form: Cabinetmaking election form shall be adopted for the Press Committee generally elected members, and the whole members shall be elected with simple majority. (Amended GM1 of 1997) 14.5.2 Qualification of candidates: 14.5.2.1 Candidates shall be the Union members. 14.5.2.2 All candidates shall not run for two (2) or more posts in the election. 14.5.2.3 Except candidates for the Editor-in-chief, all candidates may participate in other candidate cabinets. 14.5.2.4 Among the members of the same candidate cabinet, there shall not be more than three (3) persons studying in the same department. 14.5.3 Nomination: 14.5.3.1 The candidates for Editor-in-chief shall be nominated by one (1)person and seconded by ten (10) persons. The nomination shall be subject to the rules formulated by the Election Committee of the Union Council and conducted within the period designated. Election of the Campus Radio generally elected members: (Added GM1 of 2015. Voting system for annual election: 14.7.1 All Union members shall be entitled to the voting right. 14.7.2 Secrete direct voting method shall be adopted. 14.7.3 The voting time shall not be less than eight (8) hours. - 29 - Constitution of The Hong Kong Polytechnic University Students’ Union 14.8 14.7.4 The vote counting shall be conducted within twenty-four (24) hours after the voting. 14.7.5 During the vote counting, the staff of the University shall be the scrutineer. 14.7.6 When the number of valid votes exceeds one-tenth of the number of the Union members, the candidates or candidate cabinets obtaining most votes of confidence or the candidates or candidate cabinets obtaining more votesof confidence than that of no confidence shall win the election legally. Election of directly elected councilors of the Union Council: 14.8.1 Election form: Directly elected councilors of the Union Council shall be elected by the whole members of all Faculty/School Students’ Associations in the annual election. (Amended GM1 of 2006) 14.8.2 Qualification of candidates: Candidates shall be the Faculty/School Students’ Association members. 14.8.3 Nomination: 14.8.3.1 The candidates for the directly elected councilors shall be nominated by one (1) person and seconded by five (5) persons. The nomination shall be subject to the rules formulated by the Election Committee of the Union Council and conducted within the period designated. (Amended GM1 of 2006) 14.8.3.2 The nomination period shall not be less than two (2) weeks. 14.8.4 Election procedure: 14.8.4.1 All the Faculty/School Students’ Association members shall be entitled to the voting right. 14.8.4.2 Secrete direct voting method shall be adopted. 14.8.4.3 The voting time shall not be less than eight (8) hours. 14.8.4.4 The vote counting shall be conducted within twenty-four (24) hours after the voting. 14.8.4.5 During the vote counting, the staff of the University shall be the scrutineer. 14.8.4.6 When the number of valid votes exceeds one-sixth of the number of the Faculty/School Students’ Association members, the candidates obtaining most votes of confidence or the candidates obtaining more votes of confidence than that of no confidence shall win the election legally. - 30 - Constitution of The Hong Kong Polytechnic University Students’ Union 14.9 Election of all Faculty/School Executive Committee members, of all Departmental Student’s Societies Executive Committee members and of theall Course Club Executive Committee members: (Added GM1 of 2006) 14.9.1 Election form: Subject to the Regulations for Election formulated by the Union Council. 14.10 Election results: 14.10.1 After the vote counting, the initial election results shall be posted immediately. (Added GM1 of 1998) 14.10.2 Three (3) working days after the vote counting, the Union Council shall convene a meeting to formally approve the election results. 14.11 Complaint: 14.11.1 Any complaint in respect of any violation to all relevant Regulations for Election of candidates or candidate cabinets shall be lodged tothe Election Committee of the Union Council in written in the period from the commencement date of the nomination to two (2) working days after thevote counting. (Added GM1 of 2006) 14.11.2 Any other complaint relevant to an election shall be lodged to the Union Council in written within the period from the commencement of the nomination to two (2) working days after the vote counting. (Amended GM1 of 2006) 14.11.3 In case that any relevant complaint fails to be settled, the Union Council shall not formally approve and announce the election results. (AmendedGM1 of 1997; GM1 of 1998) 14.12 Re-Election: In case that the voting results shall be the same or two-thirds or more of the members with voting right of the Union Council Meeting vote in favor of the re-election, the Election Committee of the Union Council shall resettle the election affairs within two (2) weeks after such meeting. (Amended GM1 of 2006; GM1 of 2017) 14.13 By-Election: 14.13.1 In case of vacancy of the Executive Committee member, the Press Committee member or the Campus Radio member, the Union Council shall conduct a by-election with specific agenda. (Amended GM1 of 2017) 14.13.2 The candidates in a by-election of the Executive Committee members shall be nominated by the Executive Committee of the current session. (Amended GM1 of 1997) - 31 - Constitution of The Hong Kong Polytechnic University Students’ Union 14.13.3 Candidates in a by-election of the Press Committee generally elected members shall be nominated by the Press Committee. (Amended GM1 of 1997; GM1 of 2017) 14.13.4 Candidates in a by-election of the Campus Radio generally elected members shall be nominated by the Campus Radio of the current session. (Added GM1 of 2017) 14.13.5 The members by-elected through specific agenda of the Union Council shall not be entitled to the voting right at a Union Council Meeting. (Added GM1 of 1997. Amended GM1 of 2005; GM1 of 2017) Chapter 15: Affiliated Association 15.1 Affiliation: 15.1.1 Any students’ association in the Hong Kong Polytechnic University shall apply to the Union for affiliation or exempt from being affiliated to the Union. 15.1.2 The Union Council shall be entitled to accept or reject an application for affiliation or exempt from being affiliated. 15.1.3 Only the associations affiliated to the Union shall be the legal students’ associations of the Hong Kong Polytechnic University and shall be entitled to the name of “The Hong Kong Polytechnic University Students’ Union”. 15.1.4 Exempt from being affiliated: The exempt from being affiliated associations approved by the Union shall be entitled to the name of “The Hong Kong Polytechnic University Students’ Union”, provided that it shall comply with the regulations for exempt from being affiliated associations formulated by the Union. 15.1.5 15.2 The Union Council may cancel the affiliation qualification of any affiliated association. Responsibilities: All external affairs and the activities that may influence the Union of all affiliated associations shall be subject to the Union Council. 15.3 Obligations: 15.3.1 All affiliated associations shall disclose the internal affairs thereof to the Union Council and members thereunder. 15.3.2 All affiliated associations shall well manage accounts. 15.3.3 All accounts shall be reviewed by the Union Council. - 32 - Constitution of The Hong Kong Polytechnic University Students’ Union 15.4 Affiliated Club: The establishment of an affiliated club aims at the association of the members with the same interest. 15.5 All affiliated associations and affiliated clubs shall comply with the Regulations for Affiliated Associations formulated by the Union Council. (Amended GM1 of 1998) Chapter 16: Finance 16.1 The financial year shall be the same as the year of the Union. 16.2 Membership fee: 16.3 16.2.1 The membership fee of the Students’ Union in the current session shall be fluctuated annually, upon approval in General Meeting, on the basis of the membership fee of the previous session, and the fluctuation rate shall be referred to the inflation ratio announced by the Government of Hong Kong Specific Administrative Region in the previous year. (Amended GM1 of 2000; GM2 of 2001; GM1 of 2020) 16.2.2 New ordinary member shall settle membership fee upon joining the Union, membership thereof shall valid through the period of study in the registered program. The baseline of the membership fee of the ordinary members of the Students’ Union studying in Undergraduate programs shall be HKD Three Hundred and Sixty only (HKD 360); the baseline of the membership fee of the ordinary members studying in Higher Diploma and 2-year curriculum programs shall be HKD Two Hundred and Seventy only (HKD 270). (Added GM1 of 2020) 16.2.4 (Repealed GM2 of 2001) Fund: 16.3.1 Surplus of the Union in each financial year shall be allocated to the fund of the Union. (Amended GM1 of 1998; GM1 of 1999; GM1 of 2000; GM2 of 2001; GM2 of 2003; GM1 of 2005; GM1 of 2017; GM1 of 2020) 16.3.2 (Repealed GM1 of 2020) - 33 - Constitution of The Hong Kong Polytechnic University Students’ Union 16.3.3 The use of the fund of the Union shall be approved at the Union Council Meeting in specific agenda. The fund shall be used with at least two-thirds or more of the attendants with voting right voting in favor thereof. 16.4 The Financial Secretary of the Executive Committee shall well manage all accounts of the Union. 16.5 Investment: Any investment or resale investment made by the fund of the Union shall be implemented when approved at the Union Council Meeting in specific agenda, and with at least two-thirds or more of the attendants with voting right voting in favor thereof. 16.6 The Financial Secretary of any organization subordinate to the Union shall handle financial affairs in accordance with the Financial Regulations formulated by the Union Council. 16.6.1 The Financial Secretary of every organization subordinate to the Students’ Union shall draft master budget in accordance with the Financial Regulations formulated by the Union Council and submit such budget to the Union Council Meeting for approval. 16.6.2 Half a year after the succession, the Financial Secretary shall revise the master budget and submit to the Union Council Meeting for approval. 16.7 Bank cheques of the Union shall come into effect only upon signatures of two among the President, the Internal Vice President and the Financial Secretary. 16.8 Every organization subordinate to the Students’ Union shall submit interim and final financial reports to the Union Council in accordance with the Financial Regulations formulated by the Union Council. 16.9 All financial accounts of the Union shall be audited by the Auditing Commission of the Union Council. Chapter 17: Punishment 17.1 Any member may, in case of any behavior that prejudice the interest of the Union or the violation of the Constitution, By-laws and any regulations of the Union, face the following punishments: 17.1.1 Freezing of member rights: In case that any member fails to perform the member obligations thereof or violates the Constitution of the Union, and approved at the Union - 34 - Constitution of The Hong Kong Polytechnic University Students’ Union Judicial Council meeting, the Union Judicial Council may freeze all member rights thereof, with the period decided by the Union Judicial Council through discussion. (Amended GM2 of 2001) 17.1.2 Membership expulsion: In case that any member fails to perform the member obligations thereof or violates the Constitution of the Union, and voted in favor by all the Union Judicial Council members in the current session at the Union Judicial Council meeting, the Union Judicial Council may convene a General Meeting to discuss and cancel the membership thereof. 17.2 All relevant materials of any member punished shall be posted on the notice board of the Union, with the posting time of not less than one (1) week. 17.3 All relevant materials of any member whose right was once frozen but restored shall be posted on the notice board of the Union, with the posting time of not less than one (1) week. 17.4 All punishments shall be executed by the Union Judicial Council or the organizations authorized by the Union Judicial Council depending on specific situations. (Amended GM1 of 1998) Chapter 18: Dissolution 18.1 The dissolution of the Union shall be with three-fourths or more of the whole members voting in favor thereof. 18.2 The Union Council shall fully disclose all affairs, financial status and impact after the dissolution to all members prior to the dissolution of the Union, and well handle all assets of the Union. 18.3 Upon the dissolution of the Union, the Union Council shall make a formal declaration. Chapter 19: Miscellaneous 19.1 Election (Added GM1 of 2006) The election of all organizations subordinate to the Union shall be conducted in accordance with the Regulations for Election formulated by the Union Council. 19.2 Concurrent assumption: The Union member shall not concurrently assume two (2) generally elected posts in the same year, including Executive of the Executive Committee, directly elected - 35 - Constitution of The Hong Kong Polytechnic University Students’ Union councilors of the Union Council, the Press Committee generally elected member, the Campus Radio generally elected member, Executive of the Faculty/School Executive Committee, Executive of the Departmental Students’ Society Executive Committee and Executive of the Course Club Executive Committee. (Amended GM1 of 2015; GM1 of 2017) 19.3 Responsibilities: The Union Council and Executive Committee shall be liable for the legal responsibilities of the Union to the external. 19.4 Amendment of the Constitution of the Union The amendment of the Constitution of the Union shall be proposed by the Union Council and submitted to the General Meeting for discussion in specific agenda; or the amendment shall be passed with two-thirds or more of the Union Council meeting attendants with voting right voting in favor, then approved in a Referendum. The Constitution of the Union approved shall come into effect after submitted to the Societies Office. (Amended GM1 of 2017) 19.5 Interpretation of the Constitution of the Union: The Constitution of the Union shall be subject to the interpretation of the Union Judicial Council. 19.6 By-law for the Constitution of the Union: By-law for the Constitution of the Union shall be formulated by the Union Council for the purpose of supplementing the inadequacy of the Constitution of the Union, so as to smoothly promote the internal affairs of the Union. The Union Council shall amend the By-law with two-thirds or more of the attendants with voting right voting in favor of the amendment. 19.7 Standing orders: The standing orders of the Union shall be formulated by the Union Council for the purpose of ensuring the respective meetings of the Union to be convened in accordance with the correct procedures. The Union Council shall amend the standing orders with two-thirds or more of the attendants with voting right voting in favor of the amendment. 19.8 Withdrawal from the Union: (Added GM1 of 1998) 19.8.1 The Union members, including ordinary members and associate members, shall be entitled to withdraw from the Union in any time. (Amended GM1 of 1999; GM1 of 2017; GM1 of 2020) 19.8.2 Refund of membership fee: - 36 - Constitution of The Hong Kong Polytechnic University Students’ Union An ordinary member or associate member whom has not proceed with any privileges of the Union shall submit the payment proof with applicationform to the office of the Students’ Union within fourteen (14) days of the settlement of payment, upon approval of the Executive Committee, such material shall be submitted to the Finance Office for handling and refund. (Amended GM1 of 2008; GM1 of 2017; GM1 of 2020) 19.8.3 Rights and obligations The Union members, including ordinary members and associate members, shall lose all rights and obligations described in the Constitution of the Union after the withdrawal from the Union thereof.
