PREFATORY STATEMENT

WHEREAS, the Sangguniang Panlungsod received an endorsement letter from
6
the City Mayor’s Office (CMO) dated August 19, 2021 requesting for a supplemental
7
appropriation for various projects among which is the Construction of Public Buildings
8
and Facilities-Construction Of Police Building (Phase 1) at Brgy.Dolores amounting to
9
Seven Million Philippine Pesos ( Php 7,000,000.00);
10
WHEREAS, the aforementioned request was deferred due to some clarifications
11
on the deed of usufruct between the lot owners where the building will be built and
12
LGU Ormoc;
13
WHEREAS,
in an Opinion dated April 23, 2021, the City Legal office finds
14
nothing legally objectionable in the said Deed of Usufruct and that the same is not
15
contrary to law, morals, public order, or public policy much less detrimental to the
16
best interest of the city;

WHEREAS, this Sanggunian previously passed Resolution 2021-118 granting
authority to the City Mayor to sign the aforementioned usufruct;
19
WHEREAS, the request was referred to the Offices of the City Budget Officer,
20
City Accountant, and the City Treasurer for appropriate recommendations as to the
21
funding source thereof and in this respect LBP Form No. 8 and LBP Form No. 9 were
22
consecutively issued by the concerned offices certifying therein that the amount of
23
Seven Million Philippine Pesos ( Php 7,000,000.00) is deemed available for the
24
aforementioned purpose, herein attached as Annex “A” and “B” respectively;
25
WHEREAS, this Sanggunian finds the request for supplemental appropriation
26
justified and deemed reasonable and meritorious and for the best interest of the
27
development of Ormoc City, hence, most deserving of prompt favorable action;

WHEREFORE, FOREGOING PREMISES CONSIDERED, on motion of SP Member

Peter M. Rodriguez, Chairman, Committee on Finance & Appropriation, seconded by

BE IT ORDAINED, by the Fifteenth Sangguniang Panlungsod of Ormoc in Regular
Session assembled, that:

Section 1. The Supplemental Budget of the City of Ormoc for Fiscal Year

SECTION 2. SEPARABILITY CLAUSE. Should any part or provision of this

Ordinance be held unconstitutional and declared invalid by competent court, other

parts or provisions hereof are not affected thereby shall continue to be in full force

and effect.

SECTION 3. EFFECTIVITY. This Ordinance shall take effect immediately following

compliance with the publication and posting requirements in the Local Government

Code of 1991.
