by overt acts. In this case, use of
tools to supposedly steal catalytic
converter from car.
b.) He does not perform all the acts
of execution which should produce
the felony. In this case, he was not
able to perform all the acts of
execution since the catalytic
converter was already cutoff a few
days before.
c.) The offender’s acts are not
stopped by his own spontaneous
desistence. In this case, offender is
not aware that owners already cut
them off prior and were waiting for
its insurance.

a.) The offender performs all the acts of
execution. In this case, offender has
already taken the item from the shop and
was headed to exit the store.
b.) All the acts performed would produce
the felony as a consequence.
c.) But the felony is not produced. In this
case, offender was stopped by the
employee going out.
d.) By the reason of causes independent
of the will of the perpetrator. In this case,
offender did not expect the employee saw
her and chase her for taking the item
unpaid.
