TERMS AND CONDITIONS
CONTRACT CONDITIONS – PLEASE READ CAREFULLY
ACCEPTANCE: This proposal when accepted by the credit department of Missouri Storm Shelters (a division of
Carnahan-White, LLC.) becomes a binding contract between the parties and can only be canceled by the buyer paying a
10% cancellation charge to Missouri Storm Shelters. If any part of this contract is changed after Missouri Storm
Shelters begins work under the contract, buyer will be charged for all new components, materials and $125.00 per hour
for each additional hour incurred by Missouri Storm Shelters as a result of buyer’s change.
PAYMENT: Buyer promises to pay in full any balance due on this contract when Missouri Storm Shelters has
substantially completed its work under this contract. On all balances which remain due more than 10 days after
Missouri Storm Shelters has substantially completed its work under the contract – buyer promises to pay to Missouri
Storm Shelters 1½% monthly interest. If payment is not made within 10 days after Missouri Storm Shelters has
substantially completed its work under the contract, Missouri Storm Shelters may take at its sole discretion, any and/or
all remedies available to it under law, including, but not limited to, a repossession of any and/or all of the materials
provided to the buyer by Missouri Storm Shelters pursuant to this contract. By execution of this contract, Buyer grants
to Missouri Storm Shelters a purchase money security interest in any and all of the materials provided to Buyer
pursuant to this contract and Buyer further grants all rights necessary to repossess any or all of said material including,
but not limited to, the right to enter onto Buyer’s property for purposes of removing said materials. Missouri Storm
Shelters shall exercise ordinary care in the removal of said materials but shall not be responsible for any damages
claimed by Buyer against Missouri Storm Shelters whether said damage was alleged to be intentionally or negligently
caused. Should Missouri Storm Shelters place this account in the hands of an attorney for collections, buyer agrees to
pay all court costs, attorney fees, and other expenses incurred by Missouri Storm Shelters.
WARRANTIES: Missouri Storm Shelters (a division of Carnahan-White LLC.) warrants to the original purchaser all
labor and materials furnished to purchaser for a period of 90 days following date of completion of installation except
for failure resulting from abuse or for any use of the product or materials in a manner not intended. This warranty is in
addition to any factory warranties of any component parts which may exist. Written notice of failure covered by this
warranty shall be mailed by the original purchaser to Missouri Storm Shelters, 1845 S. State Hwy MM, Springfield,
MO 65810. The components or material claimed to have failed must be made available at the place of installation for
inspection on behalf of Missouri Storm Shelters for the purpose of determining whether the claimed failure is covered
by this warranty.
Missouri Storm Shelters shall not be liable for any incidental or consequential damages and its liability shall only
extend to the replacement of the component or material. This warranty is the only warranty extended by Missouri
Storm Shelters and all oral or implied warranties are hereby excluded. This warranty gives you specific legal rights
and you may also have other legal rights which vary from state to state.
OWNER RESPONSIBLE FOR DAMAGE TO UNDERGROUND UTILITIES AND IMPROVEMENTS: Buyer
is solely responsible for locating, staking, and clearing property lines. Missouri Storm Shelters will notify the
appropriate One Call Network to locate underground facilities. Buyer is solely responsible for locating, marking, and
repairing, if damaged, any underground facilities which are not located and marked by the One Call Network. Missouri
Storm Shelters is not responsible for damage to sprinkler systems and other underground improvements or obstructions.
If buyer elects to place any and/or all of the materials in an area encompassing a utilities easement, buyer agrees to pay
all costs incurred by Missouri Storm Shelters, including, but not limited to, removing or relocating the underground
facility.
WARNING: THE MANUFACTURER, WHOLESALER AND/OR INSTALLER ASSUME NO LIABILITY FOR
ANY INJURY RESULTING FROM MISUSE SUCH AS CLIMBING, SCALING, UNDERPASSAGE, OR OTHER
ACTIVITY RELATED TO ANY GATE INSTALLED BY IRONWORKS BY CARNAHAN-WHITE.
