Competent Person
“Competent person” means one who is
capable of identifying existing and
predictable hazards in the surroundings or
working conditions which are unsanitary,
hazardous, or dangerous to employees, and
who has authorization to take prompt
corrective measures to eliminate them.
Qualified Person
“Qualified” means one who, by possession of
a recognized degree, certificate, or
professional standing, or who by extensive
knowledge, training, and experience, has
successfully demonstrated his ability to
solve or resolve problems relating to the
subject matter, the work or the project.

Through numerous court challenges and other
decisions OSHA has extrapolated a simple
section of the act to mean the following:

construction and non-construction, citations
normally shall be issued to employer whose
employees are exposed to hazards (the
exposing employer).

The employer who actually creates the
hazard (the creating employer);

The employer who is responsible, by contract
or through actual practice, for safety and
health conditions on the work site; I.e. the
employer who has the authority for ensuring
that the hazardous condition is corrected
(the controlling employer);
